Bounty (Books) Act 1986

How much is paid (rates and timing)

• The bounty is a percentage of the publisher’s production cost; the Act sets year-by-year percentages that decline over time (for example 20% before 1 Jan 1989; falling to 4.5% for books produced on or after 1 Jan 1997) (section 11).
• A claim must be lodged within 12 months after production is completed and must be on the approved form with required information and signatures (section 14(4)). Claims below a net publisher’s cost threshold ($3,700) cannot be made (section 14(2)).

How costs and prices are treated; CEO discretion

• The Act defines technical cost and price terms (publisher’s manufacturing cost, manufacturing price, paper cost, production cost) and provides a specific formula for how prices paid/payable are to be worked out (section 4(5) — formula appears in the text).
• The CEO has express power to reassess or determine a publisher’s manufacturing cost, paper cost or manufacturing price where he or she considers those figures incorrect, inflated by related‑party pricing, or distorted to obtain more bounty (section 7). The CEO must give affected publishers/printers a copy of such determinations (section 7(3)).

Records, registration, securities and compliance burden

• To be eligible a person generally must be registered (section 19). The CEO may prescribe registration conditions and may cancel registration if the person no longer meets the conditions (section 19).
• Registered persons must keep English-language accounts, books and records that the CEO specifies (published in the Gazette or given in writing) and retain them for at least three years after a claim (section 20).
• The CEO may require security (bond, guarantee or cash) to be given before bounty or advances are paid (section 21).

Inspections, investigations and enforcement powers

• The CEO may appoint authorised officers who can inspect premises, production processes and records (sections 22–23). With consent or a warrant, officers may enter premises and make copies or extracts of records (sections 24, 23(1)).
• Collectors or authorised officers may require people to attend, answer questions and produce documents; answers and produced material are generally protected from use in criminal proceedings except for specific offences under the Criminal Code (sections 25–26 and 9A).
• There are criminal penalties for refusal/non‑compliance and specific offences dealing with over‑claims and false acknowledgements; certain offences are subject to the Criminal Code (sections 16, 27, 9A).

Advances, repayments and recovery

• The CEO may make advances on account of bounty on terms he or she approves (section 13). If advances exceed actual entitlement, the recipient must repay the excess; the Commonwealth may recover repayments by debt action or by deduction from other amounts payable under the Act (sections 13, 30).
• The CEO can demand repayment where overpayments are found, but may elect (in limited circumstances and for amounts up to $25,000) not to pursue recovery if recovery would be unreasonable or not cost‑effective (section 17).
• Conviction for relevant offences can lead to court orders to refund wrongfully obtained bounty; such orders can be enforced as judgments (section 29).

Administrative review and transparency

• Decisions of the CEO on payment/refusal, registration and security can be reviewed by the Administrative Appeals Tribunal (AAT) (section 33).
• The CEO must provide an annual return to the Minister listing who received bounty and the amounts; the Minister must table that return in Parliament (section 31).

Interplay with tariff law and amendments

• Eligibility depends on tariff classification; if the Tariff Act changes so that a book kind ceases to be bountiable, transitional rules treat some productions as completed before that change (section 6). The Act also treats a proposed alteration to the Tariff Act as if it were effective on the proposed day for the purposes of this Act (section 4(7)).

Stated purpose, incentives and trade‑offs (source claims and consequence testing)

• The Act’s operational rule: pay a production‑linked payment to encourage/assist domestic production of books that meet the tariff classification and pass the ineligible tests (sections 10–11, 5). That is the mechanical effect stated in the Act.
• Costs and who pays: Commonwealth appropriation funds (section 35) finance the payments; where funds are constrained the CEO may defer payments (section 12) and the CEO may require security from claimants (section 21).
• Incentives created for private actors: the payment effectively reduces the publisher’s net production cost (section 11). The law incentivises production runs that meet the Act’s technical definitions (for example runs of 1,000+ copies (section 5(1)(p)), casebound formats for some categories (section 4(2)–(3)), and retaining production processes in Australia where that affects publisher’s manufacturing cost definitions (see definitions in section 4).
• Concentrated benefits / diffuse costs: benefits are concentrated on registered publishers and printers who meet the technical definitions and thresholds; costs (appropriations) are borne by the Commonwealth budget (sections 19, 35).
• Compliance burden and administrative discretion: the Act imposes record‑keeping, registration and production‑definition requirements (sections 19, 20) and gives the CEO broad powers to determine and adjust costs and prices and to inspect premises (sections 7, 21–25). Those elements create compliance costs for businesses and administrative discretion for the CEO (sections 7, 19, 21, 23–25).
• Risks and implementation issues signalled by the text: measuring production cost precisely (definitions and formula in section 4(5)); detecting and correcting related‑party pricing and marginal costing (CEO powers in section 7); ensuring uniform application across States (constitutional uniformity constraint in section 9); and dealing with treasury limits (section 12).

Net effect on private choice, markets and production

• The Act reduces the effective production cost for eligible books, which can change publisher/printer choices about print runs, where to carry out production processes, and which titles to publish domestically — but only where the technical and eligibility tests are met (sections 4, 5, 11).
• It places administrative and compliance obligations on those who wish to claim the bounty (sections 14, 18, 20, 23–25), and gives the CEO significant oversight and corrective powers (sections 7, 19, 21).
