What it does
The Superannuation Act 1916 (NSW) establishes and governs the State Superannuation Fund for NSW public servants. It creates a defined benefit pension scheme administered by STC (now Aware Super), providing retirement pensions, invalidity pensions, and death benefits. The scheme has been closed to new entrants since 1 July 1985 (section 1A), but remains fully operational for its legacy membership base of contributors who joined before that date and their beneficiaries.
The Act sets out the entire structure of the scheme: the Fund (Part 2), contributions (Part 3), pensions and benefits (Part 4), family law provisions (Part 4A), privatisation-related entitlement transfers (Part 5), and general governance provisions (Part 7).
