The proposal is to demolish all existing buildings and construct a 4 and 10 storey building for, 63 dwellings, a shop and three food and drink premises. The shop and two of the food and drink premises front onto Bridge Road at ground floor level. The third food and drink premises fronts onto Leggo Place at lower ground floor level.
Application under section 79 of the Planning and Environment Act 1987 for review of the failure to grant a permit within the prescribed time.
Clause 43.01-1, demolition, construction and works.
The subject land is a regular lot located on the north side of Bridge Road, between Judd and Bosisto Streets in Richmond. The rear (north) boundary of the land abuts Leggo Place. The land has a frontage to Bridge Road of 20.19 metres, and a site area of approximately 958 square metres. The site is located within the Bridge Road Major Activity Centre.
The Tribunal inspected the site and locality on 5 March 2015
showing Leggo Place and Thomas Street Car Park facades
Numerous decisions of the Tribunal have considered the notion of what constitutes equitable development rights. The following principles emerge from these decisions in relation to equitable development rights:
In our view these design inadequacies must be remedied if there is to be an acceptable development proposed. It is our opinion that, as a minimum, there would need to be a substantial increase in the width of the gap to address the amenity deficiencies we have identified above.

Figure 6 - Level 1 Floor plan adjacent to The Gap (north to the right)
Apartment buildings which achieve these criteria will undoubtedly be well on the way to achieving a very high standard of design in respect of their internal corridors. A lesser standard may be acceptable, an objective assessment which must be made in each case.
Moreover, for the reasons set out above we believe that it would be desirable for there to be a further simplification of the design of the Bridge Road façade, although this is not as important as the deficiencies identified in respect of internal amenity.

[3] We also have a reservation in respect of that design decision to rely on a single lift to service up to 63 dwellings in in a 10 story building.
[5] Therefore, conventionally occupied, such an apartment is unlikely to have multiple residents highly dependent on separate spaces within a dwelling. For example, a teenage child who has to spend half, his or her, life in their bedroom.
