- The applicant's claim for compensation by way of exemplary damages for loss of goodwill, not having been pressed in the hearing is dismissed.
At no other point in either the reasons of Judge Lacava or the orders which his Honour delivered is mention made of the loss of opportunity to expand the business which resulted from the actions of the Defendant.
87 In any event, even if an issue estoppel did arise in this respect, it would not, in my view, have made any difference to the outcome of the proceedings before Senior Member Riegler. There is nothing to suggest any error of law with respect to the Plaintiff's claim for damages for loss of opportunity in this respect or that on the evidence, or lack of it, which was before the Tribunal, any finding or award of damages would have been other than mere speculation.
