Introduction 1 These proceedings are applications for a determination of native title under s 61 of the Native Title Act 1993 (Cth) (NT Act) in WAD 22 of 2019 (Gnulli Application), WAD 366 of 2018 (Gnulli #2 Application) and WAD 261 of 2019 (Gnulli #3 Application), collectively the Gnulli Applications. 2 The applicants in the Gnulli Applications, the State of Western Australia and the respondents to the proceedings (parties) have reached an agreement as to the terms of a determination (Determination) which is to be made in relation to the land and waters covered by the Gnulli Applications (Determination Area). The external boundaries of the Determination Area are described in Sch One to the Determination. 3 The Determination Area is divided into two geographical areas, being the Baiyungu and/or Thalanyji Area in the north of the Determination Area and the Yinggarda Area in the south of the Determination Area. The external boundaries of the Baiyungu and/or Thalanyji Area and the Yinggarda Area are described in Sch Eight to the Determination. The Baiyungu and/or Thalanyji native title holders hold the native title rights and interests in relation to the Baiyungu and/or Thalanyji Area in accordance with Baiyungu and/or Thalanyji traditional law and custom. The Yinggarda native title holders hold the native title rights and interests in relation to the Yinggarda Area in accordance with Yinggarda traditional law and custom. 4 The applicants in the Gnulli Applications and the first respondent have filed joint submissions in support of determinations of native title being made in the Gnulli Applications. The orders are sought by consent.
