What it does
The Unclaimed Money Act 1995 (NSW) establishes a comprehensive statutory scheme for the identification, reporting, payment, custody and eventual repayment of unclaimed money and unclaimed superannuation benefits within New South Wales. At its core the Act deems certain money to be “unclaimed” once an account has remained dormant for the statutory period (generally two years under s 7(1)(a), although enterprises may apply for a shorter period of at least 12 months under s 7(1)(b)). Section 8 limits the categories of money that can qualify: money whose recovery is or may be barred by limitation, money on deposit, and withdrawable share capital.
Before any money can be treated as unclaimed, an enterprise must discharge the positive obligation imposed by s 8A(1) to make reasonable efforts to identify and locate the owner and to pay the money to that owner. Only once those efforts have been made and a reasonable period has elapsed without success does the money become unclaimed (s 8A(2)). Section 9 then carves out several important exclusions: money is not unclaimed if the enterprise still holds other non-unclaimed money for the same owner, if the enterprise or its officer has reason to believe the owner wishes the money to remain in the account, if a dispute exists as to ownership, if the amount is $100 or less, or if the money or enterprise is prescribed by regulation as exempt.
Once money is unclaimed on 30 June in any year, the enterprise must lodge an approved return and pay the net amount to the Chief Commissioner within four months (s 10(1) and (1B)). The return must disclose any payments made to owners after 30 June but before lodgment (s 10(1A)). A parallel but distinct obligation applies to public sector superannuation providers under s 13B: they must lodge half-yearly returns of unclaimed superannuation benefits (as defined by reference to the Commonwealth ) by 1 November or 1 May (or such later date as allowed) and remit the net amount to the Chief Commissioner. Money received by the Chief Commissioner is paid into the Consolidated Fund (ss 10(2), 13B(5)).
