• Mechanically: it does this by (a) requiring accreditation for those carrying out Commonwealth‑funded building work (s43); (b) giving the Commissioner oversight, auditing, and compliance tools (ss38, 70–79); and (c) providing civil enforcement and penalty mechanisms that courts can apply on application (ch 8, especially s81).

Immediate practical effects and incentives

• Builders who want to win Commonwealth‑funded contracts will need to obtain and maintain accreditation under the WHS Accreditation Scheme. The rules can prescribe application procedures and fees (s43(1)–(3), s120(1)–(2)).
• Commonwealth procurement teams must verify accreditation at funding time, so procurement practice and contract drafting will change (s43(4)).
• The Commissioner and Federal Safety Officers can inspect business and (in limited circumstances) residential premises, require production of documents and keep certified copies admissible as evidence (ss72–79). That increases the scope for administrative compliance costs and recordkeeping.

Costs, trade‑offs and implementation risks to watch

• Compliance burden and costs fall primarily on builders (accreditation costs, application fees, administrative overhead of inspections and record production; see s43(3), ss74, 77, 79).
• The Commonwealth indirectly bears implementation costs: administering the Commissioner’s office, paying consultants, and adjusting procurement processes (ss37, 42, 120). Where the Court orders compensation payable to private persons, appropriation arrangements are provided (s81(7)).

• The Minister can issue directions to the Commissioner on general approach (not on particular cases) and make rules by legislative instrument; the Governor‑General may make regulations (ss39, 120).
• The Commissioner decides accreditation standards, delegates functions, appoints Federal Safety Officers, and can disclose information as authorised in the Act (ss37–40, 42, 43, 105).

Concrete substitution or concentrated benefit risks

• Accredited builders stand to gain preferential access to Commonwealth‑funded work. Costs of accreditation could deter small firms from tendering unless the scheme provides scalable entry routes (s43(4)).
• Rules may carve out exceptions or include additional activities, so the regulatory perimeter can shift materially once rules/regulations are made (s6(4)–(5), s120).
