3 33 0 Amending Clause 12 .2 to read as follows :- 12 .2 In the event of a landowner providing funds or construction works after the date of the resolution to prepare the Scheme and before the gazettal of the final approval of the Scheme in respect to any Scheme Works (in- cluding the extension of any main drain, sewer or water main) to serve and expedite development in the Scheme Area provided that the cost of such works would otherwise be a Scheme Cost, the Council may reim- burse the landower the capital cost and in- terest (set at the rate adopted by Council in Clause 12 .3) from Scheme funds as col- lected from other landowners as and when funds are available to the extent that it considers to be fair and equitable and in- clude such sum in Scheme Costs provided that such reimbursement shall not exceed an amount which represents the proportion of such works which will not be the landowners cost under the Scheme .
