What it does
This Regulation prescribes operational, registration, records, staffing, premises and resident-protection requirements for boarding houses that fall within Part 4 of the Boarding Houses Act 2012 (NSW) , principally assisted boarding houses that are authorised by licence or interim permit (an authorised boarding house). It does three mechanical things first.
-
It sets additional registration particulars and the public register content (cl 4, cl 5). Clause 4 prescribes contact details, local government area, proprietor details, capacity, fees and payment methods, services offered and broad resident demographics as particulars that must be notified for registrable boarding houses. Clause 5 prescribes that particulars of enforcement action recorded in the Register of Boarding Houses may be published online.
-
It prescribes the conditions of boarding house authorisations, approval and authorisation application requirements, specified grounds for refusal and revocation, and the Director‑General’s approval roles and powers. Examples include additional probity checks for licence applications (cl 8), additional information and experience required from applicants (cl 7), further grounds that can justify refusal of licences, permits and manager approvals (cl 9), revocation where an interim permit holder contravenes the Act or Regulation (cl 10), and a suite of prescribed conditions attached to authorisations (cll 11-18). The Director‑General is repeatedly identified as the decision maker with powers to approve screening tools, issue directions on staffing levels and require submission of plans or records (see cll 6, 11(1), 14, 17 and related clauses).
-
It creates detailed operational standards and recordkeeping, reporting and monitoring obligations for authorised boarding houses. Schedule 1 sets minimum standards for staffing, premises, facilities, lifestyle, health and medication. The Regulation prescribes specific duties such as staff‑to‑resident availability and first aid requirements (sch 1 Pt 1 cll 1-3), maximum residents per house and bedroom size requirements (sch 1 Pt 2 cll 6-7), medication storage and administration rules (sch 1 Pt 4 cll 28-29), reporting requirements for incidents, police attendances, planning non‑compliance and changes in operator circumstances (cll 26-29), records to be kept and retention periods (cll 19-25), and special temporal rules introduced for the COVID‑19 pandemic (Part 5 cll 32-35).
