THE Minister for Fisheries and Wildlife pursuant to the powers conferred by section 14 of the Wildlife Conservation Act 1950 (as amended) does hereby declare an open season in respect of fauna listed in the schedule hereto in the whole of the State of Western Australia in all those parts of that State which lie within the boundaries of Divisions as defined in section 28 of the Land Act 1933 (as amended) and in all those parts of the State which lie within the municipal districts within the meaning of the Local Government Act 1960 (as amended) of the Shires, specified in the Schedule hereto subject of the following restrictions on the taking of that fauna:— (1) The fauna described in the Schedule hereto may be taken without licence by landholders or leaseholders (or their approved agent) on that land which they own or occupy which lies in the whole of the State of Western Australia in all those parts of that State which lie within the boundaries of Divisions as defined in section 28 of the Land Act 1933 (as amended) and in all those parts of that State which lie within the municipal districts within the meaning of the Local Government Act 1960 (as amended) of the Shires, as specified in the Schedule hereto. (2) The fauna may be taken only when it is causing damage or may be reasonably expected to cause damage to property production or domestic stock. (3) A person shall not take or atempt to take any such fauna by means other than a firearm licensed in conformity with the Firearms Act 1973 or by such other means as an authorized wildlife officer in a specific instance may authorize. (4) That part of the Notice, relating to an open season in respect of the species of fauna mentioned in the Schedule hereto, published in the Government Gazette (No. 40) of 16 June 1978 is hereby cancelled.
