Why it matters (purpose claims and practical effects)
Purposes claimed in the text (express or implied):
Testing those purpose claims against costs, incentives and trade‑offs (what the Rules do to behaviour and who bears costs):
Who pays, who decides and what behaviour changes (direct statements)
Who pays: Providers pay most of the incremental compliance costs (time, police check fees, ASIC/AFSA searches, obtaining ATO Statements of Tax Record, updating billing and record systems). Individuals (claimants) may pay indirect costs if missing tax lodgements or debt repayments prevent effective claims. The Department bears processing and enforcement costs.
Who decides: The Secretary (Department) determines provider approvals, can accept or waive some requirements (s 5(2) example), and enforces record/statement/reporting requirements. Providers decide how to organise their record‑keeping and billing systems to comply.
Behavioural effects providers/claimants will face: Providers will need to collect specified probity and financial documents before applying (s 6), maintain and keep specified records (ss 11–12), present richer statements to families (s 10), and report detailed session data (s 13). Families will need to keep tax lodgement and debt positions current to avoid claim hygiene issues (s 5).
Implementation risks and trade‑offs
Implementation risk: The Rules assume secure, working data flows between providers and the Department (session reports, statements, departmental identifiers). Successful operation requires IT capability and clear process timetables. The transitional clauses (ss 14–15) give lead time for two changes but mean providers must track multiple effective dates.
Trade‑offs and opportunity cost: The Rules allocate administrative burden to providers and applicants in return for improved verification and auditability. That may discourage some small providers or require them to invest in administrative systems rather than direct service provision. The Rules do not themselves set monetary penalties in these extracts, but failure to comply can affect approval and subsidy payment flows under the Family Assistance Acts.
