NCAT Appeal Panel | 2014-04-09
Tenants were terminated for non-payment of rent following an uncontested hearing where the landlord's agent gave evidence and the Member recorded findings in hearing notes. The tenants sought leave to internally appeal under s 80(2)(b) but did not raise any question of law; therefore leave required. Clause 12 Schedule 4 requires showing the appellant 'may have suffered a substantial miscarriage of justice' because the decision was unfair, against the weight of evidence, or there is significant new evidence. The tenants relied on phone logs and asserted contact and willingness to pay. The Appeal Panel found the record disclosed arrears and necessary findings, the phone logs were not fresh or persuasive, and there was no denial of procedural fairness. Leave was refused, the appeal dismissed, and the stay of the original orders lifted.

The Court of Appeal rejected the applicant’s request for an advance assurance about human rights and considered her judicial-review case. It found that she had been given opportunities to present her case in the Local Court and District Court, including explanations about how to seek to rely on new evidence. The Court concluded that she had not shown jurisdictional error by the District Court. It extended the time for filing the summons, but dismissed it and ordered her to pay the respondent’s costs.

The Court of Appeal dismissed Ms Bezzina's challenge to a District Court decision connected with her attempts to reopen proceedings about a speeding conviction. It said the summons was limited to the District Court's 8 November 2024 decision, while the allegations of serious misconduct were unsupported and partly outside that scope. The Court also recounted that Ms Bezzina had had a trial, appealed her conviction, and made applications to reopen the decision. It ordered her to pay Transport for NSW's costs.
