Cremorne Properties Pty Ltd V Yarra CC [2008] VCAT 1202
(Reasons given orally at the hearing but subsequently revised)
Is there strategic support for the redevelopment of this site for an intensive residential use?
The panel clearly encourage a mix of residential and business uses within the area it recommended to being included in a mixed use zone and they did not recommend that the affected area be deleted from the business employment area policy. However, neither did the panel recommend special policy provisions to constrain the exercise of discretion, in respect of the affected land in this regard.
The amendments to the MSS and clause 25.05 [sic] which form part of Amendment C39 Part 3 did contain more specific policies in respect of the land use mix to be achieved, but as we have already observed, do not conclude that the mix of uses on any individual site should include a significant or predominant proportion of employment generating uses.[5]
Is the form of the proposed building is acceptable?
Is satisfactory amenity provided for future residents?
