Bineshri Prasad applies for judicial review, under the Administrative Decisions (Judicial Review) Act 1977, of a decision of the respondent refusing his application for a permanent entry permit allowing him to reside indefinitely in Australia. He is a citizen of Fiji. In February 1979 the applicant, then aged 25 years, entered Australia as a visitor pursuant to a temporary entry permit valid for three weeks. He stayed with his brother, Sarda Prasad, who has resided in Sydney, since 1973. He made application for a further temporary permit
but this was refused. Nevertheless he remained in Australia
until May 1979, when he was detained as a prohibited immigrant.
