NCAT Appeal Panel | 2014-04-09
Tenants were terminated for non-payment of rent following an uncontested hearing where the landlord's agent gave evidence and the Member recorded findings in hearing notes. The tenants sought leave to internally appeal under s 80(2)(b) but did not raise any question of law; therefore leave required. Clause 12 Schedule 4 requires showing the appellant 'may have suffered a substantial miscarriage of justice' because the decision was unfair, against the weight of evidence, or there is significant new evidence. The tenants relied on phone logs and asserted contact and willingness to pay. The Appeal Panel found the record disclosed arrears and necessary findings, the phone logs were not fresh or persuasive, and there was no denial of procedural fairness. Leave was refused, the appeal dismissed, and the stay of the original orders lifted.

The appeal succeeded because the prosecution gave the defence an important file note only after questioning of the complainant had started. The note contained an account and inconsistencies that mattered to assessing her evidence. The Court considered that the late disclosure could realistically have affected the jury’s reasoning and that the harm could not be undone by extra time or an explanation. The Court did not accept the other grounds, including the challenges based on the different verdicts and the overall evidence. It set aside the three convictions and ordered a new trial on those counts.

The Court of Appeal refused SY permission to appeal the dismissal of his challenge to the Public Guardian's appointment for VY. It said SY had not shown a matter of legal principle, public importance, or sufficiently clear injustice. The Court also noted that NCAT would review the order in October 2025 and that SY would be entitled to notice and to be heard at that review. The Court corrected the first respondent's name and made no costs order.
