"Yes?---The only thing I can remember about that is that Maller and Clifford had got a newspaper with the football - it was on the front of this local paper, stating that there was a proposed thing for a soccer stadium across the road from the pub. I think it's true to say that everybody involved was rather excited if that was going to happen, because obviously it would've been a good thing.
Did you represent to Mr Clifford that that was going to happen and that would ensure the commercial success of the bottle shop?---No, that never had anything to do with the commercial success or it going to happen. They were going to proceed with it, as they did, irrespective of whether that occurred.
I see. Then it is said further that at Mr Maller's offices you represented to Mr Clifford that Kee-Vee could not agree to an initial rental of $55,000 per annum and the initial rent would have to be $85,000 per annum?---That was not at anybody's office. That was at Maller's house on a Sunday. That was when we had the meeting and we nutted it all out and we agreed it. Prior to that, look, I can't be responsible for what Maller and Clifford discussed amongst themselves. I wasn't privy to that discussion, but the only thing I attended was a meeting on a Sunday at Maller's home, nobody's office, when the rental was discussed.
It's then said that you represented that to compensate Newmarket for the increase in rental, Kee-Vee would sell to the first plaintiff $35,000-worth of plant and equipment at the hotel in accordance with a schedule to be provided?---Yes, I heard that evidence. That's not true.
Then you represented as well, it is said, that the redevelopment would be completed within 12 to 16 weeks?---I hardly think so. I wouldn't know. I've never done this before. I mean, it had to have all sorts of discussions with architects, plans, different permissions from various councils and different governing bodies, Main Roads. All sorts of people were involved in a development like this. I couldn't have said and would not have said that, no.
