When submitted and approved to the satisfaction of the responsible authority, the Disability Access Plan and associated notated plans will form part of this permit.
All activities associated with the construction of the approved buildings and works must be carried out in accordance with the Construction Management Plan. The Construction Management Plan may be amended to the satisfaction of the Responsible Authority.
When submitted and approved to the satisfaction of the responsible authority, the Waste Management Plan and associated notated plans will form part of this permit.
Where a Statement of Environmental Audit is issued for the land, the buildings and works and the use(s) of the land that are the subject of this permit must comply with all directions and conditions contained within the Statement.
Where a Statement of Environmental Audit is issued for the land, prior to the commencement of the use, and prior to the issue of a Statement of Compliance under the Subdivision Act 1988, and prior to the issue of an Occupancy Permit under the Building Act 1993, a letter prepared by an Environmental Auditor appointed under Section 53S of the Environment Protection Act 1970 must be submitted to the Responsible Authority to verify that the directions and conditions contained within the Statement have been satisfied.
Where a Statement of Environmental Audit is issued for the land, and any condition of that Statement requires any maintenance or monitoring of an ongoing nature, the Owner(s) must enter into an Agreement with Council pursuant to Section 173 of the Planning and Environment Act 1987. Where a Section 173 Agreement is required, the Agreement must be executed prior to the commencement of the permitted use, and prior to the certification of the plan of subdivision under the Subdivision Act 1988. [1] I have placed greater weight on the Draft Structure Plan, July 2008 which is a reference in the current planning scheme although I have also been taken to the Structure Plan adopted by the responsible authority in August 2010 but not referenced in the planning scheme.
[2] The map nominates a maximum height of 18 metres. The proposal adopts a maximum height of 19. 6 metres.
[3] This is consistent with the views expressed by Senior Member Komesaroff in 457-459 Lygon Street Pty Ltd v Moreland CC & Ors and more recently by Members Sibonis & Keddie in Damfine Pty Ltd & Anor v Moreland CC [2011] VCAT 96 in relation to the DDO provision.
[4] This is a proposal for student accommodation. The responsible authority supported a full waiver of parking for this proposal.
[5] The Structure Plan 2010 recommends a podium height of 15.5 metres. The proposal is for a 12.5 metre high podium.
[8] Within 6.5 to 7 metres of the light source.
[9] This much is assumed, although it was not addressed at the hearing.
[11] The Green Travel Plan as consented to is also included in this assessment. I have also considered relevant aspects of planning policy as derived from submissions and evidence.
[12] As a general observation, I wonder whether there may be an opportunity for a public/private mixed use development incorporating a large number of public parking spaces within a basement on the open public car park site opposite.
