Plain English Summary
3/10 complexity
This regulation prescribes the Pacific Airshow Gold Coast (16–18 Aug 2024) as a major event, names Pacific Airshow Pty Ltd as the organiser, fixes specific major event and controlled areas and exact event and control periods, and sets temporary works windows (secs 3–6, 9–12). It declares an official logo and title and authorises crowd controllers and security officers to exercise certain powers while reserving some powers to police (secs 13–16). It therefore changes who can control access, carry out works, and enforce rules during the stated times and places.
This regulation prescribes the Pacific Airshow Gold Coast 2024 as a major event for the purposes of the Act that the regulation repeatedly references. It sets the organiser, the major event areas, the major event period, the controlled area and control period, the specific provisions of the Act that will apply in those places and times, temporary works windows, the event’s official logo and official title, and who may be an authorised person for the event. Key mechanical changes are:
The event itself is prescribed as a major event (sec.3). The regulation names the event “Pacific Airshow Gold Coast”.
Pacific Airshow Pty Ltd ACN 647 800 539 is prescribed as the major event organiser (sec.4).
Major event areas are prescribed by reference to schedule 1, column 1 (sec.5).
The major event period is prescribed as 16 August 2024 from 6.00am to 18 August 2024 at 5.30pm (sec.6).
The regulation prescribes that, for the major event period, particular provisions of the Act apply: notably section 31, other than subsection (1)(a), and section 36 (sec.7).
It prescribes which provisions of the Act apply to particular major event areas for the periods stated in schedule 1 (sec.8).
A controlled area is prescribed by reference to the map in schedule 2, part 7 as the Surfers Paradise controlled area; other maps are included for information only (sec.9).
The control period for the controlled area is identical in dates and times to the major event period (sec.10).
Sections 30 to 35 of the Act are prescribed to apply to the controlled area for each of the three dates between 16 and 18 August 2024 during daily windows of 6.00am to 5.30pm (sec.11).
Temporary works rules under section 16 of the Act are applied to Appel Park and Surfers Paradise major event areas, with works windows before and after the major event (sec.12).

The event logo in schedule 3 (and a black and white copy) and the title “Pacific Airshow Gold Coast” are declared to be official under the Act’s section 51 headings (secs.13-14).
The regulation prescribes additional authorised persons for the event to include crowd controllers and security officers (sec.15), defined by reference to the Security Providers Act 1993 (sec.2). It imposes limits on which authorised persons may exercise particular powers of the Act (sec.16).
All prescriptions operate by declaring that specific sections of the Act apply to the event, areas or periods listed in the regulation. The regulation is limited in scope to those prescriptions, to the temporary works windows, and to authorisations and logo/title declarations. The regulation repeatedly references the Act for the substance of powers, offences, obligations and enforcement; the Act itself is not reproduced in this regulation.
Main concepts
The regulation operationalises a short list of administrative mechanisms that attach the Act’s substantive powers and rules to (1) a named event, (2) prescribed locations and maps, and (3) defined time windows. The principal conceptual elements are:
Prescription of a major event: sec.3 formally brings the Pacific Airshow Gold Coast within the Act’s major events machinery. The regulation does not itself restate the Act’s criteria for a major event. Instead, it declares that for the Act’s section 12(1) the event is prescribed.
Designation of an organiser: sec.4 prescribes Pacific Airshow Pty Ltd ACN 647 800 539 as the major event organiser under section 12(2)(a) of the Act. That designation allocates the statutory role the Act gives to an organiser; the regulation does not reproduce the Act’s duties that attach to that role.
Spatial prescription: sec.5 and schedule 1 identify major event areas, referencing schedule 1 column 1. The controlled area is prescribed by map in schedule 2 part 7 (sec.9). The regulation uses maps in schedule 2 (multiple parts) to define areas. It also notes that some maps are included for information only (sec.9 second paragraph).
Temporal prescription: sec.6 sets the major event period precisely: starting 16 August 2024 at 6.00am and ending 18 August 2024 at 5.30pm. Sec.10 repeats the same dates and times as the control period for the controlled area. Sec.11 prescribes narrower daily windows for the controlled area application of the Act’s sections 30 to 35, namely 6.00am to 5.30pm on each of 16, 17 and 18 August 2024.
Application of Act provisions: the regulation does not itself impose the substance of event powers and offences; rather, it prescribes which sections of the Act apply in which places and when. Examples include: for the major event period, section 31 (except subsection (1)(a)) and section 36 of the Act are applied (sec.7). For the controlled area, sections 30 to 35 of the Act are applied for specified daily windows (sec.11). For major event areas, schedule 1 column 2 lists which Act provisions apply to each area and the period those provisions apply (sec.8).
Temporary works windows: sec.12 prescribes the areas (Appel Park and Surfers Paradise as shown in schedule 2 parts 1 and 7) to which section 16 of the Act applies for specified pre-event and post-event periods (5-16 August 2024 and 18-23 August 2024 with precise daily start and end times).
Official branding: secs.13 and 14 declare an official logo (schedule 3) and the official title “Pacific Airshow Gold Coast” for the purposes of section 51(1)(a) and (b) of the Act.
Authorised persons and limits on their powers: sec.15 prescribes crowd controllers and security officers as additional authorised persons for the event under section 56(1)(d) of the Act, with those terms defined by reference to the Security Providers Act 1993 (sec.2). Sec.16 imposes limits on the exercise of particular powers of the Act by specifying which categories of authorised persons may exercise certain powers; for example, some powers may only be exercised by police officers, while others may be exercised by police officers, crowd controllers or security officers, as detailed in sec.16.
Mechanically, the regulation is a schedule of prescriptions tying statutory powers and duties from the Act to a concrete event, place and time. It does not itself create new substantive offences or powers; it delegates to the Act for those details. The definition cross-references to the Security Providers Act 1993 bring in existing private security categories for operational use during the event.
Who it affects
The regulation identifies a specific set of actors who will be affected by its prescriptions. These actors are affected because the regulation attaches the Act’s sections to them, to the locations where they operate or to their operational windows. The main categories are:
The major event organiser: Pacific Airshow Pty Ltd ACN 647 800 539 is prescribed as the major event organiser (sec.4). Any duties, obligations or liabilities that the Act attaches to “major event organisers” will therefore apply to that corporate entity during the major event period and inside the prescribed areas where the Act’s provisions are applied. The regulation itself does not list those duties; it effects the legal connection.
Attendees, participants and members of the public in major event areas: the regulation prescribes major event areas in schedule 1 (sec.5) and prescribes that certain Act provisions apply to those areas for particular periods (sec.8). People who enter or operate within those areas during the prescribed times will be subject to the Act provisions that the regulation applies to the area.
Persons inside the Surfers Paradise controlled area: sec.9 prescribes the area shown on the map in schedule 2 part 7 as the controlled area and sec.11 prescribes that sections 30 to 35 of the Act apply in that controlled area during specified daily windows. Therefore, inhabitants, visitors, businesses, vendors, property owners and passers-by inside that mapped controlled area during those windows are directly subject to the Act provisions applied there.
Authorised persons: sec.15 prescribes that, for the event, authorised persons include crowd controllers and security officers in addition to other categories the Act provides. The regulation defines “crowd controller” and “security officer” by reference to the Security Providers Act 1993 sections 5 and 7 respectively (sec.2). That pulls in persons who meet those statutory definitions and places them within the event’s authorised-person framework. Sec.16 then narrows which powers particular authorised persons may exercise by reference to the Act’s specified sections, meaning that authorised persons will have different operational capacities depending on their category.
Police officers: although not named as prescribed in sec.15, police officers are singled out in sec.16 as the only category permitted to exercise a range of specified powers under the Act for the event (secs.16(2) and 16(3)). That affects police operational roles and their interface with non-police authorised persons during the event.
Providers of temporary works, contractors and site occupiers in Appel Park and Surfers Paradise: sec.12 prescribes application of section 16 of the Act to those major event areas and sets specific pre- and post-event windows when temporary works may be carried out. Contractors and property managers intending works in those areas during the windows will be affected.
Businesses using the event’s branding or claiming official endorsement: secs.13 and 14 declare an official logo (schedule 3) and the official title “Pacific Airshow Gold Coast”. Any person or business that seeks to use the official logo or title in ways that claim official status will be affected by those declarations because the Act’s regime for official logos and titles (section 51 of the Act) will govern permitted uses.
Owners and operators of infrastructure and property in the mapped areas: because the regulation ties Act provisions to named areas and maps in schedule 2, owners and operators of built infrastructure within those mapped parts (including schedule 2 parts 1 through 7) will need to consider the event’s times and the Act provisions made applicable to their locations.
Event staff and security suppliers: the use of crowd controllers and security officers as authorised persons (sec.15) and the Security Providers Act cross-reference (sec.2) mean that private security firms, their employees and credential holders will have altered operational roles during the event, subject to the Act provisions and the limits in sec.16.
The regulation’s cross-references define the affected persons by legal category rather than by a descriptive list. That means the precise practical obligations on persons in these categories depend on the content of the sections of the Act that the regulation applies to the event areas and periods.
Key duties and rights
The regulation itself primarily specifies which provisions of the Act apply and when; it does not restate the operative content of those provisions. Nonetheless, the regulation creates duties and confers operational rights by binding those Act provisions to event-specific places and times. Key duties and rights established or triggered by the regulation are:
Duties and rights tied to the major event organiser: sec.4 prescribes Pacific Airshow Pty Ltd ACN 647 800 539 as the major event organiser under the Act’s framework (section 12(2)(a) of the Act). Any duties the Act assigns to a major event organiser, such as planning, safety coordination, or compliance obligations, are therefore triggered for that entity for the major event period and in the applicable areas. The regulation does not restate those duties; it effects the assignment.
Rights and restrictions inside major event areas: sec.8 prescribes the Act provisions that apply to each major event area listed in schedule 1, column 1, for the periods in schedule 1, column 3. That creates legal obligations for persons within those major event areas during the stated times under the Act’s applied provisions. For example, if the Act’s provisions applied to an area include powers to direct movement or prohibit objects, those powers will be exercisable in that area during the stated period because of sec.8.
Control and movement powers in the controlled area: sec.9 prescribes the Surfers Paradise controlled area by reference to the map in schedule 2 part 7; sec.10 prescribes the control period; sec.11 prescribes the application of sections 30 to 35 of the Act to that controlled area for the specified daily windows. Those prescriptions create operational rights for authorised persons (and duties for members of the public) to comply with the Act’s section 30 to 35 measures while in the controlled area during the control period. The regulation itself does not restate the content of sections 30-35.
Limits on authorised persons’ powers: sec.16 sets out specific limits on who may exercise particular Act powers at this event. It states that an authorised person may exercise a power under section 18(5) or section 25 of the Act only if the person is a police officer, a crowd controller, or a security officer. It also states that a person may exercise powers under a listed set of sections of the Act (section 30(4); section 32(5); section 33(4); section 54(2); section 63; section 65(2)) only if the person is a police officer. In practical terms, sec.16 narrows the pool of authorised persons who may perform certain enforcement, direction, search, or seizure functions that those Act sections supply.
Temporary works obligations and rights: sec.12 applies the Act’s section 16 in relation to Appel Park and Surfers Paradise for specified pre-event and post-event periods. That will create whatever duties, approvals or conditions the Act’s section 16 establishes for temporary works during those windows; likewise it vests any rights or exemptions the Act provides for authorised temporary works operations in that period.
Use and control of official branding: secs.13 and 14 formally declare an official logo (schedule 3) and the official title “Pacific Airshow Gold Coast” for the purposes of section 51(1)(a) and (b) of the Act. This declaration gives the Act’s section 51 machinery legal force for branding, which will determine who may lawfully use the logo and title or claim official status. The regulation does not itself set usage rules; it effects the application of the Act’s s51 regime to the declared logo and title.
Roles for private security and crowd controllers: sec.15 prescribes crowd controllers and security officers as authorised persons for this event, referencing the Security Providers Act 1993 for definitions (sec.2). That means persons meeting those statutory definitions will have the authorised-person status the Act accords, subject to the later limits in sec.16.
Because the regulation works by prescription, duties and rights are contingent on the text of the Act sections it applies. The regulation shapes the locus of applicability, who must obey and when,by tying the Act’s substantive measures to event-specific places, maps and time windows, and by clarifying which categories of authorised persons may exercise which powers.
Penalties and enforcement
The regulation does not itself create a new catalogue of offences or numerical penalties. Instead, it prescribes the application of the Act’s enforcement and offence provisions to specified areas and periods, and it narrows which categories of authorised persons may exercise particular enforcement powers. The operational elements to note are:
Enforcement powers arise from the Act: secs.7, 8 and 11 operate by making certain sections of the Act apply to the major event generally, to particular major event areas, and to the controlled area respectively. Sections 30 to 36 are specifically referenced (sec.7 prescribes s31 (other than subsection (1)(a)) and s36 for the major event period; sec.11 prescribes s30 to s35 for the Surfers Paradise controlled area). Any penalties, infringement schemes or criminal offences provided in the Act’s referenced sections will be enforceable in the places and times the regulation prescribes.
Authorised persons and limits on enforcement powers: sec.16 restricts operational capacity by tying certain powers to particular authorised-person categories. It provides that powers under section 18(5) or section 25 of the Act may be exercised by police officers, crowd controllers, or security officers. In contrast, the power to act under sections such as 30(4), 32(5), 33(4), 54(2), 63 and 65(2) of the Act is reserved to police officers only. This means enforcement tasks that rely on those Act sections can be legally undertaken only by police, which shapes practical enforcement resourcing and delegation.
Controlled area enforcement windows: sec.11 specifies that sections 30 to 35 apply in the Surfers Paradise controlled area on each of 16, 17 and 18 August 2024 between 6.00am and 5.30pm. Enforcement of the Act’s measures entrusted to those sections is therefore temporally concentrated.
Temporary works supervision and compliance: by prescribing section 16 of the Act to apply in particular major event areas during pre- and post-event windows (sec.12), the regulation brings any compliance, approval or offence mechanisms that the Act attaches to temporary works into force for those windows. Enforcement by authorised persons during those windows will therefore proceed under the Act’s section 16 framework.
Logo and title enforcement: secs.13 and 14 declare an official logo and title under section 51(1)(a) and (b) of the Act. The Act’s section 51 machinery will determine whether misuse of the official logo or title is an offence or otherwise actionable. The regulation does not itself state penalties for misuse but activates the Act’s rules.
Direct penalty statements are absent: the regulation contains no quantified fines, imprisonment terms or infringement notice amounts. Any penalty attached to event-related conduct will come from the Act provisions the regulation applies to the relevant place and time.
In short, enforcement and penalties at the Pacific Airshow Gold Coast will be exercised under the Act as applied by the regulation. The regulation defines spatial and temporal boundaries for enforcement and assigns which categories of authorised persons can lawfully exercise which enforcement powers. Operational enforcement planning therefore requires reading the Act sections cited (for example, sections 18, 25, 30 to 36, 31, 36, 16, 51, 54, 63 and 65) together with the prescription regime in this regulation.
How it interacts with other laws
The regulation is a narrow instrument that functions through cross-reference. Its interactions with other laws are expressed expressly and exclusively by those references. The principal statutory interactions in the regulation are:
The Act (unnamed in the text of this regulation): the regulation functions entirely by prescribing the operation of specified sections of the Act in relation to the event. The regulation repeatedly cites the Act’s sections (for example, sections 12, 16, 18, 25, 30-36, 31, 36, 51, 56 and 57) and uses those references to apply the Act’s legal machinery to specific places and times (secs.3-12, 15-16). Therefore the regulation’s effect depends on the substantive obligations, powers, offences and limits that the Act contains. The regulation does not alter the content of those Act sections; it makes them applicable for the Pacific Airshow Gold Coast.
Security Providers Act 1993: sec.2 defines the terms “crowd controller” and “security officer” by direct reference to sections 5 and 7 of the Security Providers Act 1993. That pulls persons who meet those statutory definitions into the regulation’s authorised-person framework (sec.15). The regulation therefore interacts with the licensing, registration, training or conduct regimes that the Security Providers Act provides, because individuals who meet those definitions will be the classes of private security personnel the regulation relies upon.
Maps and schedules as legal instruments: the regulation uses schedule 1 and schedule 2 (and schedule 3 for the logo) as instruments to link statutory provisions to precise geographical areas and times. The schedules and maps are part of the regulation and therefore have legal force for defining major event areas, controlled areas, and the official logo. The regulation also notes that some maps are included for information only (sec.9 second paragraph), which affects the legal status of those particular maps.
Delegation of enforcement roles alongside police powers: sec.16 differentiates powers reserved to police officers from those that may also be exercised by crowd controllers and security officers. That creates an interface between public law enforcement structures and private security regimes, mediated by the Act’s powers and the Security Providers Act definitions. The regulation thus allocates functional responsibilities between public officers and private security personnel within the event context.
Relationship with other local regulatory regimes: the regulation does not explicitly reference local government, planning, transport, liquor, workplace health and safety or environmental laws. However, because it prescribes parts of the Act that may affect movement, access, temporary works and authorised persons, there will be practical interactions with regulatory requirements administered under other regimes (for example, approvals for temporary works, traffic management or occupational safety). The regulation does not displace or restate those regimes; it operates in parallel by applying the Act’s provisions to specific periods and areas.
Because the regulation operates as a prescriptive layer, its legal effect depends on the content of the other statutes it references. Parties affected by the regulation must read the Act sections and the Security Providers Act provisions together with this regulation to determine the full composite legal position during the event.
Amendment history
The regulation is titled the Major Events (Pacific Airshow Gold Coast) Regulation 2024 (sec.1). The instrument itself contains no internal amendment notes, transitional provisions, revocations or schedules of prior versions. The text supplied does not include any history of amendments, prior versions, commencement amendments, or savings provisions. It is a single consolidated instrument that:
Provides the short title at sec.1.
Sets definitions at sec.2.
Contains event-specific prescriptions at secs.3-16.
Includes schedules (schedule 1, schedule 2 parts 1-7 maps, schedule 3 logo) that are referenced throughout.
Because the supplied regulation text contains no separate amendment section or marginal annotation, there is no record within this document of prior amendment events, repeal of earlier regulations, or deferred commencements. Any amendment history, prior instruments prescribing the same event for earlier years, or later amending instruments are not included in the supplied text.
Users who require a formal legislative history (for example, dates of registration, parliamentary papers, explanatory memoranda, or amendment history) must consult the official legislative database or the register where the regulation is published. The regulation as provided establishes the 2024 instrument and its content; it neither records amendments nor includes a schedule of previous regulations.
Litigation history
The regulation text supplied contains no references to litigation, judicial decisions, or legal challenges. There are no notes within the instrument about court orders, declaratory judgments, injunctions, or related proceedings affecting the regulation’s provisions. The instrument does not cite any judicial authority, and no cases are named in the text.
Therefore, based solely on the supplied regulation, there is no litigation history recorded in this document. Practitioners wanting to know whether any judicial or administrative proceedings have engaged this regulation or the Act provisions it applies should conduct a case law search and check the public law reporting and tribunal databases. The regulation itself does not supply case law, contested determinations, or precedent.
Gotchas
This regulation contains a number of traps for the unwary because it operates exclusively by prescription and cross-reference. The following points are concrete, source-grounded issues to watch for:
Strict temporal windows: the major event period (sec.6), the control period (sec.10) and the controlled-area daily windows (sec.11) are expressed to precise start and end times down to the minute. Compliance obligations and the application of Act provisions will switch on and off at those times. For example, sections 30 to 35 of the Act apply in the Surfers Paradise controlled area only between 6.00am and 5.30pm on 16, 17 and 18 August 2024 (sec.11). Acting outside those windows may mean an otherwise-authorised measure lacks the specific legal backing supplied by the Act as applied by this regulation.
Geographical definition by map: the controlled area is the area shown on the map in schedule 2 part 7 (sec.9). Other maps in schedule 2 parts 2, 3, 4 and 6 are included for information only. If a person relies on an “informational” map instead of the legally prescribed map, they risk misidentifying the controlled area. Practically, that matters for signage, barrier placement, and enforcement.
Different provisions apply in different areas: schedule 1 (referenced in sec.5 and sec.8) ties specific Act provisions to particular major event areas for particular periods. This creates a patchwork of legal regimes across the overall event footprint. Event planners, security contractors and businesses must map which Act provisions apply to which spaces and times; a one-size-fits-all operational plan risks deploying powers or restrictions where they are not prescribed.
Limits on powers for authorised persons: sec.16 narrows which authorised persons may exercise specified powers. For example, some powers are reserved to police officers only (including those under s30(4), s32(5), s33(4), s54(2), s63 and s65(2) of the Act). Conversely, powers under s18(5) and s25 of the Act may be exercised by police officers, crowd controllers or security officers. Failure to respect those limits risks unlawful exercise of powers by private security or other authorised persons.
Definition dependencies: the regulation defines “crowd controller” and “security officer” by reference to the Security Providers Act 1993 (sec.2). That means whether an individual qualifies depends on the definitions and licensing requirements in that separate statute. Relying on informal job titles without checking statutory definitions and licensing status under the Security Providers Act may lead to incorrectly classifying authorised persons.
Temporary works timing and approvals: sec.12 prescribes pre-event and post-event windows for temporary works in Appel Park and Surfers Paradise. Contractors must align with those windows and with any approvals the Act’s section 16 requires. Mis-timed installation or removal of structures may fall outside the prescribed temporary works period and lose any legal protections or permissions that the Act’s section 16 supplies.
Official logo and title declared but usage rules not repeated: secs.13 and 14 declare an official logo and title for the event under section 51(1)(a) and (b) of the Act. The regulation does not restate permitted or prohibited uses. Parties that use the logo or title should not assume free use; the Act’s s51 regime must be consulted to determine lawful use.
No standalone penalties in the regulation: because the regulation applies Act provisions for penalties and enforcement rather than creating them, one cannot infer penalty amounts or enforcement procedures from this regulation alone. Users must consult the underlying Act sections (e.g., those cited in secs.7, 11 and 16) for precise enforcement consequences.
Reliance on schedules that are part of the instrument: Schedule 1 and schedule 2 maps form the legal specification of areas and provisions. Omission to attach, read or correctly interpret those schedules will materially affect compliance. The regulation refers with precision to schedule parts and columns; operational actors should not treat the schedules as ancillary.
Potential for fragmented authority: the regulation spreads authority across public police and private crowd controllers/security officers by prescribing who may exercise particular powers (sec.16). This can create operational gaps or ambiguity unless roles and communications are clearly established in advance.
Each of these gotchas flows directly from the regulation’s mechanics: precise times, map-based area definitions, prescription of Act provisions to specific places and times, and limits on which categories of authorised persons may exercise particular powers. Practitioners should map these particulars to their operational checklists.
How to comply
Compliance under this regulation is a composite exercise of reading the regulation, the Act provisions it applies, and the Security Providers Act 1993 where relevant. The following checklist is a source-grounded, practical sequence of steps to align operations with the regulation’s prescriptions:
Identify the major event organiser and its legal responsibilities:
Note that Pacific Airshow Pty Ltd ACN 647 800 539 is prescribed as the major event organiser (sec.4). Review the Act’s obligations, duties and liability rules that attach to a major event organiser so the corporate entity can allocate responsibilities, procurement and insurance accordingly.
Determine the temporal scope for operations:
Record the major event period: 16 August 2024 at 6.00am to 18 August 2024 at 5.30pm (sec.6).
Record the control period (the same start and end times) for the controlled area (sec.10).
For the Surfers Paradise controlled area, note the daily window when sections 30 to 35 apply: 6.00am to 5.30pm on each of 16, 17 and 18 August 2024 (sec.11).
For temporary works, record the pre-event and post-event windows: 5 August 2024 at 6.00am to 16 August 2024 at 6.00am, and 18 August 2024 at 5.30pm to 23 August 2024 at 5.30pm (sec.12).
Map spatial boundaries precisely:
Use schedule 1 column 1 for major event areas (sec.5) and schedule 2 part 7 for the legally prescribed Surfers Paradise controlled area map (sec.9).
Pay attention to which schedule 2 maps are marked “for information only” (sec.9 second paragraph) and rely on the legally prescribed map for control decisions.
Cross-check which Act provisions apply where:
For the major event period generally, note that sections of the Act apply as specified in sec.7 (s31 except s31(1)(a) and s36).
For each major event area, consult schedule 1 column 2 and column 3 (sec.8) to see which Act provisions apply and when.
For the controlled area, ensure operations are aligned with sections 30-35 for the prescribed daily windows (sec.11).
Read the text of the Act sections cited to understand substantive powers, duties, offences and enforcement mechanics.
Staff authorised persons appropriately:
Recognise that authorised persons for the event include crowd controllers and security officers (sec.15). Use the Security Providers Act 1993 definitions (sec.2; see s5 and s7 of that Act) to verify personnel qualifications, licences and registration status.
Train authorised persons on the limits set by sec.16: certain powers are exercisable by police, crowd controllers or security officers (s18(5) and s25 of the Act), while other powers are reserved to police only (s30(4), s32(5), s33(4), s54(2), s63, s65(2)). Ensure written operational protocols reflect those legal limits.
Coordinate with police:
Because some Act powers can only be exercised by police officers (sec.16), coordinate operational plans with policing authorities to ensure that police resources cover any functions private authorised persons cannot legally perform.
Manage temporary works with the Act’s section 16 framework:
If installing temporary infrastructure in Appel Park or Surfers Paradise, align works with the windows in sec.12 and apply any approval, notification or safety obligations that section 16 of the Act imposes. Confirm that contractors understand the permitted periods for erecting and removing temporary structures.
Control branding and official representations:
Use only the official logo declared in schedule 3 and the official title “Pacific Airshow Gold Coast” where the Act’s s51 regime allows such use (secs.13-14). Review the Act’s section 51 to determine permissions and prohibitions around using the logo and title.
Prepare signage and public communications to reflect legal boundaries:
Signage indicating controlled areas, entry points, restricted behaviours and the times when Act provisions apply should mirror the dates, times and maps in the regulation and in the Act sections applied to those places. Avoid communicating inaccurate boundaries that rely on informational maps rather than the legally prescribed ones.
Integrate compliance with other regulatory requirements:
Although this regulation applies specific Act provisions, other regimes (for example, occupational safety, planning and local approvals) may additionally apply. Confirm overlapping approvals, permits and notifications required by other statutes and local authorities when planning works, temporary structures and crowd management.
Document roles, powers and delegation:
Produce written protocols that set out who is authorised to do what, when and where, referencing the regulation’s relevant sections (for example, secs.11, 12, 15, 16) and the applicable Act sections. Ensure that private security and crowd controllers are only asked to perform functions they are legally empowered to perform.
Retain and review the schedules:
Keep authoritative copies of schedule 1, schedule 2 maps and schedule 3 logo for operational use. Do not rely on third-party summaries of area boundaries; the regulation ties legal effects to the schedules themselves (secs.5, 9, 13).
Legal review:
Before operationalising any enforcement, branding, temporary works or crowd-control activity, obtain legal advice that reads the Act sections referred to in this regulation alongside the regulation itself, because substantive duties, powers and penalties reside in those Act sections.
These steps follow directly from the regulation’s prescriptions. The key compliance principle is to treat this regulation as a spatial-temporal switch that activates discrete sections of the Act; practical compliance requires aligning people, maps, times and roles with those switches.
