Plain English Summary

7/10 complexity

This Act gives the Minister powers to prepare for and manage liquid‑fuel shortages: require industry information, mandate and locate reserves, direct production, transfers, allocations and sales, proclaim emergencies and issue permits, price caps and supply controls. It creates enforcement tools and penalties.

A 2015 addition requires fuel sellers to meet sustainable‑biofuel sales quotas, keep records, register and report sales, and allows exemptions or suspensions in limited circumstances. The law mainly affects fuel producers, wholesalers, retailers, bulk customers and their compliance costs.

What it does

Mechanically, the Liquid Fuel Supply Act 1984 establishes a two‑part regulatory framework. First, it creates contingency and emergency powers for the State to gather information, order the accumulation and transfer of fuel stocks, direct production and supply, control prices and distribution, issue purchase permits, and requisition or otherwise control assets and services related to liquid fuel when there is, or is likely to be, a shortage (Pt 3; Pt 4; Pt 5). The Governor in Council may declare a liquid fuel emergency (s 23), at which point the Minister may assume control over extraction, production, supply, distribution, sale, purchase, use, consumption and storage of the fuel covered by the proclamation and give directions, requisitions or issue permits (s 24, ss 24(1)-(2); s 25). The Act gives the Minister broad powers to require information at any time relevant to administration of the Act (s 8), to require businesses to notify addresses and storage capacities (s 10), and to identify and allocate supplies to bulk customers and essential or high priority users (ss 11-14, 30).

Second, an overlay introduced by amendment in 2015 creates continuing regulatory obligations on fuel sellers to sell mandated percentages of sustainable biofuels (Part 5A). That amendment inserts obligations to register as a fuel seller (s 35L-35N), to keep sale records and submit quarterly returns (ss 35E, 35F), to meet minimum volumes of sustainable biobased petrol and diesel (ss 35B-35C), and to seek exemptions or benefit from suspension mechanisms where supply or other conditions make compliance impracticable (ss 35G, 35J-35K). The ministerial and chief executive roles are split operationally: the Minister issues directions, exemptions and emergency proclamations (see s 6; s 24); the chief executive manages the fuel seller register and receives returns and reports (s 35L-35P).
