NCAT Appeal Panel | 2014-04-09
Tenants were terminated for non-payment of rent following an uncontested hearing where the landlord's agent gave evidence and the Member recorded findings in hearing notes. The tenants sought leave to internally appeal under s 80(2)(b) but did not raise any question of law; therefore leave required. Clause 12 Schedule 4 requires showing the appellant 'may have suffered a substantial miscarriage of justice' because the decision was unfair, against the weight of evidence, or there is significant new evidence. The tenants relied on phone logs and asserted contact and willingness to pay. The Appeal Panel found the record disclosed arrears and necessary findings, the phone logs were not fresh or persuasive, and there was no denial of procedural fairness. Leave was refused, the appeal dismissed, and the stay of the original orders lifted.

The Court of Appeal rejected Mr Mohareb’s attempt to reopen its earlier refusal to grant leave to appeal. It said r 36.16 can correct a genuine oversight, but it is not a second opportunity to argue a case that has already been rejected. Having compared his complaints with the earlier reasons, the Court found that the relevant limitation, knowledge and summary-dismissal points had been considered. The motion was dismissed, and Mr Mohareb was ordered to pay the respondents’ costs.

The NSW Court of Appeal held that RNSW could appoint an administrator to the ATC in the particular circumstances described. The Court treated the ATC’s financial health and governance as potentially connected to its ability to operate racecourses and conduct thoroughbred race meetings. It found that RNSW’s reasons, read fairly and as a whole, supported that connection. The Court also rejected the ATC’s arguments that RNSW had unreasonably misread the KordaMentha report, that the Merger Act impliedly repealed the appointment power, or that the power conflicted with the Corporations Act. The appeal succeeded, although the Court temporarily stayed operation of the appointment until 13 July 2026 or further order.
