- For the reasons I have set out in detail in this judgment, I have preferred and accepted the plaintiff's version of events to the versions put forward by the defendants and the witnesses called by the defendants, I have found that the first defendant Heath Robinson brutally assaulted and battered the plaintiff as claimed. I have also found that the second and third defendants were in breach of the respective duties of care they owed to the plaintiff.
- I have found that the plaintiff's injuries were caused by both the assault and the battery committed by the first defendant, as well as by reason of breach of duty of care on the part of the second and third defendants. I have found that in the relevant events there was no contributory negligence on the part of the plaintiff. I have found that in addition to an entitlement to compensatory damages as against each defendant the plaintiff is also entitled to an award of exemplary and aggravated damages as against the first defendant.
