What it does

The text you provided is the published web entry for the "Guardianship Regulation 2026" on the NSW legislation website. It does not contain the operative regulatory clauses of the instrument. Instead, the document is a metadata page describing the status, versioning and administrative notes for that regulation. Key, directly quoted lines from the source establish its mechanical status: the page states "Current version for 21 August 2026 to date (accessed 31 August 2026 at 9:56)," and that this is the "In force version" with "Current from 21/08/2026." Critically, the page also states, twice, that "None of the provisions displayed in this version of the legislation have commenced."

Because the page is the site’s compiled and certified form of the regulation rather than a schedule of substantive provisions, what it does , in the narrow sense , is:

present the published metadata for the Guardianship Regulation 2026 (version date, in-force marker, file modification date);
record administrative information about non-commenced amendments and staged repeal status;
certify that the version is compiled and maintained by the Parliamentary Counsel’s Office and is "certified as the form of that legislation that is correct under section 45C of the Interpretation Act 1987";
and flag that the site "usually" updates within three working days after a legislative change.

The page also contains notes that it "Does not include amendments by Sch 2 to this regulation (not commenced , to commence on 5.11.2026)" and that "This legislation is currently due to be automatically repealed under the Subordinate Legislation Act 1989 on 1 September 2031." Those statements are the only substantive policy-direction statements visible in the source.

Important information

An enduring guardianship appointment is an important document. It allows someone else to make medical and lifestyle decisions on your behalf. You should get legal or medical advice, or both, before you sign it.

It is important that you trust the person you appoint as your enduring guardian to make appropriate lifestyle decisions on your behalf. It is recommended you inform this person of your wishes about lifestyle decisions and involve them in discussions about your views or goals. If these change, it is important to let your enduring guardian know.

An enduring guardian can only make lifestyle decisions such as health decisions. You should make an enduring power of attorney if you want someone to make financial decisions on your behalf if you lose capacity.

If you appoint more than one enduring guardian, you should indicate whether the enduring guardians are to act jointly, severally or jointly and severally. Enduring guardians who are appointed jointly are only able to make decisions if they all agree about the decision. Enduring guardians who are appointed severally or jointly and severally are able to make decisions independently of each other.

If you appoint an alternative enduring guardian, they will only have authority to act as your guardian if the first appointed enduring guardian/s dies, resigns or becomes incapacitated.

Each enduring guardian must sign their acceptance on the appointment for the appointment to be effective.

If someone signs the appointment on your behalf, they must be at least 18 years of age. They must not be the person being appointed as an enduring guardian. They cannot also witness the execution of the appointment.

If you marry after you appoint an enduring guardian, the appointment will automatically be revoked unless you marry your enduring guardian.

If you appoint an enduring guardian, you may revoke the appointment in writing using Form 2. You may revoke the appointment at any time while you have legal capacity to revoke the appointment.

Your enduring guardian can resign at any time by giving you written notice. If you have lost capacity to make decisions at that time, your enduring guardian can only resign with the approval of the NSW Civil and Administrative Tribunal.

Enduring guardianship appointments are not automatically accessible on any public register. Therefore, it is important that key people are aware of the appointment so they can contact the enduring guardian if required. You should give a copy of the enduring guardianship appointment to your enduring guardian and keep a copy in a safe place. You should also let close friends or family know about it and give a copy to your solicitor, doctor and health service provider.

For further information about enduring guardianship, contact the NSW Trustee and Guardian or the NSW Civil and Administrative Tribunal.

Form 2 Revocation of appointment of enduring guardian

I, [insert name, address and occupation], revoke the appointment of [insert name of each enduring guardian] as my enduring guardian.

I understand that this revocation will not be effective unless the enduring guardian is or has been given written notice of the revocation.

Part 1 Preliminary

1 Name of regulation

This regulation is the Guardianship Regulation 2026.

2 Commencement

This regulation commences as follows—

(a) for Schedule 2—on 5 November 2026,

(b) otherwise—on 1 September 2026.

Note—

This regulation replaces the Guardianship Regulation 2016, which is repealed on 1 September 2026 by the Subordinate Legislation Act 1989, section 10(2).

3 Definitions

In this regulation—

Form means a form set out in Schedule 1.

restricted substance means a substance included in the Poisons List, Schedule 4 under the Poisons and Therapeutic Goods Act 1966.

the Act means the Guardianship Act 1987.

Note—

The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this regulation.

Part 2 Enduring guardians

4 Eligible witnesses

(1) For the Act, section 5, definition of eligible witness, paragraph (a)(iv), the following classes of person are prescribed—

(a) a foreign lawyer within the meaning of the Legal Profession Uniform Law (NSW),

(b) a person—

(i) who is a member of staff of the NSW Trustee and Guardian, and

(ii) who has completed an approved course of study, and

(iii) who has been approved by the Chief Executive Officer of the NSW Trustee and Guardian for this paragraph.

(2) In this section—

approved course of study means a course of study approved by the Minister by order published in the Gazette.

5 Appointment of enduring guardian

For the Act, section 6C(1)(a), Form 1 is the prescribed form.

6 Revocation of appointment of enduring guardian

This section does not give legal advice and does not instruct you to take a particular action. It explains, based on the source, what steps a compliance officer, in-house lawyer, or interested party would need to take to determine whether they are subject to operative duties once the Guardianship Regulation 2026 becomes effective.

Confirm commencement status:
- The single most important datum on the page is "None of the provisions displayed in this version of the legislation have commenced." Before relying on any supposed duty or right under the Guardianship Regulation 2026, verify commencement notices in the NSW Government Gazette and the PCO’s instruments of commencement. The website page provides a "Current from 21/08/2026" marker, but that is the compiled version date and not a substitute for a formal commencement instrument.
Check scheduled amendments:
- The page explicitly notes "Does not include amendments by Sch 2 to this regulation (not commenced , to commence on 5.11.2026)." If you anticipate obligations that may arise from Sch 2, obtain the text of Sch 2 and any commencement instrument specifying 5 November 2026. Compare the current certified version and the Sch 2 text to identify added duties or altered thresholds.
Use the certified copy as the authoritative text for the snapshot:
- The page states the version "is certified ... under section 45C of the Interpretation Act 1987." If you need to prove what the text said at or before 21 August 2026, rely on the certified form, but note that certification does not mean the provisions are in force.
Monitor the PCO site and Gazettes for changes:
- The site says it is "usually updated within 3 working days after a change to the legislation." For operational planning, set up an automated check or a manual schedule to revisit the PCO site, the point-in-time XML path referenced on the page, and the Government Gazette around any expected commencement dates such as 5 November 2026.
Verify the enabling Act and cross-reference rights and duties:
- The page does not identify the parent statute. To understand the legal powers and limits of any regulation measures, obtain the relevant Guardianship Act or other enabling legislation that authorises the regulation. That Act will typically set out the scope and permitted content of regulations and any limits on penalties or delegated powers.
Note the scheduled repeal horizon:
- The page records an automatic repeal under the Subordinate Legislation Act 1989 on "1 September 2031." For medium-term compliance planning, treat this as a planning horizon for whether regulation-based obligations will be long-term or temporally limited.
Maintain an audit trail and version control:
- Because the page includes a "File last modified 21 August 2026" timestamp and point-in-time XML references, keep copies (certified where appropriate) of the versions you rely on and record when you checked the site. That will help with retrospective compliance questions.
If uncertainty remains, escalate to counsel:
- If your organisation faces material operational risk from the possible content of Sch 2 or from any part of the regulation once commenced, consult a qualified Australian lawyer to interpret the text, verify commencement instruments, and advise on compliance measures tailored to your factual context.

These compliance steps are procedural and organisational; they follow directly from the page’s recorded metadata (non-commencement, pending amendments, certification, update lag, and repeal date). They do not assume any substantive duties that are not displayed on the page.

This is general legal information, not legal advice. I can make mistakes. Before you act on, rely on, or use any draft or interpretation drawn from this, get a qualified Australian lawyer to check it.
