For the reasons discussed above, the application for leave pursuant to s 54 of the VPA is refused and the application is dismissed.

The purpose for which a stay will be granted is, as correctly identified by the applicant in his supporting affidavit affirmed 7 January 2026, to ensure the proposed appellate proceeding will not be rendered nugatory.
Because I have refused the application for leave pursuant to s 54 of the VPA, there is no basis to grant a stay, whether that be of the sentence or of the warrant. Because the applicant does not have leave to commence an application for leave to appeal the sentence, no appellate proceeding exists or is entitled to be commenced, the effectiveness of which might require protection via a stay.
The application for a stay of execution of the sentence and of the warrant is dismissed.
