- For the reasons thus summarised, I consider that Staples should be viewed with some caution when considering the circumstances in which State legislation (in which I include rules of court) will be considered to permit amendment where the effect is to revive a cause of action extinguished by State law.
- I should next refer to Harris & Anor v Western Australian Exim Corporation[57]. Both counsel relied upon it. According to the defendant's argument it supported the fourth concession which was made; and supported a conclusion that neither the Victorian Rules nor s. 34 of the Limitation of Actions Act can have the effect of permitting resurrection of an extinguished right of action under the Carriers Act.
