The application was not to correct a mistake in the name of a party by substituting another person as a party (r. 36.01(4)); it was an application to substitute a person who ought to have been joined as a third party in the first place: r. 9.06(c).
The question in this appeal is whether r. 36.01 of the Supreme Court Rules Vic authorizes the substitution of another person for the person named as defendant in the action after the expiration of the relevant limitation period for bringing an action against the first person.
(1) For the purpose of determining the real question in controversy between the parties to any proceeding, or of correcting any defect or error in any proceeding, or of avoiding multiplicity of proceedings, the Court may at any stage order that any document in the proceeding be amended or that any party have leave to amend any document in the proceeding.
