- PAYNE JA: I agree with Hidden AJ.
- DAVIES J: I agree with Hidden AJ.
- HIDDEN AJ: The applicant, Luke Udovcic, pleaded guilty in the District Court to an indictment containing the following two counts: 1. assault occasioning actual bodily harm in company, an offence under s 59(2) of the Crimes Act 1900 (NSW), carrying a maximum sentence of imprisonment for 7 years; 2. wounding with intent to cause grievous bodily harm, an offence under s 33(1)(a) of the Crimes Act, carrying a maximum sentence of imprisonment for 25 years and a standard non-parole period of 7 years.
- For the two counts, he was sentenced to an aggregate term of imprisonment for 10 years with a non-parole period of 7 years and 6 months. The indicative sentences were: 1. on the first count, 3 years and 1 month with a non-parole period of 2 years and 3 months; 2. on the second count, 9 years with a non-parole period of 6 years and 9 months.
