The Rules organise the shellfish fishery around a discrete set of legal concepts and administrative instruments. These are the primary conceptual building blocks and their operative mechanics:

• Licence classes and endorsements. Rule 6 lists classes: class shellfish (with subtypes for specific species and zones), class commercial dive, and class vessel. Each licence authorises a narrowly defined set of activities and areas (rule 15). Endorsements are the mechanism used to permit particular apparatus, vessels or State waters; the Secretary endorses licences with TAC allocations (rule 7(4)) and the Rules permit alternative reporting arrangements via licence endorsement (rule 43).

• Quota period and TAC allocation. The licensing year runs 1 September to 31 August unless the Minister specifies a different period by public notice for particular licences (rule 7(1)). The Minister determines the total allowable catch for the fishery or parts of it by whole weight or number (rule 7(2)), and that TAC is allocated equally among licences issued for the quota period (rule 7(3)). This equal share model means each licence of the same class receives the same quantitative entitlement per quota period.

• Closed seasons and closures to activities. The Minister can set open and closed seasons by public notice (rule 9) and can close the fishery or part of it to specified fishing activities by public notice for periods specified (rule 10). The regime differentiates spatial closures, species‑specific closures and closures to particular activities.

• Possession and size limits. Specific possession limits apply on and during a fishing trip for undersize katelysia cockles, native oysters and venerupis clams (rule 11), while for other species the Minister may set minimum and maximum size limits and allowable numbers of undersize or oversize shellfish by public notice (rule 12). Importantly, the possession limits in rules 11 and 12 apply to physical possession on and during a fishing trip, not to stock at purge sites or off‑site storage (rules 11(4) and 12(6)).

• Fish caufs and purge sites. Fish caufs are regulated structures for holding shellfish in State waters (rule 3 definition of fish cauf). Use is prohibited unless the licence is endorsed for a fish cauf (rule 45(1)). Licence holders who are endorsed face obligations to place shellfish only at specified places in a licence, keep day‑separated and species‑separated containers, clearly mark containers with date and shellfish docket number, and maintain purge site records capturing placement and removal timestamps and daily stock (rules 46 and 47). Purge supervisors have distinct duties and restrictions (rule 19).

• Reporting and documentation. The Rules require pre‑fishing reporting to an approved reporting service (rule 40), set timing constraints (cannot make a report earlier than 24 hours before activity under rule 41), and require cancellation reports within two hours if the activity does not proceed (rule 42). Shellfish dockets, disposal receipts and purge site records are formal records required for traceability and must be kept typically for at least five years (rules 34, 35, 36, 37, 47).

• Assistant/supervisor roles and restrictions. The Rules define "assistant", limit the number of assistants (rule 17), require the licensee to supervise assistants (rule 17(3)), and regulate approvals under s 87 of the Act to allow another person to use the licence as a supervisor or purge supervisor (rule 18). If the licence holder obtains approval to allow another person to use the licence as supervisor, the holder must not use the licence during that period (rule 18(2)).

• Penalty framework and infringement notices. Offences are graded and penalised as Grade 1, 2 or 3 penalties per the Fisheries (Penalties) Regulations 2011 as cross‑referenced in definitions (rule 3). Rule 51 prescribes which rule breaches are infringement notice offences for the purpose of s 234 of the Act and maps penalty units in Schedule 1.

These core concepts structure rights of access, monitoring and enforcement. The equal allocation TAC model, the numerical caps on licences for certain classes (rule 16), the renewal constraints (rules 20 and 21), and the detailed record keeping and reporting regime create a co‑ordinated set of property‑like entitlements plus administrative controls intended to enable management, monitoring and traceability.

The Rules specify duties and limits applicable to a set of identifiable actors. Primary affected parties are:

• Holders of fishing licences (class shellfish). These persons hold the primary statutory authorisations to take shellfish commercially in specified areas and are the main compliance subject. Their obligations include landing all shellfish taken under the licence (rule 33(1)), completing shellfish dockets and sending originals to the Secretary (rules 34, 35), maintaining purge site records where fish caufs are used (rule 47), complying with fish cauf labelling and separation (rule 46(6)), and observing possession limits, closed seasons and TAC allocations (rules 8, 9, 11, 12).

• Purge supervisors. A purge supervisor is an approved user of a licence solely for removing shellfish from a purge site endorsed on the licence in connection with sale or transfer (rule 3 definition). Purge supervisors are explicitly restricted from taking fish under the licence (rule 19(2)), may only be in possession of species listed on the licence under narrow conditions (rule 19(3)), must not mix shellfish from different licences (rule 19(4)), and must not be on board a vessel with diving equipment while acting as purge supervisor (rule 19(5)). Purge supervisors also have specific responsibilities with disposal receipt books (rule 19(6)-(7)).

• Assistants. Assistants assist licence holders in fishing under the licence (rule 3 definition). The holder must not allow more than two assistants to participate in fishing under that licence (rule 17(1)) except for Pacific oyster licences where there is no restriction (rule 17(2)). Assistants may only participate if supervised by the licence holder (rule 17(3)).

• Fish processors. Processors who take possession of shellfish from licence holders must have a copy of the completed shellfish disposal receipt before taking possession (rule 37(1)), must keep that copy with the shellfish while processing and retain it for at least five years (rule 37(2)). Processors are thereby part of the chain of custody requirements.

• Holders of marine farming licences. The Rules restrict transfers to marine farmers whose licence is not endorsed for that kind of shellfish (rule 49). Marine farm licence holders therefore must ensure appropriate endorsements before accepting transfers.

• Vessel owners and operators. Holders of class shellfish licences are limited to vessels specified in a fishing licence (vessel) for the purposes of the licence (rule 31(1)), subject to exceptions for punts used solely to carry shellfish where endorsed (rule 31(2)-(4)). Vessel types, endorsements and on‑board equipment such as diving gear will affect eligibility and permissible operational configurations.

• Reporting service providers and the Secretary. The Rules contemplate approval of reporting services to receive pre‑fishing and other reports (rule 38(1)). Such services must issue report receipt numbers and maintain the ability to supply those numbers to fisheries officers (rule 38(2)-(3)). The Secretary sets reporting detail (rule 39), endorses licence allocations (rule 7(4)) and may require licensee participation in research (rule 22).

• Fisheries officers. Officers are empowered to require production of report receipt numbers and to enforce the rules, including serving infringement notices under s 234 of the Act as linked by rule 51.

• The Minister and the Secretary. The Minister determines TACs and may set licence‑specific quota periods, open and closed seasons, closures to activities, and size limits by public notice (rules 7, 9, 10, 12). The Secretary has endorsement and administrative roles, receives dockets and disposal receipts, and may require research and set reporting detail (rules 7(4), 22, 39).

• Recreational fishers and Aboriginal persons. The Rules set daily recreational limits (rule 14). There is an explicit carve‑out for Aborigines engaged in Aboriginal cultural activity from two of the stated recreational limits (rule 14(3)). Recreational players are affected where recreational activity intersects commercial licences (rule 32 prohibits recreational fishing while fishing under a commercial licence).

Who pays and who decides. Licence holders and purge supervisors bear the operational and administrative costs of compliance: reporting, docketing, maintaining purge site records, and possible time spent on research (rule 22). The Minister and the Secretary decide TACs, seasons, alternative reporting endorsements, and endorsement details for apparatus and vessel use (rules 7, 9, 10, 39, 43). Fisheries officers and the Secretary administer enforcement and records receipt.

This section lists the principal duties imposed on regulated parties and the principal rights granted by licences, with precise references.

Rights created by the Rules

• Species and area rights. A licence grants species‑and‑area specific rights only. For example, a fishing licence (cockle - Ansons Bay) authorises taking and possession of katelysia cockles for commercial purposes from the Ansons Bay Cockle Zone only (rule 15(3)). A Pacific oyster licence authorises taking Pacific oysters from waters specified by endorsement (rule 15(5)).

• Quota allocation and use. Where a TAC is determined, licence holders obtain an equal share for the quota period and the Secretary endorses that quantity on the licence (rule 7(2)-(4)). The licence therefore carries a quantified entitlement for the quota period.

• Use of endorsed apparatus, vessels and fish caufs. Holders may use apparatus, vessels and fish caufs only if those uses are endorsed on the licence (rules 13, 31, 45). Endorsements create limited exceptions to otherwise general prohibitions.

Principal duties and operational obligations

• Compliance with TAC and quota balance. Licence holders must not take or possess, for commercial purposes, more shellfish than the licence’s shellfish quota balance (rule 8(1)). The definition of shellfish quota balance is the allocation for the period less any quantity taken and retained under that licence during the period (rule 8(2)).

• Observe closed seasons and closures. Persons must not take or be in possession of shellfish from waters closed to the shellfish fishery or closed to that kind of shellfish (rule 9(2)-(3)). The Minister sets these dates by public notice (rule 9(1)). The Rules also enable closure of particular fishing activities for specified periods by public notice (rule 10).

• Size and possession limits. Holders are subject to strict possession limits on undersize katelysia cockles, native oysters and venerupis clams while on a fishing trip (rule 11). For other kinds of shellfish, the Minister may set minimum and maximum size limits and allowable numbers by public notice; those limits apply on and during a fishing trip (rule 12).

• Apparatus restriction. A person must not use apparatus, including mechanised hand tools, to take shellfish unless the licence is endorsed for that apparatus (rule 13(1)). A limited exception applies for authorised wild Pacific oyster fishers using non‑mechanised hand tools (rule 13(2)).

• Landing, docketing and disposal receipts. Licence holders other than Pacific oyster licence holders must complete shellfish dockets relating to the taking of shellfish before the end of the day the shellfish are landed and before any leave the landing area or are moved into temporary structures (rule 34(1)). Pacific oyster licence holders must complete dockets before the end of the landing day (rule 34(2)). Original dockets must be received by the Secretary within 48 hours and copies kept for at least five years (rule 35). Disposal receipts must be completed for each sale or transfer, signed by the purchaser immediately and originals provided to the Secretary within 48 hours; copies must be kept five years (rule 36). Fish processors must possess a copy of the disposal receipt before taking possession and must retain it for five years (rule 37).

• Reporting obligations. The holder of a class shellfish licence must make a report to an approved reporting service before entering the authorised area and before taking shellfish under that licence (rule 40(1)). The Secretary may specify how reports must be made and what information must be provided (rule 39). Reports cannot be made earlier than 24 hours before the activity unless approved in writing by the Secretary (rule 41).

• Fish cauf and purge site record‑keeping. Where fish caufs are used, licence holders must ensure the cauf is used only at places specified in the licence, not used to hold recreationally taken shellfish or shellfish taken under another licence, and that shellfish taken in the previous licensing year are removed within 30 days of the new licensing year (rule 46(2)-(4)). The licence holder must maintain a purge site record for each fish cauf that records dates and precise times of placement and removal, kinds and quantities, and daily stock for each kind (rule 47(1)). Entries are time‑stamped by rule: placement entries by end of day placed, removal entries before shellfish leave landing area, daily stock entries before end of each day (rule 47(3)-(5)).

• Supervision and assistant limits. No more than two assistants are allowed under a class shellfish licence at any time (rule 17(1)), unless a Pacific oyster licence where there is no numeric restriction (rule 17(2)). The licence holder must supervise any assistant (rule 17(3)). If the licence holder obtains approval under s 87 of the Act to allow another person to act as supervisor, the holder must not use the licence during that approved period (rule 18(2)).

• Research participation. As a licence condition, the Secretary may require the licence holder to conduct up to two days of research in a licensing year, if required by notice (rule 22).

• Transfer restrictions. Holders must not sell or transfer shellfish to a marine farming licence holder unless that marine farming licence is endorsed for that kind of shellfish (rule 49). A fishing licence (Pacific oyster) is not transferable (rule 23). Other classes may be subject to the renewal constraints in rules 20 and 21 which restrict availability of subsequent grants.

These rights and duties create a compliance regime that ties quantitative entitlements to administrative documentation and temporal restrictions. The Rules emphasise traceability through docketing, disposal receipts, purge site records and reporting to an approved service.

The Rules use a two‑track enforcement architecture: graded statutory penalties under the Fisheries (Penalties) Regulations 2011 and infringement notice disposals under s 234 of the Act, with a detailed mapping in Schedule 1.

Penalty structure

• Grade penalties. The definitions in rule 3 reference Grade 1, Grade 2 and Grade 3 penalties as those specified in regulations 5, 6 and 7 respectively of the Fisheries (Penalties) Regulations 2011. The Rules attach Grade 3 penalties to higher‑seriousness offences such as exceeding the shellfish quota balance (rule 8(1) penalty Grade 3), taking shellfish in closed waters (rule 9(2) and 9(3) penalties Grade 3), and taking shellfish for commercial purposes without the appropriate licence or supervisor (rule 24 Grade 3).

• Infringement notice regime. Rule 51 operationalises the Act’s infringement notice power (s 234). Schedule 1 lists specific rule provisions that are infringement notice offences and assigns a penalty in penalty units for each. The Schedule covers a large number of the Rules, including quota and possession breaches (e.g. item 1 lists rule 8(1) with 5 penalty units), closed season breaches (rule 9(2) & 9(3) items 2 and 3 with 5 units each), reporting, docketing and purge record offences. The Schedule thus allows many contraventions to be dealt with through infringement notices rather than prosecution.

• Specific mapped penalties. Examples from Schedule 1 include: rule 13(1) (use of apparatus without endorsement) is an infringement offence at 2 penalty units (item 11); rule 14(1) (recreational limits) is 2 units (item 12); rule 17(1) (limit on number of assistants) is 5 units (item 13); rule 33(1) (land all shellfish) is 3 units (item 33); rule 47(1) (purge site record requirements) is 3 units (item 53). The Schedule gives practical guidance on the sanction that a fisheries officer may apply administratively.

Enforcement mechanisms and administrative controls

• Reporting receipt numbers and inspection. Approved reporting services issue report receipt numbers when they receive reports (rule 38(2)). Persons who receive a report receipt number must provide it to a fisheries officer when required (rule 38(3)). Fisheries officers will thus use receipt numbers and the record system as part of compliance checks.

• Record keeping as an enforcement tool. The Rules prescribe specific timing for entries, retention periods (typically five years for dockets, disposal receipts and purge site records), and physical requirements (separation and labelling in fish caufs). These create audit traces that enforcement agencies can examine to verify compliance.

• Defence provisions. Rule 46(7) provides a limited defence in proceedings under rule 46(6) if the defendant proves another person acting under the licence committed the offence and the defendant either did not know and could not reasonably have been expected to know, or exercised reasonable diligence to prevent the offence. This is a narrowly framed evidential defence rather than a broad statutory immunity.

• Ministerial/Secretary discretion as an enforcement adjunct. The Minister’s power to set TACs, seasons and closures by public notice (rules 7, 9, 10) and the Secretary’s ability to specify reporting detail and approve reporting services (rules 38, 39) allow enforcement focus to be directed administratively. The Secretary also endorses quotas on licences (rule 7(4)) and may require research (rule 22), creating further avenues for oversight.

Practical enforcement implications

• Many routine breaches are mapped to infringement notices with modest penalty units. This enables on‑the‑spot or administrative enforcement rather than prosecution for a range of infractions, including record keeping and reporting failures.

• More serious conduct, possession of quantities above quota, taking in closed waters, unauthorised commercial taking and diving without a commercial dive licence, carry Grade 3 penalties and are likely to be treated as prosecutable offences.

• The Rules place accountability on licence holders for acts of persons acting under their authority, subject to the narrow defence in rule 46(7). Licence holders should therefore train assistants and supervisors and maintain internal controls to avoid strict liability exposures.

Legal basis and interaction with Act enforcement. Rule 51 cross‑references s 234 of the Living Marine Resources Management Act 1995 for infringement notices; Grade penalties are those detailed in the Fisheries (Penalties) Regulations 2011 in the definitions (rule 3). The Secretary and fisheries officers are the practical enforcers of this regime. The retention and traceability obligations are central enforcement tools.

The Rules are closely linked to the Living Marine Resources Management Act 1995 and several other subordinate instruments. The main statutory cross‑references and interactions in the text are:

• Living Marine Resources Management Act 1995. The Rules frequently refer to and depend on the Act for administrative mechanisms:

  • Section 77 of the Act is the application procedure for grant of licences; rules 20 and 21 make eligibility for subsequent grants conditional on complying with s 77 within 12 months after expiry and holding the licence on the preceding 31 August (rule 20).
  • Section 87 of the Act is the approval mechanism for allowing other persons to use a licence; rules 18, 19 and 23 incorporate this approval process and place restrictions on who may use a licence and how (rule 18(1)-(2), rule 19).
  • Section 234 is the Act provision authorising infringement notices. Rule 51 prescribes which rule breaches are infringement notice offences and maps penalty units in Schedule 1.

• Fisheries (Penalties) Regulations 2011. The Rules import terminology for Grade 1, Grade 2 and Grade 3 penalties from regulation 5, 6 and 7 of those Regulations (rule 3 definitions). The Rules themselves attach Grade penalties to many offences (for example rule 8(1) penalty Grade 3).

• Fisheries (Commercial Dive) Rules 2011. The Rules adopt the concept of a fishing licence (commercial dive) from the 2011 Rules (rule 3 definition) and prohibit commercial diving for shellfish without such a licence (rule 30).

• Fisheries (General and Fees) Regulations 2016. Rule 3 excludes certain fishes from the definition of shellfish by reference to regulation 15 of that instrument. Rule 12(2) also cross‑references regulation 15 when specifying limits on species.

• Marine farming licences. The Rules interact with marine farming licensing. Shellfish farmed under a marine farming licence are excluded from the definition of shellfish for these Rules (rule 3 definition(d)). Rule 49 prohibits selling or transferring shellfish to a marine farming licence holder whose licence is not endorsed for that kind of shellfish, creating a linkage between endorsements on marine farm licences and commercial wild take transfers.

• Rules Publication Act 1953. Schedule 1 is formally displayed and numbered in accordance with that Act, as noted at the end of the Schedule.

Operational and compliance interactions

• Administrative dependence on public notices and Secretary decisions. The Minister’s and Secretary’s public notices and endorsements under the Act and these Rules determine TACs, seasons, size limits and reporting arrangements. The Rules therefore create substantial reliance on subordinated administrative instruments for day‑to‑day management (rules 7, 9, 10, 12, 39, 43).

• Record retention and Act requirements. The Rules make many records part of the records required under the Act (for example shellfish disposal receipts and dockets are "part of the records required to be kept under the Act" per rule 3 definitions). That ties these obligations back into broader Act record‑keeping and potential disclosure regimes under the Act.

Limits on transferability and licence continuity. Rule 23 states a Pacific oyster licence is not transferable. Rules 20 and 21 constrain the grant of subsequent licences by reference to holding the licence on a specified date and applying under s 77, which is an Act procedure. Those provisions interact with the Act’s broader licensing framework and any policies the Secretary or Minister adopt under the Act.

In short, the Rules implement a regulatory overlay that depends on and is exercised through powers and processes in the Living Marine Resources Management Act 1995 and complementary regulations. The Act supplies licence application and approval mechanisms, infringement notice capacity, and general enforcement architecture; the Rules specify the fishery‑specific operational obligations and offence mapping.

The text provided contains the formal commencement date and the nominal duration of the Rules but does not include any amendment instruments or revision notes. The explicit chronological information in the text is:

• Commencement. The Rules took effect on 21 March 2017 (rule 2).

• Notification. The Rules were notified in the Gazette on 15 March 2017, as stated at the end of the Schedule.

• Duration. The Rules continue in effect for 10 years (rule 5). That yields a statutory expiry date by operation of rule 5 of 21 March 2027 unless earlier revoked, replaced or extended by subsequent instrument under the relevant statutory provisions.

The provided document does not record any amending instruments, schedules of amendment, or insertions. There is no textual evidence in the Rules themselves of later variations, repeals, or extension orders. Where the Rules incorporate public notices and Secretary endorsements as the mechanism for dynamic management (rules 7, 9, 10, 12, 39), those public notices are external instruments and would appear in administrative records or gazette notices rather than within the Rules text. The Rules also refer to other instruments (for example Fisheries (Penalties) Regulations 2011, Fisheries (General and Fees) Regulations 2016), but the provided text contains no historical amendment trace.

Practical consequences of the duration provision. Because the Rules are subject to a 10‑year duration, investment decisions by licence holders (for example capital expenditure on vessels, fish caufs or processing capacity) face a finite regulatory horizon as framed by rule 5. After expiry, continuation would require renewal of the rule‑making instrument or new rules adopted under the Act.

If you require a formal register of amendments, revival orders, or public notices that post‑date the original 2017 commencement, those documents will be found in the Government Gazettes and legislative amendment registers rather than in the Rules as provided here.

The provided text contains no court decisions, appeals records, or litigation references. It does not list any judicial determinations relating to the Rules, nor does it cite any cases. The Rules themselves are a statutory instrument and the text as provided does not include any litigation history, judicial interpretations, or court‑issued guidance.

Consequences of an absent litigation record in the text

• No case law referenced here. Because the Rules do not contain or summarise judicial decisions, practitioners must consult case law databases and tribunal records for any judicial interpretations of the Rules, the Act provisions referenced (for example s 77, s 87, s 234), or enforcement outcomes.

• Defences and evidentiary provisions remain to be tested. The Rules provide one express evidentiary defence in rule 46(7) for offences under the fish cauf container marking requirements. How courts have interpreted and applied that defence, or the Rules’ strict liability elements (for example strict possession and quota breaches), will be determinative for practical enforcement risk and is not available from the text.

• Administrative determinations not summarised. Public notices, quota determinations, TACs and endorsements are administrative actions that can give rise to litigation or judicial review, but no such instances are recorded in the Rules text. Practitioners concerned about enforcement practice, reasonableness of decisions or procedural fairness must search administrative decisions and tribunal records.

If litigation history is required for risk analysis, locate judgments under the jurisdiction’s Court and Tribunal databases and review enforcement files accessible under the Act or by Freedom of Information requests. The Rules as provided do not supply case citations or litigation narrative.

Practitioners and compliance officers should be alert to a number of practical traps created by timing rules, narrow definitions, endorsement requirements and recordkeeping details. The following are concrete "watch items" grounded in the Rules.

1. Possession limits apply only to shellfish physically held during a fishing trip, not to stock at a purge site. Rules 11(4) and 12(6) make explicit that the possession limits apply solely to shellfish in the licensee’s physical possession on and during the relevant fishing trip, not to shellfish held elsewhere. This distinction can lead to apparent inconsistencies if enforcement assumes totals across storage and on‑board stock.

2. Equal TAC allocation per licence. The Minister determines TAC and the total is allocated equally among licences issued for the quota period (rule 7(3)). This means incremental improvements in productivity do not increase a licence’s share; licence holders receive a fixed equal quota per period. The allocation model may be counterintuitive to operators used to effort‑based systems.

3. Licence continuity requirements constrain eligibility and transferability. Rule 20 requires an applicant for most class shellfish licences to have held a licence of the same class on the preceding 31 August and to lodge an application within 12 months after expiry. Rule 21 disqualifies lapsed licensees who did not reapply in that 12‑month window (except Pacific oyster). This means administrative delays, illness or other interruptions can lead to loss of eligibility.

4. If you approve a supervisor under s 87, the holder cannot use the licence during that period. Rule 18(2) requires the licence holder who obtains approval for another person to use the licence as supervisor to refrain from using the licence during that approved period. That reduces holder flexibility and may have operational consequences.

5. Purge supervisor constraints are tight. A purge supervisor may not take fish under the licence (rule 19(2)), may only be in possession of shellfish when removing from an endorsed purge site and must hold the purge site record when removing shellfish from a fish cauf (rule 19(3)). Purge supervisors must not be on board a vessel used for the licence if diving equipment is present (rule 19(5)). Those constraints can complicate logistics where supervisors perform multiple roles or where mixed operations involve diving.

6. Docketing and disposal timing is precise. Shellfish dockets must be completed before the end of the day the shellfish are landed and, for non‑Pacific oyster licences, before any shellfish leave the landing area or are moved into temporary structures (rule 34(1)). Originals must reach the Secretary within 48 hours and copies retained for five years (rule 35). Disposal receipts must be signed by purchasers immediately on taking possession and originals lodged with the Secretary within 48 hours (rule 36). Failure to observe these precise time frames is an offence mapped to infringement penalties in Schedule 1.

7. Purge site record timing and single combined document requirement. Rule 47(1) requires a single combined document for each fish cauf recording placement and removal times, kinds and quantities and daily stock. Entries for placement must be made before the end of the day of placement (rule 47(3)); removal entries must be made before the shellfish leave the landing area (rule 47(4)). The single document requirement means distributed or fragmented recording practices are non‑compliant.

8. Fish cauf labelling and separation. Rule 46(6) requires day‑separated containers and species separation with each container clearly marked with the date placed and the shellfish docket number. The Rules attach Grade 1 penalty to failure to comply with labelling and separation (rule 46(6) penalty Grade 1). The labelling requirement is an immediate practical control on mixing and traceability.

9. Vessel and punt constraints. Holders must only use vessels specified in a fishing licence (vessel) (rule 31(1)) for licence purposes. A punt may be used only where endorsed (rule 31(3)) and only one punt at a time may be used. Punts are limited to non‑mechanically powered vessels under 2.5 metres long (rule 31(5) definition). Additionally, punts cannot carry shellfish if diving equipment is on board, if any diving occurred during the trip, or if shellfish taken under other licences are onboard (rule 31(4)). These constraints affect small‑boat operators and logistics.

10. "Use" of the shellfish disposal receipt book is tightly controlled. Rule 19(6)-(7) requires purge supervisors to use only the most recently issued personal book and not allow others to use it. “Use” includes signing, writing, removing or substituting folios. Misuse is an offence.

11. Reporting timing constraints. Reports cannot be made earlier than 24 hours before the activity (rule 41), unless the Secretary approves in writing. Cancellation reports must be made within two hours after the activity was supposed to have been carried out (rule 42). These timing rules require real‑time operational discipline.

12. The Rules have a statutory life. Rule 5 sets the duration at 10 years. Licence holders planning multi‑year investments based on the regulatory regime should factor in the finite statutory horizon and the possibility of different future rules or non‑renewal.

13. Pacific oyster licence exceptions and non‑transferability. A Pacific oyster licence is not transferable (rule 23) and Pacific oyster licence holders are not required to make pre‑fishing reports for taking only Pacific oysters unless directed by the Secretary (rule 40(2)). That creates asymmetry between Pacific oyster licences and other licence classes.

14. Reconciliation of whole weight vs number. Rule 7(2) allows TAC determination by whole weight or number. Rule 48 then directs that docket quantities be recorded consistent with how the licence allocation is expressed (whole weight in kilograms if allocation is whole weight; otherwise number). Practitioners must reconcile measurement method with the endorsed allocation.

Being alert to these specifics will reduce inadvertent breaches. The Rules impose many procedural and timing constraints that are operationally material.

This checklist maps the Rules’ operational and documentation obligations into a practical compliance programme for licence holders, purge supervisors, assistants and processors. Cross‑references to the Rules are included for each compliance step.

1. Confirm licence class, endorsements and territorial scope (rules 6, 15, 31, 45, 46).

   • Verify the licence class (clam, cockle, native oyster, Pacific oyster, commercial dive or vessel) and the precise area and species authorised (rule 15).
   • Check endorsements required for apparatus, fish caufs, punts and specific State waters. Do not use any apparatus or fish cauf unless the licence is endorsed for that purpose (rules 13(1), 45(1), 46(2), 31(1)-(3)).
   • Ensure vessel(s) used are specified in a fishing licence (vessel) where required (rule 31(1)).

2. Understand quota allocation and monitor quota balance (rule 7, rule 8).

   • Obtain and record the quantity endorsed by the Secretary on the licence for the relevant quota period (rule 7(4)).
   • Maintain a running tally of quantities taken and retained under the licence to ensure you do not exceed the shellfish quota balance for the quota period (rule 8(1)-(2)).

3. Pre‑fishing reporting and timing (rules 38-42).

   • Use an approved reporting service to lodge pre‑fishing reports before entering the authorised area and before taking shellfish (rule 40(1)). Pacific oyster licence holders only exempt if taking Pacific oysters alone and not directed otherwise by the Secretary (rule 40(2)).
   • Do not lodge reports more than 24 hours in advance unless the Secretary gives written approval (rule 41).
   • If the planned activity does not proceed, lodge a cancellation report within two hours of the scheduled activity (rule 42).
   • Keep and produce the report receipt number to fisheries officers on request (rule 38(2)-(3)).

4. Docketing and disposal receipts (rules 34-37).

   • Complete shellfish dockets as required: for non‑Pacific oyster licences do so before end of day landed and before any shellfish leave the landing area or are moved inside tents/buildings/vehicles; Pacific oyster licences must complete by end of the landing day (rule 34).
   • Send original completed dockets to the Secretary within 48 hours and keep a copy in good condition for at least five years (rule 35).
   • Complete a shellfish disposal receipt in the approved form for each kind of shellfish sold or transferred and ensure the purchaser signs immediately on taking possession (rule 36(1)).
   • Send originals of disposal receipts to the Secretary within 48 hours and retain copies for five years (rule 36(2)).
   • If you are a fish processor, do not take possession of shellfish unless you have a copy of the completed disposal receipt; retain that copy while processing and for five years (rule 37).

5. Purge sites and fish caufs (rules 45-47, 46(6)).

   • Only use fish caufs if endorsed on the licence (rule 45(1)). Place and hold shellfish only at locations specified in the licence (rule 46(2)).
   • Keep shellfish from each day in separate containers and, if multiple kinds are taken that day, keep each kind in separate containers (rule 46(6)(a)-(b)).
   • Mark each container with the date of placement and the shellfish docket number (rule 46(6)(c)(i)-(ii)).
   • Maintain a single combined purge site record for each fish cauf recording precise dates and times of placement and removal, kinds and quantities, and daily stock (rule 47(1)).
   • Ensure that the person who places or removes shellfish has possession of the purge site record before doing so (rule 47(2)).
   • Make placement entries before the end of the day placed, removal entries before shellfish leave the landing area, and daily stock entries before end of day (rule 47(3)-(5)).
   • Retain purge site records for at least five years (rule 47(6)).

6. Assistants, supervision and purge supervisors (rules 17-19).

   • Limit assistants to no more than two for class shellfish licences (rule 17(1)) unless you hold a Pacific oyster licence (rule 17(2)).
   • Supervise assistants at all times while they participate in fishing under the licence (rule 17(3)).
   • When appointing a supervisor or purge supervisor under s 87 of the Act, be aware the licence holder must not use the licence during the approved supervisory period (rule 18(2)).
   • Ensure purges supervisors do not take fish under the licence, are only in possession when removing from an endorsed purge site, carry the relevant purge site record when removing from a fish cauf, do not mix shellfish from different licences, are not on board vessels with diving equipment while acting as purge supervisor and use only their personally issued shellfish disposal receipt book (rule 19(2)-(7)).

7. Size limits, possession and recreational rules (rules 11-14).

   • Measure undersize thresholds and ensure you do not exceed the on‑trip possession limits (100 for specified undersize katelysia, native oysters and venerupis clams; rule 11).
   • Watch for Ministerial public notices that alter size thresholds, minimums, maximums and allowable numbers for other species (rule 12).
   • For recreational fishing, respect daily limits and note the limited Aboriginal exception for cultural activities (rule 14).

8. Weighing and recording quantities (rule 48).

   • If a licence allocation is expressed as whole weight, record quantities in dockets and records by whole weight in kilograms (rule 48(2)(a)). If allocation is by number, record by number (rule 48(2)(b)).
   • Ensure scales are calibrated and that personnel are trained in accurate whole weight measurement where applicable.

9. Transfers to marine farms and processing (rule 49).

   • Do not sell or transfer shellfish to a marine farming licence holder unless their licence is endorsed for that kind of shellfish (rule 49).
   • Processors must keep disposal receipt copies with shellfish while processing and retain for five years (rule 37(2)).

10. Audit, training and administrative controls.

• Develop documented checklists and standard operating procedures that map each stage of the take‑to‑sale chain against the Rules: pre‑fishing report, fishing trip tally, dockets, fish cauf entries, purge site records, disposal receipts and deposit of originals to the Secretary.
• Train all assistants, purge supervisors and any other persons acting under the licence on the timing constraints, documentation requirements and labelling rules.
• Maintain secure storage for docket and disposal receipt copies and purge site records for the required five‑year retention period.

11. Liaison with the administering agency.

• Seek written endorsements for apparatus, fish caufs, punts and alternative reporting arrangements where available (rules 13, 45, 31, 43).
• If the Secretary requires research participation under rule 22, schedule and resource up to two days in a licensing year for the research tasks specified.

12. Responding to enforcement contact.

• Provide report receipt numbers to fisheries officers on request (rule 38(3)).
• Keep contemporaneous evidence of compliance actions: completed dockets, disposal receipt originals and copies, purge site records and vessel endorsements.

Following these steps and mapping each requirement to the cited Rules should materially reduce exposure to infringement notices and prosecutions. Where operational uncertainty exists, particularly regarding endorsements, public notice content (TACs, seasons and size rules), or interpretation of records requirements, seek written confirmation from the Secretary or legal advice.
