Parties: Plaintiff: David Bottrill
First Defendant: David Michael Graham (Self-represented)
Second Defendant: Cathryn Gale Gibson (Self-represented)
Representation: Counsel:
Plaintiff: N Kirby
Solicitors:
Plaintiff: O’Connor Legal
File Number(s): 2024/334742
Publication restriction: Nil
The Plaintiff brings an action in defamation under the Defamation Act 2005 (NSW) (‘the Act’) arising from three live broadcasts published on the social media platform X.com (formerly Twitter) (‘X’) via the First Defendant’s profile page on 24 January 2024 (‘First Broadcast’), 29 January 2024 (‘Second Broadcast’) and 3 February 2024 (‘Third Broadcast’) respectively.
In each broadcast, Luke McKee (‘Mr McKee’) was given entry into the broadcasts and was able to speak live on the First Defendant’s “Guru and Crew” podcast.
Mr McKee made assertions that the Plaintiff is a paedophile, the leader of a paedophile cult, and a member of a satanic cult whose religious observance involves drinking blood and molesting children. He referred to the organisation as being Ordo Templi Orientis or OTO (‘OTO’), which, broadly speaking, is said to have dogma like that of the Masons.
The First Defendant (who also goes by the name “Guru”), hosted the broadcasts from his X profile page “@StoptheRot7”.
The Second Defendant (who uses the handle “@CathrynAussie”), was listed as a co-host on each occasion. I found the label to be relevant but not to be determinative. I have also considered, in determining the Second Defendant’s liability as a publisher, the role she played during each broadcast.
On each occasion, Mr McKee (using the handle “@EndTheZB951Visa”) was given an opportunity on the broadcasts to make highly defamatory statements about the Plaintiff by name.
The broadcasts were published to substantial live audiences and remained available on the First Defendant’s X profile page after the live broadcasts concluded.
Concerns notices were sent on 25 March 2024 and 18 April 2024. Neither Defendant responded to them.
The Plaintiff filed his statement of claim on 10 September 2024.
The Second Defendant filed an Amended Defence on 28 April 2025.
The Plaintiff filed a Reply on 19 May 2025.
The First Defendant filed an Amended Defence on 2 February 2026.
The Defendants were initially self-represented. Gibson DCJ made several interlocutory rulings: Bottrill v Graham [2024] NSWDC 566, Bottrill v Graham & Anor (No 2) [2025] NSWCC 221 and Bottrill v Graham & Anor (No 3) [2025] NSWDC 306.
Gibson DCJ facilitated access to the Defendants to the District Court’s pro bono panel. Whilst initially self-represented, the First Defendant was represented by pro bono lawyers up until shortly before the hearing. The Second Defendant has at all times been self-represented.
On 20 June 2025, Gibson DCJ determined, pursuant to s 10A of the Act, that the Plaintiff had established serious harm to his reputation and that the action should proceed to trial.
The trial was listed to commence on 23 March 2026.
On 13 March 2026, the Court wrote to the parties asking for confirmation that the trial was ready to proceed.
On 16 March 2026, the First Defendant’s solicitors filed a Notice of Ceasing to Act.
On 17 March 2026, the First Defendant’s solicitors informed the Court that they had ceased to act in the proceedings.
On 23 March 2026, the First Defendant appeared in the trial self-represented, his pro bono lawyers having withdrawn with his consent. I refused his application for an adjournment for reasons set out in an ex tempore judgment given that day.
Accordingly, both Defendants were self-represented in the trial.
Both Defendants were granted leave to appear by Audio Visual Link (‘AVL’) due to the First Defendant’s health concerns and the Second Defendant’s distance from Sydney.
On 24 March 2026, the Second Defendant, at a time when the Plaintiff had called his publication witness Rodney Swift, absented herself from the proceedings due to asserted family issues. She had similar issues the day before and the matter was accommodated by allowing her to appear via AVL from another location.
At 10.56am on 24 March 2026, my Associate sent the Second Defendant an email indicating that I wished for her to appear and set out the matters that had been set out in her email, as the Plaintiff resisted an adjournment and was concerned that the hearing would not be completed in the time allocated. The First Defendant’s position was that the Second Defendant should be ready to resume the trial the following day.
I made clear that I had no way of knowing whether the Second Defendant’s situation was only in respect of that day or whether it was ongoing. The Second Defendant was informed that it had been proposed by the Plaintiff that the First Defendant at least complete his cross-examination of Mr Swift.
The Second Defendant was informed that I needed to know what she proposed in respect of her cross-examination of Mr Swift.
I adjourned the hearing for a short period of time so that the Second Defendant could appear via AVL and provide the information needed to make an appropriate determination as to any adjournment.
It was made clear to the Second Defendant that I was concerned about her non-response to the email, sent asking her to come on screen at 11.00am and her unexplained non-appearance at that time. The Second Defendant was informed: that unless she appeared by 12.00pm on the screen, that the proceedings may continue in her absence, in circumstances where she had unilaterally determined not to appear that day (and perhaps the following day) without having first obtained an adjournment; and that it was imperative that she appear at that time.
The Second Defendant did not appear. She was informed by email that I had not allowed the adjournment due to her lack of communication with the Court. She was informed that she could rejoin the proceedings by AVL at any time, but that the proceedings would continue. She was told that the First Defendant was likely to complete his cross-examination of Mr Swift by about 1.00pm and that if she wished to cross-examine Mr Swift, she would need to appear in Court promptly at 2.00pm. She did not appear at 2.00pm and the evidence was completed in her absence.
The Second Defendant reappeared on 15 April 2026 when the matter was next listed to provide written and oral submissions. The Second Defendant made submissions and also tendered further evidence in her case.
In respect of the Second Defendant’s absence at times during the proceedings, I was mindful to honour my obligations to her notwithstanding her non- appearance, in accordance with the principles disclosed in Satz v ACN 069 808 957 Pty Ltd [2010] NSWSC 365 (‘Satz’). I was satisfied that I gave the Second Defendant every opportunity to appear or at least to explain her non-appearance, neither of which she did. She did not later apply to recall any witness. She was allowed to tender evidence after the evidence had closed. Ultimately, as Barrett J noted at [64] in Satz, in an adversarial system, the responsibility for conduct of a case rests with the party concerned.
Mr Swift gave evidence of publication of all three matters complained of in the three broadcasts.
In his cross-examination of Mr Swift, the First Defendant seemed to be suggesting that it was improper for Mr Swift to listen to and notify the Defendant of any defamatory posts, particularly in respect of Mr McKee. I do not agree. The notion that the Plaintiff ought not act to protect his reputation in this way is rejected.
Publication of and concerning the Plaintiff in all three broadcasts was proven.
The First Broadcast was titled “Guru and Crew. Aussie Chat. Bosi in the space. Let’s GO !!!!!!” (CB100) [1] .
It relevantly commenced with a “special guest” talking about: there being “too much Masonic filth, but we’ll fix that problem” (CB118); there isn’t one aspect of life in Oz that is not controlled by the Masonic filth, and they do everything with money (CB120); and that it is the most infested country on the planet with Masons. “It really is and so it’s a tough place to crack; and these cockroaches live under every rock and behind every cupboard” (CB121).
Mr McKee first spoke at approximately 0:20:48 [2] (CB104) with conspiracy theories relevantly including about “VIP paedos”.
Commencing at approximately 0:26:44 of the First Broadcast, Mr McKee made the first defamatory statements of and concerning the Plaintiff (CB106). They are in the following terms [emphasis added]:
Luke McKee — Okay, I just wanted to tell you that if you want to look at this system in Australia, right, the legal system is thoroughly corrupt. If you look at Sunol, SunolJohnC, on Twitter, he's being sued by an intelligence operative David Bottrill, who's been assigned to the Australian Embassy in Turkey, and if he was just regular immigration he’d have been fired a long time ago. He's a leader. He's a, he's leader of a paedophile cult. He gave documents to the Australian Charities and Not-for-Profit Commission that he serves the global head of the cult, i.e. the outer head of the Order. And, you know, Oz Rocker here, he's seen my group, pinned post number nine, he knows that we've got the leader of this cult on camera admitting to a doctrine of drinking human blood and orgies with children. And if you go to Age Newspaper, “Couple jailed for contempt in vilification case”. Police will come directly to your house and say, you have broken a law that doesn't exist in the State of New South Wales. A tribunal in a different state that, under the Australian Constitution, has no right to send us here to come and get you, has sent us to come here and get you. You don't have a right to a lawyer, you don't have a right to the hearing. The Victorian Human Rights and… Human Rights Commission, VEOHRC on Twitter, who's doing the prosecution, offers one day training courses for a thousand bucks on how to comply with the Victorian Human Rights and Responsibilities Act, which section 25D says ‘you have a right to appear in a courtroom before being sentenced’. But in their wisdom, the Victorian Human Rights Commission has said ‘you don't deserve human rights because you have disrespected the great beast 666 Aleister Crowley’, who wrote the book “Ballad to Passive Pederasty” about the joy of boy rape. Now…
David Graham — Yeah, right-o man, take it easy…
Luke McKee — Yeah, I know, this is all true, bro. This is mainstream news, Age Newspaper, “Couple jailed for contempt in vilification case”. The fucking, the fucking lawyer in the case is now the High Court Judge for Nauru, Ian Freckleton QC. And of course, he got a Queen's Birthday Honours for being such a good fucking Satanist. Okay? I’m sorry, mate…
@Crikey171 — Well, they all get it, mate. They all get it…
Luke McKee — But there’s no justice in the courts…
@Crikey171 — It’s so frustrating, bro. It’s frustrating…
Luke McKee — What is private prosecutions, which is what you guys are talking about, but under the legal system in Australia the cunts can just block you doing it. You know, the, um, the Crown Prosecutor’s office, which is corrupt as shit, that I know from fighting Satanists and stuff…
David Graham — Right-o, hey Mack. Hang on a minute…
Luke McKee — They’ll, they’ll shut you down.
David Graham — Nah, hang on, hang on. Just drop the C word. I'm making a coffee and I don't want to have to run across the boat again to pull you up again. So, anything else but drop the C word, all right? We got a lot of women here. I'm fucking old school and I don't dig it. Thanks, bro.
Rodney Swift heard Mr McKee state that the Plaintiff was the leader of a paedophile cult (Affidavit of Rodney Swift paragraph [17], CB443).
The First Defendant demonstrated his ability to control who spoke in the broadcast and on what topics. For example, after 0:29:25, he told Mr McKee to “drop the C word”. Otherwise, Mr McKee was told he was allowed to continue.
As to the endorsement by the Second Defendant and her control of the speakers, at the conclusion of Mr McKee’s speech at about 0:30:26, the Second Defendant thanked him and asked the next speaker to come in.
After 0:51:12, the First Defendant illustrated his control of the speakers. He said to Mr McKee, “Fucking hell. You either listen to me, man, or I'm just going to mute you, dude. All right. I just said two seconds ago, please don't jump in and just go on a rant, okay?” The First Defendant then muted Mr McKee, who, not appreciating that he had been muted, assumed he had technical difficulties.
The Plaintiff also relies on the First Defendant’s “self-conscious ability to control the broadcast and its speakers” at CB122. As “Guru”, he tells a participant, “That's why I'm controlling you, because you do get overexcited.”
The Second Defendant was a nominated co-host. The Plaintiff relies, as an example, on @Drunkleopardo at CB121 acknowledging both Defendants as hosts stating, “…thank you so much for even bringing me up, Guru and Cathryn”.
The First Broadcast had a total audience of about 2,100 persons, with 1,043 live listeners at its peak (Affidavit of Mr Swift paragraphs [50], [54], CB446, Exhibit C pp 5 and 8).
By this time, Mr McKee was known by the Defendants to espouse paranoid conspiracy theories and racist hatred. Before defaming the Plaintiff, he claimed that the Port Arthur massacre, the Lindt Café siege, and the Medibank data breach were all “false flags” (CB205), and that he had been “ahead of the mainstream news five years” on various conspiracy claims (CB203).
Mr McKee was introduced by the Second Defendant, stating at about 0:01:29, “Come on in Luke”.
The Second Broadcast is relevantly in the following terms [emphasis added]:
0:46:37
Luke McKee/@EndTheZB951Visa — The Ordo Templi Orientis global leader, David Scriven, is on camera in leaked training videos, if you see my recent Tweet, and he's saying that, yes, we drink blood in the Cakes of Light ritual — some OTO people will say menstrual blood, but still human blood — and we mandate two real children, not adult stand ins, to join the Gnostic, with a G, Catholic Mass. If you go to Vimeo.com and search Gnostic Catholic Mass, after turning off your adult filter, you'll see it looks like a black mass sex scene, okay? So they mandate children join orgies. So Vivian Legg and Dyson Devine from Coffs Harbour in New South Wales were, according to the High Court of Australia…
…
Luke McKee/@EndTheZB951Visa — This is true…
Luke McKee/@EndTheZB951Visa — This is true, your government is getting cops to kidnap people under blasphemy law for disrespecting satanic cults and it's in the bloody newspaper. Age newspaper, ‘Couple jailed for contempt in vilification case’. You want to see the headline? I'll give you… put the link in the Jumbotron now if it works.
0:47:54
David Graham/@StoptheRot7 — Anyway, it'll work. But Nocky, I don't mind you coming back in, but I'm controlling it, mate. And I want to get some info out, and then we've got some hands, mate. And I was about to come to you, all right? But, man, when you come back in, just cool it, right? You know I'm fair, I get to everyone, okay? But I want the info out, okay? At the moment, as much as we can get it out, then we'll ask some questions. Fuck me, come on, bro.
….
Luke McKee/@EndTheZB951Visa — … I just shared in the Jumbotron is sharing a link to a BuzzFeed story by a gay journalist called Lane Sainty talking about Katrina Bailey being sued by the OTO. So @cookerwatch has, you know, knowledge of everything I'm talking about.
…
0:49:18
@BecFreedom — OK, so I'm just going to propose something, just as a possibility, because I've actually heard from another cooker watcher, not @cookerwatch, that you have actually provided these stories to them in the past, and tried to push them to get the stories out there.
…
Luke McKee/@EndTheZB951Visa — Well, I’ll tell you about how I first came across @cookerwatch…
…
Luke McKee/@EndTheZB951Visa — I’ll tell you the facts…
@BecFreedom — Hold on. Hold on, I’m still talking. I'm still talking. Let me finish please. Just one sec.
David Graham/@StoptheRot7 — Yeah, hang on, Luke… @BecFreedom — Okay, so I’m just wondering, is there a possibility that maybe you're suspecting them of being people who they are not just because they wouldn't get your story out there for you?
Luke McKee/@EndTheZB951Visa — That… that is… that is…
@BecFreedom — Because, like I said, she has been on mainstream media and everything…
Luke McKee/@EndTheZB951Visa — … that is…
….
Luke McKee/@EndTheZB951Visa —
0:50:58 David Graham/@StoptheRot7 — Okay. All right, so it looks like, Bec, we've got a little bit more research to do into things. I mean, what we're trying to do here is gather all the information, you know what I mean? So, yeah, I don't know. I just know how these things work. There's a high echelon, there's a low echelon. And yeah, Cazza, what do you got to say on this, darl?
…
0:53:20
Luke McKee/@EndTheZB951Visa — Guys, what you want is you want to meet Katrina Bailey. There's backed up videos of her and stuff, to see her at rallies, on my Telegram group, which is deepstatepedohunters — ‘deep’ as in water, ‘state’ is in Australia has eight including New Zealand, ‘pedo’... you know what that stands for, and ‘hunters’, men with guns who run around and kill things, plural, on Telegram. But Katrina Bailey is trying to make a whole bunch of fake ones. She is next level insane. She’s writing… she got sued by the OTO, got a big headline about being fined $20,000, right, that @cookerwatch linked to. Then she goes back to court, gets it bumped down to a hundred bucks. And she… in the proceedings, she could have brought down an Australian Government ASIS asset, David Bottrill, who is in court records being… he's officially works for Immigration, but he's been… in court hearings from when he sued Legg and Devine… he double sued, double jeopardy prosecution against Legg and Devine. In the Canberra hearings, he was requested to the Australian embassy in Turkey. That's why he didn't show up. And he testified under oath, “we in the OTO don't drink blood and we don't do stuff with kids.” But then he went to the Australian Charities And Not-For-Profit Commission for… under the Ordo Templi Orientis and said, “the global head of our Order is called the Outer Head of the Order, OHO. And the Outer Head of the Order is Frater Operius X. And his other name is David Shriven. And I doxed him for real this time on my group. And here's the guy on camera saying, “we drink blood and we fiddle kids”.
0:55:09
So there we go. We've got the head of these… this guy… this top, high level Australian government official, leader of a child abuse cult, doing perjury. And Katrina Bailey could have brought him down, had all the evidence, but said to me, “all your research on the OTO” — that I put in the Jumbotron — “is bullshit”. So that's why I'm saying the OTO sues their own members. Because why do you do that? To corrupt the judiciary. What would happen if the… the New South Wales Police, or the Queensland Police, or especially the ACT Police, went to David Bottrill's own lodge and went to a Gnostic Catholic Mass that mandates two real children, not adult stand-ins, join in — as the global head of the cult has said in league training videos, in deepstatepedohunters pinned post 9? I'm not doing detraction here, we got the receipts. What would happen then? Oh, then all these judges that said that the OTO must be respected… what about Magistrate Harbinson in Victoria, who sent Vivian Legg and Dyson Devine directly to jail without appearing in a courtroom, contrary to section 25D of the Victorian Charter of Human Rights, the right to appear in court in person? What will happen to all these judges?
0:56:27
David Graham/@StoptheRot7 — All right, Luke, hang on. Let's just give you a… you're going well man, just give you a breath, Luke. So what I'm finding at the moment guys… and Nocky if you're sitting down there man, come back in. But, yeah, just have respect dude, you know what I'm like man. Listen, okay, so what we're finding out about the @cookerwatch thing here, and apart from @cookerwatch… Listen I just said to Mel, I don't even care if Luke's wrong on @cookerwatch. That doesn't worry me, okay? We need to do our own research on @cookerwatch, what Luke's given us is the information that he's found. Now, this is multilayered guys, all right? And are we just dealing with what we're finding is a lower echelon of @cookerwatch, and up here Luke may have the top echelon. I don't know if that's a correct statement or an incorrect statement, but what we've got here is more information to go looking, okay? And that's what we… that's what we've got to have.
…
Luke McKee/@EndTheZB951Visa — … We've got the forensic proven fact that @cookerwatch is… the account of @cookerwatch is closely associated with these two individuals based on forensic evidence.
David Graham/@StoptheRot7 — Which is something that we can now look at and use Luke. What am I, who's got a mic open? Franco, can you shut your mic mate, please?
….
David Graham/@StoptheRot7 — Thanks buddy, you got so much feedback there, man. Sorry, just turn it on when you want to come on and I'll get you in two secs, you got your hand up. Yeah, so I think this is a very, very positive discussion here guys, all right? Because what we're doing is we're finding other leads and other things. And when we go look and we'll find out. But, you know, if you saw my inbox and, you know, I'm going to start dropping into this purple pill in a minute. And I'll tell you what guys, you want to start and grab the stuff I'm putting in there. Because Luke sent me a whole lot of different stuff. He's been doing this for a little while and, you know, he may be, you know, I don't know, I… we all presume that @cookerwatch was female, but we've got new things to look at now, and I think this has been a great conversation. Come in, Caz…
0:59:00
@FrancoGTodisco — Oh yeah, sorry mate, I was just ranting without a mic. Yeah, I've got a couple of questions for Luke. Would it be fair to say, Luke, that the universities are very highly tied up in the involvement in trafficking here in Australia? But more importantly, like, there's a lot of universities that have out-of-township areas, like the likes of Lismore, right? Now they've got their own little satanic little workshops that they have outside of town. Is there a link? Do you feel personally there's a link between that?
Luke McKee/@EndTheZB951Visa — Now you're talking about the the video… Get this: Katrina Bailey went to Activist-News and lies…, he was the one that lined me up with Dan Walker to do his little video about New South, uh, Sydney University and the Ordo Templi Orientis, to bait me… to bait me to have a relationship with him, for a couple of years. And that also turned very, very toxic. So, and make of that what you will.
@FrancoGTodisco — Yeah… No, no, I can see there is definitely a link. And I have no doubt. I’ve…
1:00:01 Luke McKee/@EndTheZB951Visa — Yeah. If you want to see that video, you want to go… you want to change… go to the link on my profile, right, the… hojuruku on news, and then change the end of the URL to Activist-News, and you will see, uh, he did a story by himself about the OTO, to bait me over to come talk to him after I was talking to Katrina Bailey. And Katrina Bailey is… I don't know how well you guys know her, but she goes to every right-wing group and then starts in-fighting and doing the COINTELPRO jamming tactics. And she's best mates with @cookerwatch. She was sued by the OTO, right, but she's best mates with Rod Swift on Twitter. And Rod Swift is the witness for the Ordo Templi Orientis, whose David Bottrill and Tim Kerslake are now suing Sunol, John C. Sunol, John C, holds the World Guinness Book of Records for lawfare. He makes Alex… he puts Alex Jones to shame. He's had 209 complaints and he's only had 23 of them substantiated. I suggest everyone look at… I'll put a tweet from John Sunol now — my friends have told me to share, they're helping him out — in the Jumbotron. But yeah, John Sunol is being… is this poor brain-damaged Christian man. He's had a metal rod go into his head in a car accident. He shouldn’t be… he's got frontal lobe damage, right? He shouldn't be in the courtroom alone. And Magistrate Nancy Hennessy presided over 20 cases against him from Garry Burns, the first gay on Australian mainstream media when Kevin Rudd announced there would be gay marriage on Sunrise on 7. In fact, Guru, you've got the clip in your DMs, you can share that in the Jumbotron for us.
David Graham/@StoptheRot7 — Will do, I'll go looking now, okay.
1:01:58
@FrancoGTodisco — And one more question, if I may? So Luke, obviously, you know, what's your end motivation after this? You know, like, because you've got all this information, but what's your end motivation? I mean, because we're still stuck here fighting the fight, you know what I mean?
Luke McKee/@EndTheZB951Visa — My motivation is to hand it over, because… look, you guys are fighting the good fight in Australia, but I… I… I was crying into the wilderness for 15 years, since 2007, since I've been in exile, trying to expose the left. ….
David Graham/@StoptheRot7 – Okay. Luke, let me in for a minute, okay? If we had someone who’s saying they’re @cookerwatch, wanting to get into the room, would you like me to let them in or not?
Luke McKee/@EndTheZB951Visa — Well, this, this would be very interesting. But I'd like that @cookerwatch to explain their relationship with Rod Swift, the Greens candidate…
David Graham/@StoptheRot7 — Oh, I'm going to let them in. I'm going to let them in….
Luke McKee/@EndTheZB951Visa — … (inaudible)… about me.
David Graham/@StoptheRot7 — I'm gonna let them in and control the conversation. So you keep your cool. They'll keep their cool, hopefully, or I'll just dump them. But yeah, we're gonna let @cookerwatch into it. And yeah, let's see how this goes. … I don't know Luke. I'm just, yeah… I'm just gonna let the girls drop them in and we’ll go for it mate. We'll have a look. I don't let @cookerwatch in, I block them mate. Anything to do with the cookers, you know what I mean? I just… I'm not interested. I'm just really not interested. We got a war to fight. We got something to win, you know? I mean, I won't spend any time on these fuckers. But, they want to come in and talk to you, so if you're alright with it, yeah. Here we go.
…..
David Graham/@StoptheRot7 — I've sent you a few mics…
…
Unidentified speaker — Cath, take over for two secs.
1:08:56
Luke McKee/@EndTheZB951Visa — I've shared a sample of Rod Swift's voice in the Jumbotron right now for those who are interested…
David Graham/@StoptheRot7 — Beautiful. Thanks, Luke. Thanks man. No, this is good. This is what we need, open discussion. Where's @cookerwatch? Come on, you want to come in guys.
Unidentified speaker — We've got to unblock them.
David Graham/@StoptheRot7 — I've got to unblock them. Unidentified speaker — Yes, because they're in your profile. So mute. Caz, take over for a sec…
David Graham/@StoptheRot7 — Okay…
Cathryn Gibson/@CathrynAussie — Hi, yep. I'll have to unblock her or him as well. So I'll do that now.
………..
Cathryn Gibson/@CathrynAussie — You've got to talk, Caz.
…
Cathryn Gibson/@CathrynAussie — Just for a change, you have to talk. Anyway… …
…
Cathryn Gibson/@CathrynAussie — Yeah, and check with both your account and Guru’s as well. Just click unblock. I've unblocked her.
1:10:55
…
1:13:30
David Graham/@StoptheRot7 — Yeah, well there's a lot coming out at the moment**. So, but this is a time that things are going to come out. But anyway, yeah, we** look into everyone. We're not silly, you know what I mean? We all do our research and stuff. But… and that's what this is about guys, alright, gathering the information and…
Unidentified speaker — Alright, they’re in…
David Graham/@StoptheRot7 — … and doing the research. So, @cookerwatch is in. So…
Unidentified speaker — Just going to give them a mic…
David Graham/@StoptheRot7 — We're just going to give them a mic and then, yeah, I'll control it. And yeah, as I say, I can just hit the mute button guys.
Unidentified speaker — Bec, you can come in when you want.
1:14:00
David Graham/@StoptheRot7 — So anyway, @cookerwatch, you're, yeah.
Unidentified speaker — You've got a mic…
David Graham/@StoptheRot7 — You’ve got a mic. I've usually got your barred. Yeah, I'll give you the first question at Luke and then we'll get a response. And then, yeah, I'll control it. So, come in, @cookerwatch.
@cookerwatch — Hey, Guru.
David Graham/@StoptheRot7 — You're not my friend, don't be like that. Just ask Luke a question.
@cookerwatch — All right, I just wanted to say one thing. Tomorrow is the anniversary of your meltdown about 2GB and I'm gonna re-stream the whole thing tomorrow night, so tune in.
David Graham/@StoptheRot7 — Oh, you're just a fucking legend. Hurry up and ask your question or I'll fuck you off. It's simple.
…
1:20:18
…
@BecFreedom — I mean, all I wanted to say was, can we just keep it on topic? Like, @cookerwatch Guru done you a solid and unblocked you so you could come in here and defend yourself. Can we keep it on topic?
@cookerwatch — Yeah, sure.
@BecFreedom — Because there's no point going to Guru, when Guru has done the right thing and giving you a chance to come in here and defend yourself. And Luke's putting out some pretty fucked up full-on allegations, and that's why I messaged you as well, because I think everybody should have the right to defend themselves.
@cookerwatch — Yeah, I'm not… I’m not that worried about…
David Graham/@StoptheRot7 — Yeah, Bec, you run this Bec. You run it.
@cookerwatch — I'm not worried at all about what Luke McKee has to say about me. Luke McKee's got way bigger problems than me. And Luke McKee, he's just a… well, I guess you can tell from my tone of voice what I think about Luke McKee. I… He's just a fucking lot of noise, alright? He's a lot of noise…
…
1:32:37
Luke McKee/@EndTheZB951Visa — Mate, the devil… mate, the devil, Aleister Crowley, the great beast, 666, his fan club, the Ordo Templi Orientis is what I go after. And @cookerwatch reports me yesterday a couple of days ago for talking shit about his cult and their doctrine of child abuse. I mean, writings on the wall who’s the paedo is here?
1:42:05
David Graham/@StoptheRot7 — I'd say… I’d say you're pretty correct on that. Yeah, Canberra's just, you know, we're being run by the New World Order. We all know it. You know, they've all set all this up…
Luke McKee/@EndTheZB951Visa — Oh, you've dropped… you’ve dropped a big point for me on Canberra. …. With the Victorian Human Rights Commission — who, you know, give one day training courses on the Victorian Human Rights and Responsibilities Act 25D, ‘right to appear in court in person’ — have decided you don't deserve any rights because you disrespected Aleister Crowley. You've got judges like Brian Meagher in the ACT, former head of the ACT Bar Society, right? He's saying that if you disrespect Aleister Crowley — the great beast, 666, who wrote the poem Ballad to Passive Pederasty about the joy of boy sexual abuse — you have tangentially defamed a state-recognised religion of Satanism in Australia. And you… and it's not just Satanism. The Ordo Templi Orientis is the world's first gay rights organisation. At the highest level in the cult is Master of the Hermit Triad XI in gay anal sex magick — with a k. And by gay pride law in California, under Californian House Bill SB48, all American children are forced to go to lgbthistorymonth.com/harry-hay. And if Harry Hay goes to gay pride marches with a sign on his chest saying ‘NAMBLA walks with me’ — that is real, that actually happened. He's also on Usenet mailing list supporting NAMBLA back in the day; nambla.org has a page praising him — nambla.org/hayonmanboylove.html — It's text only guys, yeah, I have to warn you. But yeah, under… and guess what? He played… he played the organ at OTO Agape Lodge, right, with… and Jack Parsons founded that Lodge. He's… he’s a Zionist who gave American military secrets to Israel, if you see the FBI file.
1:45:54
And, yeah. So the… so the Canberra courts are saying: “no, no, no, the constitution doesn't apply to us because we're not a state, we're a territory”. And the only two judges which are picking on people outside the ACT is Brian Meagher SC and Robert Orr, and they're both linked to court cases involving the Ordo Templi Orientis satanic cult. And how can you say in case law? And then the OTO, right, they bring in this religious expert called Douglas Ezzy, from the University of Tasmania, and he writes books on witchcraft, right? And this is… this is the first video on my BitChute channel has the sources for this, you can see it all, me going through it with Professor Jim Fetzer. And, yeah, he's writing books with the OTO for profit, and he's saying the OTO’s never been involved in a child abuse case in all history. OTO Solar Lodge, boy in the box case in America, never happened. OTO… OTO case in England, in Kidwelly, Wales with Colin Batley, never happened. Nothing to see here. So the government's saying: hail satanic paedophile cults or go to jail without trial. That is your country. Age Newspaper, ‘Couple jailed for contempt in vilification case’, in the Jumbotron. It's real people, and that's the… And @cookerwatch’s mates, right, are right now… David Bottrill, leader of this cult, who has got a federal government position — I believe to be Intelligence, but officially it's Immigration with stations… positions overseas — according to court records...
1:46:27
David Graham/@StoptheRot7 — Okay, Luke, Luke, Luke, Luke. Let me get a some questions, mate. Come on, come on. We've been going for a while. Let me, yeah, let people ask questions. Righto, Crikey, come in, mate. You've been sitting there for a while. Sorry, bro. He's hard to stop when he's on a roll. He's got plenty of info.
181@Crikey171 — Yeah, no, no, no… Luke's giving his sermon, mate. And that's, that's not unusual for Luke. Um, yeah, the OTO, you're onto it. Uh, just the mere fact that we’re talking about it is gonna bring the spooks into this chat now. That'll be fun. Um, we'll change direction a bit if we can. It's probably…
Luke McKee/@EndTheZB951Visa — Let's change the direction to some funny stuff, I think. I've falsely been accused of being a Nazi.
…
Luke McKee/@EndTheZB951Visa — That's why I want to retire. I want other people to take my research and… and run with it, and...
David Graham/@StoptheRot7 — Okay, well, we will. But yeah, just give us a minute. Just give us a minute.
@DiligentWAussie — Yeah, thanks… thanks Luke, appreciate it mate. Look, ultimately we don't know the truth. The best thing that we can know is the right question to ask. And I think you've given us a lot of material to ask the right question to do research. ….
2:24:49
Cathryn Gibson/@CathrynAussie — (inaudible)
…
Unidentified speaker — Cathryn, you’re microphone’s open…
Cathryn Gibson/@CathrynAussie — (inaudible)… stop adding stupid words onto everything… so you don’t lose it… (inaudible)
David Graham/@StoptheRot7 — Cathryn. Cathryn…
Unidentified speaker — Cathryn, you’re mic’s open…
@DiligentWAussie — Yeah, so… yeah. I think… it might be Cathryn who was trying to mention it anyway, but it might have been her. But yeah, yeah. David
Graham/@StoptheRot7 — Cathryn, you there?
Cathryn Gibson/@CathrynAussie — Sorry, dude, for that…
…
2:27:23
David Graham/@StoptheRot7 — Okay, all right, you've got it Luke. Go for a roll until a hand comes up, buddy.
Luke McKee/@EndTheZB951Visa — … So that was a chilling… that was his chilling defeat and it's made every single government person who's meant to serve us afraid of the gay lobby, and the people behind the gay lobby, the world's first gay rights organisation — the Masonic, Satanic, Ordo Templi Orientis — which really is the world's first gay rights organisation if you look up what Master of the Hermit Triad XI° is, the highest level in their cult, which is gay anal sex magic rituals. So, there you go. That's his… that’s his epic defeat, and that upsets me, and you can't go higher than the High Court.
But his epic victory was Burns, Gaynor and Corbett, and that proved Vivienne Legg and Dyson Devine were kidnapped under law, right, for being… making true comments about the Ordo Templi Orientis that the global head of the cult admits in leaked training videos on one of the tweets in the Jumbotron here, right? Now I contacted the Victorian Ombudsman, right? I said, “hey, your Victorian Police went to New South Wales and affected a kidnapping”, okay? And Nicole Smolich there wrote back to me and said, “we're not taking your complaint because the kidnapping didn't happen in Victoria. When they were taken across state borders into Victoria and put into a Victorian jail without trial, Victorian jails are not in Victoria, therefore we can't take your complaint”. Nicole Smolich at the Australian… at the… at the Victorian Ombudsman, s-c-r-e-w-y-o-u, Jewess. Thank you.
2:30:00
David Graham/@StoptheRot7 — Thanks, Luke. See, it doesn't take long to, you know, come around to Guru's way of thinking. Makes it all run really smooth**, man. Look, Luke, you’ve got brilliant information, mate. You're… you’re… obviously got a… a Rain Man sort of brain for this stuff, mate. And that’s what…**
Luke McKee/@EndTheZB951Visa — It’s called.. it's called having an associative memory, okay? But my curse is that if I don't say something, and I don't have a sheet of paper with me to write it down, which I don't now because I'm outside giving the missus some space, I lose hold of my thread. So that's… that’s why… that’s why I'm, you know, guilty of interrupting and being a bit of a prick myself. Sorry about that.
David Graham/@StoptheRot7 — All good, mate. It’s been a very interesting chat.
@RickLamsted — (inaudible)
David Graham/@StoptheRot7 — A very, very interesting chat. …
…
2:50:00
Luke McKee/@EndTheZB951Visa — Oh my God. I'm North Wollongong swimming champion…
…
David Graham/@StoptheRot7 — Luke, hang on. Luke, hang on. Koko… ladies first. I think you got cut off, Koko, didn’t you?... Koko?... Where have you gone, Mel?
Unidentified speaker — I'm here…
David Graham/@StoptheRot7 — Okay. You're not a co-host.
Unidentified speaker — I think she's feeding her dog.
David Graham/@StoptheRot7 — Okay. Yeah, she might be feeding her dog.
Cathryn Gibson/@CathrynAussie — Koko… come in, Koko.
Unidentified speaker — Cathryn, you're back.
David Graham/@StoptheRot7 — Cathryn, you're back. You had your mic on, mate. We were listening to you. You were going off.
Unidentified speaker — You were going off…
David Graham/@StoptheRot7 — (laughs).. You’ve gotta love spaces with an open mic, mate.
Cathryn Gibson/@CathrynAussie — Oh, dear…
David Graham/@StoptheRot7 — It's so funny…
2:51:05
…
2:51:42
David Graham/@StoptheRot7 — Thanks, Smurfette. And… all right, so Koko, are you there? Have you finished feeding the dogs, or what? Maybe not. All right. So Luke, we're gonna have to get… you've obviously got a shitload more information, and I'm going to start sharing all your stuff out on Twitter, mate, and banging it out for you, all right? I haven't had a chance to do that…
Luke McKee/@EndTheZB951Visa — Yeah, all the DMs... all the DMs I sent you, you can retweet the whole lot. My account… I think you've followed me, or you're trying to talk to me. I can't reply for at least 12 hours, and after that I'm gonna be DMs only for a couple of weeks. Just to buy some time, you know, for the… you know @cookerwatch onslaught. (laughs)
David Graham/@StoptheRot7 — Yep… Luke
McKee/@EndTheZB951Visa — But I would… I would love to go… @cookerwatch banned me from their Twitch. They're too scared to talk to me. They know I dropped the hate fact… the hate facts, the truths … So, I've got credibility. I'm… been ahead of the mainstream news five years, a couple of times already, you know? I know a broken clock is only… only uh, you know, right twice a day, but holy… holy shit. I did this, guys. I’ve got the receipts.
David Graham/@StoptheRot7 — Okay. All right. You got the receipts?
Unidentified speaker — (inaudible)… Guru has the… (inaudible)…
Luke McKee/@EndTheZB951Visa — (inaudible)…
David Graham/@StoptheRot7 — Hang on… hang on… hang on… Luke, please. Fucking manners, son! I'm older than you man, much older. Right, Shari, come on in please.
…
3:03:07
David Graham/@StoptheRot7 — It’s been a great Space. Luke, we’ll be in touch, mate. We’ll talk again. Koko, you want to say anything before… or finish us up, Koko? You got your mic back?
@kokokell19 — Oh, just goodnight and God bless my darlings. I love youse. Carry on what you’re doing, it’s smashing.
David Graham/@StoptheRot7 — All right, thanks, sweet. All right, see you, guys. Luke, brilliant stuff, mate. That was a great… a lot of info. People are going to have to go back through this and pick the guts out of it they want and go looking. Everything's up in the Jumbotron up there, guys, so get into it. Happy digging. And, yeah…
Unidentified speaker — Thank you, Cathryn.
David Graham/@StoptheRot7 — Thanks, everyone. Thanks, Cathryn. Thanks, everybody.
Unidentified speaker — Good night, Guru. Good night, Mel.
Cathryn Gibson/@CathrynAussie — Thank you. Good night, everyone.
The transcript of the broadcast clearly shows that Mr McKee telegraphed to the Defendants that he may again talk about the Plaintiff. He discussed, at length, OTO, Aleister Crowley, and “the Masonic, Satanic, Ordo Templi Orientis — which really is the world’s first gay rights organisation if you look up what Master of the Hermit Triad XI° is, the highest level in their cult, which is gay anal sex magic rituals” (CB194).
Mr McKee was described as the Second Broadcast’s special guest. The episode was titled “Guru n Crew… Whistle Blowing Folks... Don’t miss this…” (CB155).
Relevant to any “grapevine effect” relied on by the Plaintiff, the First Defendant encouraged listeners to “hit it, retweet it” and share widely (CB155). The Defendants thereby expose themselves to liability for any foreseeable republication by that person to others: Slipper v British Broadcasting Corporation [1991] 1 QB 283 at 300.2.
The First Defendant introduced Mr McKee, telling the audience that he had given him material that was “pretty hot” and that there were “a few things in it that we need to know” (CB155).
The Second Defendant, at approximately 0:06:00 stated, “Hi everyone, nice to see everyone here and I’m looking forward to this conversation tonight with Luke” (CB155).
The Second Defendant endorsed Mr McKee’s statements (whatever they might be) knowing the content of the First Broadcast, having assisted the First Defendant in it.
Mr McKee delivered, for more than two hours, defamatory statements about the Plaintiff (CB166-168) and, more generally about OTO (which Mr McKee says the Plaintiff is a leader of) (CB164, CB178, CB181-2, and CB194).
Mr Swift heard Mr McKee state that “Mr Bottrill is the leader of a child abuse cult, that Mr Bottrill is a perjurer, that Mr Bottrill is a member of a satanic cult, and that Mr Bottrill’s religious observance involves drinking blood and molesting children” (Affidavit of Mr Swift paragraph [31], CB444).
The Plaintiff relies on the fact that the First Defendant actively endorsed Mr McKee’s material during the Second Broadcast relying on the following matters:
At about 2:11:55, the First Defendant said, “Look, he’s got great information.”
Mr McKee states that “it’s all true”. The First Defendant responds, “I’m not saying it’s not. I check you out before I got you on here, mate.”
I find that the First Defendant endorsed the statements made by Mr McKee, defaming the Plaintiff. The First Defendant lent his credibility, as the main host of the broadcast and the “Guru”, suggesting to his audience that they should accept Mr McKee’s statements as being true.
I find that the First Defendant invited Mr McKee onto the broadcast as his guest, knowing that statements of this kind might be made.
The Plaintiff relies on the fact that at approximately 2:30:00, after hearing Mr McKee’s OTO conspiracy theories, the First Defendant stated, “Look, Luke, you’ve got brilliant information, mate. You’re… you’re… obviously got a… a Rain Man sort of brain for this stuff, mate” (CB194). At approximately 2:37:31, the First Defendant also stated, “Luke’s certainly got a talent… talent for dropping it out, that’s for sure” (CB197). At approximately 2:51:42, the First Defendant announced, “We’re gonna have to get… you’ve obviously got a shitload more information, and I’m going to start sharing all your stuff out on Twitter, mate, and banging it out for you” (CB203). The First Defendant also said, “It’s been a great Space. Luke, we’ll be in touch, mate” and “Luke, brilliant stuff, mate. That was great… a lot of info…” (CB206).
I find that the Second Defendant acted as a co-host during the Second Broadcast. The Plaintiff relies on the First Defendant asking her to “take over for a sec”. Most relevant however, is the fact that the Second Defendant had the ability to, and did, exercise that right to block and unblock callers (CB170).
The Second Broadcast had a total audience of about 3,300 persons, with 1,389 live listeners at its peak (Affidavit of Mr Swift paragraphs [51], [55], CB446 and Exhibit C pp 6 and 11).
The Third Broadcast was titled “Guru n Crew. GO TIME. All Welcome. Getting Organised. WE WIN” (CB207).
Mr McKee was brought on as a speaker and, at the First Defendant’s invitation, discussed OTO and Freemasonry at length (CB210-214).
Relevantly, the Third broadcast was in the following terms [emphasis added]:
(Song: Sounds Of Then, Ganggajang)
0:04:06
David Graham/@StoptheRot7 — Well, is this really okay? Is this really Australia?
Cathryn Gibson/@CathrynAussie — Guru!
David Graham/@StoptheRot7 — Is this really Australia? Yeah, come on Cathryn.
Cathryn Gibson/@CathrynAussie — Oh, Ganggajang...
David Graham/@StoptheRot7 — How are you?
Cathryn Gibson/@CathrynAussie — Oh, Ganggajang. Yeah, I'm good mate. Umm, oh, good Guru. Yeah, Ganggajang. Isn't that the most brilliant song? Sends shivers down my spine. Love it...
David Graham/@StoptheRot7 — The question is, is this Australia? It's not really, is it?
Cathryn Gibson/@CathrynAussie — This is Australia...
David Graham/@StoptheRot7 — It's not anymore...
Cathryn Gibson/@CathrynAussie — No, not at all, nope...
0:04:32
Luke McKee/@EndTheZB951Visa — Zionist occupied enemy territory, and that's what I think.
David Graham/@StoptheRot7 — Okay, hang on Luke...
Luke McKee/@EndTheZB951Visa — Sorry...
David Graham/@StoptheRot7 — Hang on Luke. Don't do that please...
Cathryn Gibson/@CathrynAussie — (laughs)...
David Graham/@StoptheRot7 — Right-o, yeah, so yeah, that was the question guys, all right? Is this Australia? Because I don't really think it is. Not the Australia I remembered, that's for sure. Not the Australia I'm missing. That's for definite.
0:04:54
David Graham/@StoptheRot7 — But, um, yeah... let's, ah... Luke, I don't want you taking over everything, mate. Come on in, have a chat, all right? But it's topic-related tonight, right? Not Luke-related, okay? You can throw something in if you want, but it's not all about you, bloke. All right, we're in here to have a chat, man. I'll just tell you straight, right? I love you in here. I love your info. But yeah, I don't want you overtaking every chat, bloke.
Luke McKee/@EndTheZB951Visa — Roger, wilco.
David Graham/@StoptheRot7 — Okay, brother.
Luke McKee/@EndTheZB951Visa — Okay.
David Graham/@StoptheRot7 — Thank you very much. I'm just laying the rules down, you know me. We have a fucking even playing field, but the fucking rules are put out before we go to fucking bat. All right. So bring it in, Caz! Get... get the mics going darling, and, yeah, let's see what they wanna talk about.
David Graham/@StoptheRot7 — Okay. And I spoke to you guys today, Lea. Can... you wanna relay that bit of information just to what, umm, we heard today about how our opposition is in panic mode, we think, down in Cathryn's area?
0:08:21
@LiaMaitlan48986 — Well, this Masonic Lodge is shutting down. I viewed one today that was shut down and turned into a childcare centre. Travellers we meet every day. Some intel of Tasmania, they've just come back from Tasmania tour... all around Tasmania. There are signs depicting 'Mason wanted'. That's not the correct wording, what they related, but that's the gist of it. They're advertising for Masons. I don't know whether they're...
…
@LiaMaitlan48986 — But they're... they're getting desperate for members.
Cathryn Gibson/@CathrynAussie — Can... can I just butt in there? Thanks Guru and Lea.
David Graham/@StoptheRot7 — Yep. Certainly.
Cathryn Gibson/@CathrynAussie — Yeah, my girlfriend's been, on our page of course, has been traveling down to the Northwest Coast from... I'm up in the north so just west of... west of me. And she's been noticing, like, she's just going on camping trips and things with her hubby. And, near through every town on the way down, at least 4 or 5 of them, they have got these signs up: 'Masons wanted'. She's been meaning to stop and take photos, but they are so rampant all along that Northwest Coast. So that's really, really interesting. Anyway, keep going, please.
…
@LiaMaitlan48986 — Well, we can only surmise. The word's out. They're being fingered. They're running, they're hiding. They're being captured. I don't know. But they are in short supply.
Cathryn Gibson/@CathrynAussie — Absolutely, yeah, no, it's a real... it's a real worry. When I heard Bosi saying about how bad Tasmania was, I mean, I wasn't really privy to all of this sort of information. I had no idea how bad it was down here. And...
0:10:32
David Graham/@StoptheRot7 — All right, dear co-host, why is it a worry?
Cathryn Gibson/@CathrynAussie — Oh, what's that, sorry? Why is it a worry?
David Graham/@StoptheRot7 — Why is... why is it a worry to you? Yeah, yeah. Why is it a worry to you?
Cathryn Gibson/@CathrynAussie — Oh... David Graham/@StoptheRot7 — To me, it's the... on the opposite side of worry. I'm laughing my head off, mate. They've got no... you know, we know that they can't run their lodge meetings because they don't have the 13 standings in most lodge meetings, unless they're big lodges, to actually do their little ritual shit. So, yeah, I'm looking at it from the other side of the coin...
Cathryn Gibson/@CathrynAussie — Abs...
David Graham/@StoptheRot7 — They're in trouble, man. They're in trouble.
Cathryn Gibson/@CathrynAussie — Yeah, abs... absolutely. When I said it was a worry, I mean, I'd never noticed it...
David Graham/@StoptheRot7 — Yep...
Cathryn Gibson/@CathrynAussie — So now it's fantastic that it's come to the fore, that we're seeing the fact that they are trying to recruit everyone. Umm, I'm just waiting for a few of them to burn down, or a bit of graffiti going around. So, yes, it is... it... it is a celebration actually. But I... I was not so aware, even though I found out, oh, that my uncle was a Mason and all that... like, it's quite... it's so prevalent here. But I was never aware of it going back, you know, in the last year or two, what... what it actually meant until Bosi came along and educated us all.
0:11:47
@S_Meeks12_7 — Okay, so you had relatives that were stonemasons, or, you know, in that clique?
Cathryn Gibson/@CathrynAussie — What? Stone...
@S_Meeks12_7 — Why didn't you get invited? Because it was more male-dominated.
@BepicQueensland — Absolutely...
David Graham/@StoptheRot7 — Look, we know that the whole country is absolutely full of them, guys……
….
0:13:02
David Graham/@StoptheRot7 — Okay. Luke...
Cathryn Gibson/@CathrynAussie — Guru, um, that...
David Graham/@StoptheRot7 — Yep, go.
Cathryn Gibson/@CathrynAussie — ... That's interesting. About four or five years ago, I was asked along to a... like a little morning tea or coffee catch up. I don't know whether you know, but I run a... Heads Up Launceston, Eating Out in Launceston, for the last 12 years...
David Graham/@StoptheRot7 — Yep...
Cathryn Gibson/@CathrynAussie — ... and I do all the restaurants and cafes and directories, and all the councils and all the chambers of commerce and all these supposedly important people used to say: "oh, come along, have coffee and meet with us" and all of this, and I'd never understood what it was all about. And about five years ago, this fellow asked me along for this morning tea and I'm thinking, "oh yeah". And he wanted to mentor me. And I thought, "what the fuck?" — excuse the expression — what... what... what... why is he out of the blue? And he came from Devenport, like an hour's drive away. And he's a full-on bloody Mason! And I just sort of looked up at this the other day. So they've been trying... they were trying to reel me into their little networks, umm, and because I've always been so independent and just my own person and my... I do my own thing, and they used to try and reel me in. And at that stage, obviously, I did not know anything. And now everything's been... is lightened up for me and I'm just thinking: "far out, I did not know", and I can see it all now. And, yeah, so it's just friggin' gobsmacked me...
David Graham/@StoptheRot7 — Yep...
Cathryn Gibson/@CathrynAussie — But anyway, keep talking...
0:14:38
David Graham/@StoptheRot7 — ... and... and that's... yeah, that's what we're up against. So, I'll bring Lea back in a minute. But Luke, let's bring you in for a minute. Because what I wanna do, Luke, is ask you, with all the research that you've done on these different, you know, topics and that, that you've given us the stuff to, I wanna quickly ask, have you found, which you have in a couple of things, but is there a big Mason, you know, resemblance within all the research that you've done, Luke?
Luke McKee/@EndTheZB951Visa — Okay, I'll give you answers and specifics. I'll just give you one example. When I broke into Ordo Templi Orientis Coph Nia Lodge in Eugene, Oregon, whose website says, "ask permission and let us know in advance if you're bringing children to the Gnostic Catholic Mass ritual", we talked about last time. All of them were high level Masons. As I said before, I've got the photos on my group. You want to go to see them? All those photos of me going in there, and see what I saw? You got my Telegram group, which I don't... I barely post in. I can't post in it directly. … Like I said, my owner account's been nuked there. I've got to rely on my old mods to post for me. Which is good. That's what saved the group from being deleted when my phone got hacked. Ah, deepstatepedohunters**,** pinned post number nine. You can see the receipts. They're all Masons. And this cult that they're... the New South Wales and Victorian Police does a... High Court confirmed acts of kidnapping for. As I said, Burns, Gaynor and Corbett...
David Graham/@StoptheRot7 — Yep...
Luke McKee/@EndTheZB951Visa — Interstate... yeah, remember we rehashed it all... Interstate, interstate, you know, lack jurisdiction. Cops say, "we don't care about the courts". I... it's almost... the cops don't care about the politics themselves because they have the guns. There was an... I can give you another funny example, if you want, or do you want me just to stay on top...?
0:16:28
David Graham/@StoptheRot7 — Nah, just hold it there, Luke, thanks. All right. So, yeah, again that's just confirmation, guys. You know, Luke's done a lot of research, okay? And... into different areas, and again, this Mason factor. Now, the fact that they're having to, and they were doing this before, right? They started advertising on the radio. So, you know, that tells us if you wanna put the pieces together, right? That, you know, what... what Riccardo and myself have sort of been saying about these guys, are in a little bit of trouble and we've heard, you know, from them... or not me personally, but, you know, people have heard from them. Ric's one of them, you know, because he's fronted a few up. I was in Gunnedah with him when he fronted that guy up, but I speared the guy off to Ric, actually. The guy come and come at me, and I just looked at the sise of him and looked over at Bosi and went, I know who's a better competition here. I'm sending you straight to Bosi. Hey, fwoomp, get over there. And that's how it happened. You know what I mean? Because he was fucking too big for me to handle and he had a horrible look on his face and... but anyway, Bosi sorted him out But again, this just shows you the depth. And I'm sorry guys, but I'm gonna tell you again, you're gonna see a fair few of these guys. And let's be really nice. All right? But let's see how many we can pick out when we're down there at Canberra because I can tell you that there's gonna be a lot of them down there, guys. If it was organised, where... the farmers that I know, that we know, let's say in our little group, they... they weren't privy to this thing. They didn't know about it. So again, I'm gonna tell you selected people going down there. Okay? And, yeah. We're on our best behaviour, once again, to go down there and try and utilise this. We are in a war. The enemy of my enemy is my friend. That is what I'm working off for... they're sick, guys.
Luke McKee/@EndTheZB951Visa — One thing I wanted to say before is that the Ordo Templi Orientis themselves identifies as a Masonic organisation, or used to, on their websites even in Australia. When I start asking questions... Hey, the Masons in Australia say they're not a religion, they're a fraternity, okay? Then why the hell is the OTO who claims to be a Masonic organisation, i.e a fraternity, gaoling people with religious blasphemy vilification laws And... it doesn't make sense. So I ask these questions, then then the OTO delete all their Mason stuff off their own website reacting to my activism. It's hilarious.
0:18:46
David Graham/@StoptheRot7 — Yeah**. Well, we know nothing makes sense, Luke. The whole world's upside down, mate.** It's exactly how it is. Crikey, come on in mate. I'm just trying to bring up another co-host Cathryn, but I'm having trouble. I can't even see her Cathryn. If you can see her, can you bring her in to co-host?
Cathryn Gibson/@CathrynAussie — Yep, who are we looking for, sorry?
David Graham/@StoptheRot7 — Ah, my other half...
Cathryn Gibson/@CathrynAussie — Oh, Warrior! Okay, cool, I'll...
David Graham/@StoptheRot7 — I can't find her on the screen. Um, Duty First, I want you to ask for a mic. Crikey, you're in now. And... Dan, ask for a mic, I'm trying to get one to you brother, and then you... yeah... Mel Graham — Dan... Dan said if he wants a mic he'll ask for one...
David Graham/@StoptheRot7 — Oh, is that what he said? Okay, all right then, no problem. All right, Crikey, floor's yours, brother.
@Crikey171 — No worries. I'm, ah, I've been talking to my father about this, when I was very young, you know, about Freemasons and religion and that. And he told me how it worked in Australia. And he said, in Australia... now this would have been back in the early '80s when he told me this, he said, "in Australia, to get ahead, you either need to be aligned with the Freemasons or with the Catholic Church. There's no in-betweens. If you're not part of those two, you're just going to... you'll be living on the streets of Richmond." And that's where he came from, right? He showed initiative and was recruited by the Freemasons, right? Now, he had the offer of the Catholics as well. But he came from a Protestant background, and that's where they recruit out of. They recruit out of the Church of England. Now they've won the war in respect to you're either one team or the other. You don't see much of the Catholic Church doing shit anymore, do you?
0:20:28
David Graham/@StoptheRot7 — And they all come through Rotary...
@Crikey171 — So what's the other... what's the other team? What's the other team that's involved. I mean, put two and two together. I... I don't wanna speculate too hard, but we can see what's really going on here, hey?
Cathryn Gibson/@CathrynAussie — Yeah. And it's Rotary. It's the chamber of commerce. It's our council. Our our whole council here in Launceston...
@Crikey171 — Yep, and with the OTO, Luke... the OTO, they infiltrated the Masons back in the 1800s, and that's what made them turn into that fucking nefarious rubbish that they are now. Before that, they were a half-decent society to a degree, and they did a lot of good shit for, I mean, look at the modern world, mate. They had a lot to do with creating that modern world. So, since they've been infiltrated by these demonic fucking Aleister Crowley and idiot, buddy, Luciferian things, right? It's just like, you know, it's... we... we...
Luke McKee/@EndTheZB951Visa — The OTO was nothing until Aleister Crowley (inaudible)...
@Crikey171 — ... say no more, fucking secret handshake bullshit. You know what I'm saying? And it's... it's... it's all bullshit, mate. And the only way it's gonna stop is if we just don't give it any power.
Luke McKee/@EndTheZB951Visa — Actually, um, there was a court case between the Catholic Church and the OTO ...
0:21:37
David Graham/@StoptheRot7 — Hey, hey... Luke, give me a minute. Luke, give me a minute. Cathryn, I'm gonna drop you out, pull the trick last week. I'm gonna drop you off as to as listener. I'm gonna bring Mel in as co-host and then bring you back in as co-host. Remember that work the other night?
Cathryn Gibson/@CathrynAussie — Absolutely. Yep. Go for it.
David Graham/@StoptheRot7 — Okay. I'm gonna do that, while... Luke, you got the floor. Who's after Luke? Put your hand up. Lea, do you wanna come back in and talk more about the Masons? Because you're gonna have to stop Luke, and Lea is the type of person that can stop him midstream when she has to. You all right with that, Lea, while I do some organising in the background?
@Crikey171 — I'll... I'll sort out Luke. It's all right. I just wanna hear what he had to say about that.
David Graham/@StoptheRot7 — Yeah, no, no, go for it. We just gotta**, you know, he's a great guy, man. I love the dude. I get over... But yeah. We just** gotta**...**
@Crikey171 — Nah, I don't mind Luke. He's just a bit of... he's a bit full on for most.
0:22:20
David Graham/@StoptheRot7 — Yeah, yeah. And he's... look, most people can't take in that amount of information, Crikey. That's all I'm saying to Luke. You know, great information, but a little bit at a time. You got... we've got plenty of time here, guys, in the war, what we're doing. And we've got plenty of time to get it out. But, yeah, you have got an in-depth amount of information, Luke, and people need it bit-by-bit.
@Crikey171 — His Telegram page is pretty interesting**...**
David Graham/@StoptheRot7 — Yep...
@Crikey171 — If you ever get a chance to have a good look at it.
David Graham/@StoptheRot7 — Yep, right-o. Okay, you guys have got the floor for a minute while I try and do this in the background, right?
Luke McKee/@EndTheZB951Visa — Let's have a happy story of a victory of a court case being shut down. Now, I'd just like to say, some people out, I used to work with someone called Catholic... who was very Catholic, Bernard Gaynor. And I don't despise all Catholic people. The Pope, and the Vatican, and him wearing all the seal of the OTO and some photos and stuff. That guy, you know, the gay... the gaypride-loving Pope and the carbon taxes Pope and the COVID jab Pope, Pope whatever the crap he's pushing, that guy is next level evil, okay? But there are some good Catholics, okay? So this is the... I'm going to talk about the case of how the OTO was involved in a court case in Tasmania. A cross-dressing man, I will not say, I will not call him a transgender because men cannot transform into woman, that's alchemy and that's satanic. So, a cross-dressing man, Martin Delaney, sued the Archdiocese of Hobart because they did the crime of supporting the Bible's position on same-sex marriage. Leviticus 20:13 would be the most extreme version of that. And they put out a pamphlet and gave it to their... some of their school kids.
0:24:05
So this law, this... this court case, the first step it was going to go to was to the Tasmanian Anti-Discrimination Board. And the head of the Tasmanian Anti-Discrimination Board was Robin Banks. But Robin Banks used to work for the Public Interest Law Clearing House, also known as @PIACnews on Twitter. And their boss Peter Cashman on the YouTube channel says, "we do experimental law. We sued 2UE and 2GB for eight years with Gary Burns." And I have a whole story about Gary Burns and 2GB because I got dirt on them, but we'll come back to that later. I'll save that for the end of the show, the grand finale, to get pay... payback for, you know who's, you know, anniversary special. Anyway, so, Martin...
David Graham/@StoptheRot7 — (inaudible)...
Luke McKee/@EndTheZB951Visa — (laughs)... I have to say it. Yeah, like if they censor this Space, they won't hear the gem that we have on 2GB. Anyway, um,... because they bought 2UE. Anyway, so Martin Delaney, suing the Catholic... Hobart Catholic Archdiocese, right? And the judge in the case is Robin Banks. She worked for the Public Interest Law Clearing House, when they did pro bono work, she was the head of pro bono. Oh, no, no... no, she was the head of the Public Interest Law Clearing House. And she approved a pro bono work to assist the Ordo Templi Orientis with taxpayers' money.
0:25:34
Yeah, this is a cult that's getting free lawyers with taxpayers' money that has a doctrine of child abuse, Gnostic Catholic Mass with two real kids... and, ah... what is it called? Cakes of Light, also known as #spiritcooking, from the Podesta WikiLeaks, and Hillary Clinton, also known as 'Killary'. So we've got that, we've got this, right. So I'm contacting the lawyers for the Catholic Church, right, and saying, "hey, guys"... and the... all the Archdiocese... and say, "hey, guys, this is pretty suss. You've got... you'll go... you can't get a fair trial in the... from the ADNSW. If you get... if you go up to a higher court, you just have to say that the AntiDiscrimination Board of Tasmania is a... is a... is a patsy of the State. And the woman they hired to put in charge has a history of fighting for satanic child abuse cults. Just jump... you threatened to dump all this, you know, the doctrine of the OTO, and the apprehended bias of the applicant in the case, which will be the Anti-Discrimination Board if they approve the complaint..."
David Graham/@StoptheRot7 — Okay, roll up and out. Come on...
Luke McKee/@EndTheZB951Visa — "... it will be thrown out". And they drop the whole case. Kaboom. It disappeared.
David Graham/@StoptheRot7 — This is what happens, guys. Yep. True. Yeah. Thanks, Luke. That's exactly right, mate. This is exactly what happens. They drop the case. They hold the cases in the courts. They don't put them through. You know, we got heaps sitting in the Supreme Court on the docks, you know what I mean? But no one's gonna touch them. They're just gonna sit on the docks. They're not gonna get into that ship.
0:27:00
Luke McKee/@EndTheZB951Visa — John Sunol referred to Supreme Court to get the newspaper headline for the gays four years ago, nothing happened yet. Nothing happened yet. Living in legal limbo, facing persecution for five years. It's not going to happen, is it? Nup.
David Graham/@StoptheRot7 — So what do we, uhh... yeah. So I think we maybe need to get a strategy out there against the Freemasons. If they're going to go putting... I don't know where the signage is, whether... is it on the side of the road, and that, Cathryn? Or is this signage professional signage that's paid for on the side of a street by us taxpayers? Do you know what signage it is?
Cathryn Gibson/@CathrynAussie — Yeah, no, look, it's on all the highways on the way down to the Northwest Coast. Just big signs. I think they're just private signs. I'll ask my friend, yeah, exactly... yes...
David Graham/@StoptheRot7 — We'd probably need... yeah, need to, you know, maybe, I don't know, maybe they're a bit old now, they might need replacing with "Stop the Rot" signs. Sack the Lot. I don't know, I'm just thinking out loud, you know.
Cathryn Gibson/@CathrynAussie — Yeah, well, that could be on the cards, I mean...
David Graham/@StoptheRot7 — You know, we use that... you know, we've got to use the enemy for our advantage, guys, you know? So... and obviously it can't be graffiti if someone's just going to whack something up on council land, you know, or just on, you know, whatever they want to call it, Crown Land, I suppose. You know, they call it anything they want to get away with whatever they want, but actually it's our land. And if they put a sign on our land, well, then that sign's really our sign. This is how it should be.
@aluminatisecret — Oh, do you know what? Like, this is what I thought...
Cathryn Gibson/@CathrynAussie — Yeah, but it's so prevalent. I mean, she was just shocked the amount of signs. It's like they're advertising everywhere. It's like they're advertising everywhere. And now that I look at things, particularly here, like our council is totally infiltrated. All the business people in Launceston that I know through my work, yeah, they're... they're all Masons and stuff. I... I just didn't realise the extent...
@Crikey171 - You... you can't. In Australia, you can't move forward unless you join...
0:29:02
David Graham/@StoptheRot7 — It is a little bit like that. Start... start using hands, guys, in... in the... in the speakers here, if you do wanna speak, after we get this little conversation finished. I've seen Lea and Arty coming in, so let's just use our hands guys and we'll go for it. And if Lea wants to say anything, she's got the first... first say to come back in the conversation on this Masons, in case she might have a bit more info for us.
Unidentified speaker — I can't get Gideon up...
David Graham/@StoptheRot7 — Okay. We can't get Gideon up. We're trying to get you up, Gideon. Request me a mic, will you mate?
Mel Graham — (inaudible)... can you see Gideon?
David Graham/@StoptheRot7 — Okay, go back to it guys. Who had it? Who... where... where were we?
@aluminatisecret — Hey guys, I put my hand up. The talk...
David Graham/@StoptheRot7 — Cool...
@aluminatisecret — ... the talk about graffiti is like the councils, they tell you, like, this is the crazy thing about it. They're like they try and wipe out the graffiti, but then they commission these artists and they put the graffiti on the fucking sides of the buildings. And it's the most fucking crazy bullshit you've ever seen in your life. It's like people tagging up, throwing up, and it's fucking bullshit. And they're paying people for that, but I'm like, I can graffiti on your shit, and they fucking put me in gaol for that shit. They put me in gaol for graphic...
Luke McKee/@EndTheZB951Visa — Hey, Alluminati... You are so right...
@aluminatisecret — ... it's fucking fucked. It's fucked. The councils are fucked. They're fucking destroying my life and then they're...
@S_Meeks12_7 — Oh my god...
Luke McKee/@EndTheZB951Visa — Brother, calm down. Brother, calm down. I'm gonna share in the Jumbotron. He's... he's passionate because he's being persecuted, but those same councils he's angry at are supporting gay activists, draw child-height rainbow angel dick wings — #dickwings. So, it's for... it's... it's for... and those dick wings, the, feathers aren't feathers. They're... they're sex toys, dildos. So they want kids to... they... they want kids to stand next to the wall at the child-height, angel wings made out of dildos, and say "look, I'm taking a photo of my little kid with sex toys".
0:31:00
I mean, I'll... I'll share the video of it in... in the Space of someone, you know, being outraged at it. But that's okay. This guy... this guy does... tries to do some art... art on... and on the wall, not... not... not bad graffiti, or over the crap, over... over the top of the politically-correct graffiti or whatever he did, and... and they throw the book at him. That's Australia. That... that's what we call equality. Or that's what they call equality. I don't know.
David Graham/@StoptheRot7 — Yep. Okay, so I just had to mute Aluminati and I don't know how to unmute him. I don't know if Cathryn can do that. But yeah, bloke, just settle your shit down, man.
…
David Graham/@StoptheRot7 — If you can unmute your own mic, man, you're fucking gone. You're gone, bloke. If you can unmute your own mic and do that to me, you are out of fucking here. Goodbye. All right, next...
0:32:10
Cathryn Gibson/@CathrynAussie — Melissa, you've got your hand up. Good evening. Yeah. If anyone else, if you wanna speak, please put up your hands, and we can...
0:35:25
Cathryn Gibson/@CathrynAussie — Excellent. Come in, Aussie Chick. Good evening.
@Roneybo1967 — Hi, good evening. G'day Guru, Cathryn and crew. How is everyone? …
Cathryn Gibson/@CathrynAussie — You know what? ... (inaudible)...
…
Luke McKee/@EndTheZB951Visa — (inaudible)...
David Graham/@StoptheRot7 — No, Luke, don't... Luke...
Luke McKee/@EndTheZB951Visa — (inaudible)...
David Graham/@StoptheRot7 — Luke, don't. Please. Hang on, let me control my Space, all right? One at a time, otherwise... the other people can't hear, man, when you're talking over the top and that. So, yeah, Aussie, we... you know, that's what we should be doing, you know, infiltrating them. So, do we... do we actually do that on the show? And we put a call out and we tell everyone to, you know, maybe email in and join up, you know, and... and then try and get in? Okay, let's start discussing this, right-o? We've gotta have a plan. So let's have a think about it....
…
0:40:20
Luke McKee/@EndTheZB951Visa — Making mistakes...
David Graham/@StoptheRot7 — Yeah...
Luke McKee/@EndTheZB951Visa — Yeah. I've... I've lost... look, Doctor Reina Michaelson appears to be a honeypot... her online identity, okay? I've tried to reach out to her. I used to know ... know her back to do with it. She's the one who wrote the dossier on the Ordo Templi Orientis that made the prediction that Channel 10 studios were used to produce child porn before Jeremy Kewley, who worked there on Blue Heelers, was arrested. And the lawyers for the OTO who ran the Victorian Human Rights Commission... I remember her name, Kristen... a Kristen Hilton. In the same year she represented the OTO, Channel 10 invited her to go back on Blue Heelers. A... this is a Lawyer of the Year. What do you think the Lawyer of the Year in Victoria is going back on... Blue Heelers right after she... she takes a case which was... had defamatory content against Channel 10 and child sexual abuse, and then one... one of their Channel 10 child sexual abuse actors, that was her co-star on Blue Heelers...
David Graham/@StoptheRot7 — Yep...
Luke McKee/@EndTheZB951Visa — ... Jeremy Kewley goes down for child porn. What are the all the coincidence... coincidences of that coming true? It's incredible.
David Graham/@StoptheRot7 — Well, we're... Yep, and all those particular coincidences are coming true, Luke, and... and thanks for the info for people to go... you know, some people are in... little... this is what we want, Luke. Little rabbit holes for them. No, hang on, Luke. Little rabbit holes for people to go and, you know, might interest someone. "Oh wow, you know? I used to watch that program." Righto, Crikey, come on in, bro...
…
0:56:35
…
David Graham/@StoptheRot7 — Who have we got? Freddy's having trouble. Mel Graham —Where's Cathryn? Gone off co-host...
David Graham/@StoptheRot7 — Uh... Mel Graham — Can't do anything...
David Graham/@StoptheRot7 — Okay... Mel Graham — Cathryn there?
David Graham/@StoptheRot7 — I don't know. Yeah, I think Cathryn's there…
…
David Graham/@StoptheRot7 — … "Yeah, I think Cathryn's there. Hang on..."
…
David Graham/@StoptheRot7 — Right, we're on loop, guys. Who have we got? Cathryn, you gotta go through man, we're getting smashed.
…
David Graham/@StoptheRot7 — Cathryn's gone, they took her out.
…
0:57:57 Luke McKee/@EndTheZB951Visa — I want to be able to give you something to give you legal insurance against the OTO on this broadcast, a strategy to protect you, a gem. Is that okay?
David Graham/@StoptheRot7 — Yeah, they're hammering me, Luke, at the moment. Mate, take the floor if you want it, okay, for a minute. Who's in there? Crikey, pull him up when you need to, mate. I'm just trying to work out who's smashing this thing in the background, all right?
Luke McKee/@EndTheZB951Visa — Yeah, so the Ordo Templi Orientis, ah, has... is what the Church of Scientology, which was founded by an associate of the Ordo Templi Orientis, L. Ron Hubbard.
Unidentified speaker — ... and his spare gun...
Luke McKee/@EndTheZB951Visa — ... oh, what ...
David Graham/@StoptheRot7 — Yeah, sorry, that's Freddy. Freddy was having trouble connecting from the United States, Luke. So just if he comes in, just talk to him, mate. I'm just doing something.
@freddywelborn — Yeah, I'm here...
Mel Graham — Cathryn's back...
@freddywelborn — Can you hear me?
David Graham/@StoptheRot7 — Yeah, we got you, Freddy. You're just getting whacked a little bit, mate. That's all.
@freddywelborn — Yeah, well, it's probably the subject matter, even though a lot of people know it's coming, brother.
Mel Graham — It's Cathryn's doing that. Get rid of Cathryn...
@freddywelborn — Two presidents. Just remember that, two presidents.
David Graham/@StoptheRot7 — Freddy, take it away for a minute, mate. I'm just trying to get some trolls out of here and get order back into what I'm doing in the Space. So, you've got the floor there, Freddy, go.
0:59:20
Luke McKee/@EndTheZB951Visa — Ah, Freddy's saying 'connecting', so I'll just keep holding the fort until I see him come back.
David Graham/@StoptheRot7 — Okay, yeah, let... let Freddy back in when he comes in, Luke, but yeah, hold it, will you, mate? I'm just trying to sort some shit out.
Luke McKee/@EndTheZB951Visa — I'm just a speaker. I... I don't need to have any mod privileges. But, you know, anyway. So how we can have protection against the Ordo Templi Orientis is they have no rights to do the religious vilification lawfare they're doing for two reasons. Reason number one is the Tax Office before... that used to do the job of charities before the Gillard created... Rainbow Labor Gillard created the Australian Charities and Not-forProfit Commission, said that if a religious institution has a doctrine that is against the law, such as adults doing sexual acts in front of, at least, and/or with children, and/or consuming human blood — I don't know what... what the people who, you know, approved all the COVID vaccine. I don't know how good it's, you know, for people to be acting like vampires and consuming blood like they admit they do on camera. David Scriven, the global head of the cult, who David Bottrill, on his submission to the Australian... if you look, if you go to the Australian acnc.gov.au, right, and you put in Ordo Templi Orientis, you can see there... the oldest document they put up there, which is their charter document, and look for the Outer Head of the Order or OHO... O.H.O. So David Bottrill, you know, who sues everyone, says, "we don't have these abuse rituals" and sends people to gaol for it. But his own documents say the global head is the guy that I've got on camera that does say that these abuse rituals are mandated. So he's done for perjury, and this guy is an intelligence officer. Anyway, so you've got that angle to... which you talked about last time... to shut them down. But there's another hilarious way to shut them down.
1:01:17
Unidentified speaker — What way is that?
Luke McKee/@EndTheZB951Visa — You can only sue people for religious vilification if you believe in the divine or divinity or some type of religious matter, right? And the OTO was in court, right? And, in the ACT, when loveforlife.com.au was sued, and they were bringing up what's in their most holy of holy books, which is called the Book of the Law by Aleister Crowley. And in it, it says, "sacrifice a child after a cattle**". So they... they brought this so-called religious expert, Douglas Ezzy in, from the University of Tasmania, who writes books with the Ordo Templi Orientis for profit. And their defence to get them off this allegation, or this charge...**
David Graham/@StoptheRot7 — Right-o, yep. Nah, you're right. I'm back up. No, but, yeah, go on... go round it up now, Luke, and then...
1:02:14
Luke McKee/@EndTheZB951Visa — Round it up now? It's a... it's a hilarious story, right? So he... he comes in, and he goes, "No, no, when we talk about child sacrifice, we're not talking about killing children, okay. We're talking about, magical masturbation." Now, magical masturbation, right? (laughs) Because... because Aleister Crowley once wrote a paper making fun of a Catholic priest that said, "you know, if you masturbate, you're, you know, killing a child or something or sacrificing a child", or some... some argument like that. But here's the thing the... the Ordo Templi Orientis is claiming that they have... you know how Mohammed, he went into the cave, okay, and... and that's how... that's... that's why the Quran is believed to be divine? Okay, well, the OTO... the OTO has a similar story with Alistair Crowley in the Book of the Law. He went to an Egypt... an Egypt... in Egypt, allegedly, and saw exhibit 666, and, you know, and then... then... then his, his missus or... no. He was... he was... he... they this is what they believe. It's batshit crazy, and you can make fun of it...
1:03:21
David Graham/@StoptheRot7 — Okay, come on. Come on, round it up and let's... yeah...
Luke McKee/@EndTheZB951Visa — Aleister Crowley was, possessed by a transdimensional space demon called Aiwass**, okay? And that... that... that's who... that's the real author of The Book of the** Law, he just wrote it down. So.****.. so their defence in court undermines their claim to divinity, okay? (laughs) They're saying, you know, "oh, no, on this other time when he wasn't possessed, he wrote this". You know what I mean? So that... that's the two angles you can use to say that these people are fair game for... for, rebuking, and they can't sue you for religious vilification. Once you've got those two gems from my Telegram group, these Satanic pricks will never go into the courtroom with you. And if they do, God help them.
David Graham/@StoptheRot7 — Okay, all right...
Luke McKee/@EndTheZB951Visa — They did... they did... they did with @cookerwatch's friend, and she didn't use this research in her own defence. That's why... that's how I know the OTO sue their own. And if you want to see all the evidence of this and stop me ranting in five seconds, I have a Bitchute channel...
David Graham/@StoptheRot7 — Yeah, yeah...
Luke McKee/@EndTheZB951Visa — Want to plug that? My username means Aussie Luke in Korean. It's a really... it's a really Nazi-named, as @cookerwatch said, to have an Asian, you know, username. Bit... bitchute.com/hojuruku, and then go to the oldest video, and you've got all the proof of that. So, yeah, the... the... these @cookerwatch sons of bitches, who were threatening to rape my kids again only yesterday, they've got nothing. Nothing. They can do nothing to you.
David Graham/@StoptheRot7 — Sorry to hear that again. All right, buddy. Thanks, man. Look into it, guys. And Freddy, you back up, are you, mate? Thank you. Oh, hang on, we got JoJo's got her hand up. Come in, JoJo, and you might've wanna ask Freddy something or whatever, but yeah. JoJo. Unidentified speaker — Hey, shut your mic, Luke...
1:05:10
…
1:09:56
Luke McKee/@EndTheZB951Visa — I have a question for MajFreddy. Is that okay?
David Graham/@StoptheRot7 — Yeah...
Luke McKee/@EndTheZB951Visa — So what you're saying, Major... MajFreddy, what you're saying is... here's a real life example: David Bottrill, that I complain about, head of the OTO and also works for the Australian intelligence services, proven. He's actually playing the long game and he's getting the docs of all the, you know, the homosexuals and what have you, that are affiliated with the Ordo Templi Orientis and @cookerwatch to prepare for the light... Night of the Long Knives to take them all out. That's a really good fantasy to believe in, but the actual names of all the people in the Australian Ordo Templi Orientis child abuse cult got leaked to gaiaguys.net — the two people who were sent to gaol without trial, Vivienne Legg and Dyson Devine. And archive.org blocked their website to keep those names secret, which is incredible.

Cathryn Gibson/@CathrynAussie — Go ahead, Koko...
@kokokell192 — I'm glad you can hear me. …

David Graham/@StoptheRot7 — Okay. Crikey, Mel... Mel's got the hands, I think. So, right now, let's go. Cathryn's had her hand up. She's a co-host. She goes first, Crikey.
Mel Graham — No, no, Crikey had his hand up first. Sorry, Cathryn, but Crikey had his hand up first.
David Graham/@StoptheRot7 — Oh!
Mel Graham — Go, Crikey...
Cathryn Gibson/@CathrynAussie — Actually, no, I didn't have my hand up. It just went on by itself, so keep going...
…
1:46:20
David Graham/@StoptheRot7 — Too true. Nah, thanks for the update, Donny. Well, we'll move on. We've got a few hands. Who was watching the hands? Cathryn? I hope so. Koko was next, Mel's just telling me. But yeah, thank you, Donny.
…
Mel Graham — Go, Cathryn...
David Graham/@StoptheRot7 — ... be... yeah, Cathryn, come in. Be prepared for a month. You know what I mean? So, yeah, that's what we're looking at, guys. But, yeah...
@NewbornSupport — I'm... (inaudible)... at times. So, yeah. Okay, bye.
David Graham/@StoptheRot7 — Okay, thank you. Okay. Next hand. Sorry, guys, I got cars going off. Who was it?

1:48:49 Luke McKee/@EndTheZB951Visa — Yeah. ….
Luke McKee/@EndTheZB951Visa — It's at themoneymasters.com, thank you, themoneymasters.com
David Graham/@StoptheRot7 — Okay, all right. And I'm not really talking financials, guys. I never do. I don't wanna discuss Bitcoin. I don't wanna discuss financials. I don't wanna discuss dinar, okay? I'm not into it.
Mel Graham — First seek the Kingdom of God...
1:50:30
David Graham/@StoptheRot7 — Yeah. First seek the Kingdom of God... Luke McKee/@EndTheZB951Visa — That's a documentary, that's not...
David Graham/@StoptheRot7 — Hey, no, Luke...
Luke McKee/@EndTheZB951Visa — Sorry, I didn't plug... I didn't plug a company...

David Graham/@StoptheRot7 — Yep, okay, thanks. First ye seek the Kingdom of God...
Cathryn Gibson/@CathrynAussie — And then all else will come. Go, Koko...
…
…
@LeaFaulknerAus — (laughs)... But, um, and I've forgot what else... oh that's right, I was going to just ask Koko, if she'd kindly answer me, because I haven't turned the television on the mainstream news. I have these smart TVs, but they're always black. Um, ah, that... I know of... um, Prince Charles and Kate were in hospital, but who were the other three that you spoke of? 'Cause you said there was five. That would be great. Thank you.
David Graham/@StoptheRot7 — No worries. If Koko could come back up, if she's not already in... Mel Graham — Yeah, she's just... (inaudible)...
David Graham/@StoptheRot7 — She'll come up and sort it out. Mel Graham — Oh, I can't... I can't accept her request. Cathryn, can you?
2:13:57
David Graham/@StoptheRot7 — Give it a go. We've got Frank in the room, Mister Tedesco.
Mel Graham — Luke... Luke's done well. He's...

Luke McKee/@EndTheZB951Visa — Yep, I'll be... I'll be quick. If you ever want to go...
David Graham/@StoptheRot7 — Thank you, Luke...
Luke McKee/@EndTheZB951Visa — If you ever want to go pro... like... I've never gone pro and asked for shekels or donations ever in 15 years. …

Luke McKee/@EndTheZB951Visa — Jitsi. Jitsi, yeah. It's a computer conferencing system. You can have your own Zoom thing like what we're doing now with video. But it... it's best not to have video with the clowns trying to dox everyone. And also about those... about those @cookerwatch clowns, and what I was saying before, you know, proven forensically they've associated with @rodcub... Rod... @rodcub, Rod Swift, is going... is going into the ACT Tribunal as a witness for David Bottrill and Tim Kerslake. Okay? That's the OTO, right? Remember I said before about the OTO and their doctrine of magical masturbation. What do we call people who do masturbation? We call them wankers. So @cookerwatch's mate is a... who threatens my kids, is a case law-confirmed wanker. You can take that to the bank. You know? So... (laughs).
David Graham/@StoptheRot7 — Thanks, buddy.
Luke McKee/@EndTheZB951Visa — Cheers.

Cathryn Gibson/@CathrynAussie — (inaudible)... Franco, yep, keep going. Um, Guru hopefully will come back in...

Mel Graham — Luke...
2:23:28
David Graham/@StoptheRot7 — Right, back to Luke. You've been very well behaved, Luke.
Mel Graham — (inaudible)... very well behaved.
David Graham/@StoptheRot7 — Yep.

David Graham/@StoptheRot7 —…. So that's... that's my last words for tonight. Thanks, guys.
David Graham/@StoptheRot7 — Thanks, Gideon. Cathryn?

Unidentified speaker — Good night, everyone.
Cathryn Gibson/@CathrynAussie — Bye.
3:35:15 (audio ends)
Again, Mr McKee telegraphed that he might speak about the Plaintiff. He claimed OTO “is a cult that’s getting free lawyers with taxpayers’ money that has a doctrine of child abuse, Gnostic Catholic Mass with two real kids” (CB214).
Indeed, the First Defendant encouraged such statements. He supported and encouraged Mr McKee’s diligence, said that he had done “a lot of research” and stated, “again, that’s just confirmation, guys” (CB211), in circumstances where both Defendants were aware of the likely topic, given their presence during the First and Second Broadcasts.
Mr McKee’s defamatory statements concerning the Plaintiff commence at about 1:00:00 into the Third Broadcast (CB224-5). The Plaintiff is referred to at 1:10:00 (CB227) and is named again at about 2:14:00 (CB244).
Mr Swift heard Mr McKee state that “Mr Bottrill is the head of the OTO, and that the OTO is a child abuse cult with a doctrine of child abuse” (Affidavit of Mr Swift paragraph [41], CB445).
The First Defendant encouraged Mr McKee to speak on the topic. He said to Mr McKee “I love you in here. I love your info” (CB207).
After the Second Defendant described an encounter with a “full-on bloody Mason”, the First Defendant invited Mr McKee to speak (CB210). Mr McKee then discussed OTO, concluding “they’re all Masons” (CB211).
The Plaintiff relies on the First Defendant’s further endorsement of Mr McKee’s allegations. He stated, “…Luke, thanks. All right, again that’s just confirmation, guys. You know, Luke’s done a lot of research, okay?”
At 0:22:20 (CB213), the First Defendant again endorsed Mr McKee’s information.
The Plaintiff also relies on the discussion of OTO’s doctrine of ritual child abuse (CB214); and which it is submitted, properly in my view, was the First Defendant’s call to arms on the issue (CB245).
The First Defendant demonstrated his control of the Third Broadcast by muting a speaker at 0:31:00 (CB215).
The Third Broadcast had a total audience of about 1,900 persons, with 864 live listeners at its peak (Affidavit of Rodney Swift paragraphs [52], [56], CB446, Exhibit C pp 7 and 14).
The Plaintiff became aware of the First Broadcast on 24 January 2024, when Mr Swift told him it was taking place. He joined the broadcast at its conclusion. As it had been recorded, he listened to the recording.
Mr Swift also told the Plaintiff that the Second Broadcast was occurring and that Mr McKee was talking. The Plaintiff was relatively new to X and did not know how to work out if it was underway or how to “follow” it. He logged on and listened to it live as it evolved. He heard himself mentioned by name by Mr McKee. At the conclusion of the broadcast, he replayed it to cover any spaces he had missed. He tried to transcribe the narrative.
The Plaintiff was told either by Mr Swift or someone else (he was not sure) that the Third Broadcast was occurring.
The Plaintiff tried to find out who the parties were that were running the space, as he had not encountered the First Defendant before and he wanted to know who was “platforming” Mr McKee.
The Plaintiff’s evidence of harm done by the broadcasts was straight forward. There was no attempt by him to embellish or exaggerate the impact of them on him and, likely, his reputation.
Listening to the First Broadcast, the Plaintiff was deeply concerned, particularly where it was broadcast primarily to an Australian audience.
The content of the Second Broadcast impacted him more greatly, by reason of the volume of it directed to him and the nature of the language. He said that being called a paedophile is not something he could get used to and it was offensive to him. He totally rejected the imputations levelled at him.
The Plaintiff said that when the matters were broadcast, he felt a sense apprehension. He became extremely concerned. He considered it threatening to his personal safety. He was concerned about the level of violent rhetoric in the broadcast. He worried that he lived on a corner block in Canberra and became very “perimeter based”. He observed and made reports to police of cars parked near his house. He had an increased level of apprehension for his personal safety and the safety of his daughter.
The Plaintiff instructed his solicitors to send concerns notices. The notices demanded: that the recorded sessions be removed; an apology; and a “nominal” amount for hurt and suffering, following the standard pro forma concerns notice. He received no response from either Defendant. The First Defendant has admitted that he received it and disregarded it. This is a matter that can aggravated damages to be awarded against the First Defendant.
No apology was forthcoming from either Defendant.
The Plaintiff commenced proceedings in September 2024.
The Plaintiff said that he did not know if the broadcasts remain on X, or whether they are accessible by the public or a normal viewer. He does not know if they remain accessible by the hosts. He believes they were removed from the public site sometime in October 2024, about a month after he filed the Statement of Claim. I find that the First Defendant had an ability to control whether the broadcasts remained on X.
The First Defendant attempted by his cross-examination of the Plaintiff to elicit evidence from the Plaintiff that the imputations were, to some extent at least, true. The questions were designed to elicit evidence that:
the Plaintiff was at some stage the treasurer of the Australian chapter of OTO;
OTO was a religious organisation;
OTO was taken over by Aleister Crowley who changed the belief structure;
OTO was a satanic religion (a matter the Plaintiff rejected);
Crowley was “satanic” and formed a secret society that worshipped the devil, and Crowley has admitted in three books (the Book of Law, the Book of Lies, and Magik in Theory and Practice) that he did this; and
OTO is a satanic “cult”, a secret society who keep all their doings secret.
The First Defendant sought to undermine the Plaintiff’s damages case by his questions, suggesting to the Plaintiff that:
it was inconsistent that he would become the Treasurer of OTO if he was so worried about what people might think;
it was inconsistent that he was not worried about being in OTO but was worried about accusations that he was a paedophile;
he had overstated his concern about his personal safety;
there is no serious harm and no hurt to his feelings;
prior to the broadcasts, he had already been already involved in “public controversy”, a reference to the Plaintiff’s prosecution of various defamation and religious vilification claims in the past;
the 3000 or so listeners was a “very low percentage” in a worldwide population of 7 billion, and where X had a billion subscribers; and
Mr Swift may get a financial benefit by garnering information so that the Plaintiff can sue.
The Plaintiff was asked to deny involvement by him or OTO in paedophilia, satanic rituals, or drinking babies’ blood. It was suggested that he was not seriously harmed by the broadcasts, in being called a paedophile and an abuser of children, matters the Plaintiff rejected.
The First Defendant invited the Plaintiff to identify anyone that believed the allegations. The Plaintiff pointed to his impression that the members of the First Defendant’s audience accepted uncritically Mr Mckee’s comments and later one said, “let’s go get them”. I also concluded that it was likely that at least parts of the audience, and most critically encouraged by the First Defendant as the main host, believed the allegations. The First Defendant referred to Mr McKee’s speech in positive terms and to the fact of Mr McKee’s research into the subject.
The First Defendant’s suggestion, that the Plaintiff had not lost any employment or suffered financial loss (suggesting that this would be a necessary indicium of harm), was irrelevant and unnecessary given that the Plaintiff was known to be a retired public servant.
The First Defendant asked if the Plaintiff had been “socially excluded” due to the broadcasts. He said that he had recently entered into a relationship with a woman and she was reluctant to reveal his full name to her daughter because if you search the internet, it is associated with paedophilia and this litigation. The Plaintiff accepted, in a way that reflected well on him, that the references to previous defamation cases in which he won on unsubstantiated claims were also on the internet and that she did not get that information from the broadcasts.
The First Defendant challenged the Plaintiff as to the appropriateness of his response to the broadcasts and asked why the Plaintiff did not reach out to him on the live broadcast given that it was “an open discussion for people to talk about what they want”. The suggestion that this would have been a reasonable and appropriate response, given the Defendants’ control of the speakers and the ridicule they had subjected the Plaintiff to, is in my view untenable. My overall impression of the broadcasts is that serious contrary voices (such as @Cookerwatch) are either ridiculed or excluded.
The Plaintiff responded that he had sent concerns notices and did not form the impression that the First Defendant would be receptive to the suggested approach, given the First Defendant’s refusal to respond to the notice. That is a reasonable response in my view, and one provided for by the Act.
The First Defendant, at that time, engaged in submissions and said, “I get plenty of people coming at me, as soon as I was hit with a service of notice, a statement of claim, I immediately reacted, took down the broadcast and got in touch with the lawyers.” This has provided a clear admission by the First Defendant that he deliberately did not respond to the concerns notice and that he had complete control over the publication of the broadcasts on X.
The First Defendant challenged the Plaintiff’s evidence that he genuinely felt threatened by the broadcasts, given he was “not threatened by other spaces [on X] (2000) of them”. The Plaintiff responded that he had not viewed or heard them.
The First Defendant challenged the Plaintiff’s choice of party to sue and asked why he had not tried to sue X for the publication of what the First Defendant admitted were “the lies”. The Plaintiff responded that this was because the First Defendant was a publisher on X, a matter I have accepted.
The First Defendant suggested by the questions, that the concerns notice suggesting a payment of $25K for pain and suffering was somehow inappropriate. The Plaintiff said that it was derived in consultation on advice from his solicitor. Given the assessment of damages that I have made, it was, in my view, a very generous offer on the part of the Plaintiff.
The First Defendant, despite earlier findings by Gibson DCJ to the contrary (and which the First Defendant still does not accept), challenged the Plaintiff as to whether he had been seriously harmed. The First Defendant asserted that the Plaintiff had not lost employment, and asked, perhaps rhetorically, “how was this serious?” The Plaintiff responded, “you broadcast that I was a paedophile to 3000 plus people, it seriously damaged my reputation, they hear you label me as a ‘pedo’ and an abuser of children, I don’t know where they are, where they live” describing them, as his “psychopathic followers”. The Plaintiff said he was concerned that one might be psychopathic and might take actions. He relied on the general tenor of the broadcast; that it was to hunt down and kill paedophiles. The First Defendant said that he thought that this was funny.
Finally, the First Defendant sought to undermine the Plaintiff’s decision not to sue Mr McKee, who lives in Vietnam, beyond the jurisdiction of the Court. He suggested again that the Plaintiff did not in fact feel threatened by the statements.
The content and manner of the First Defendant’s cross-examination of the Plaintiff has caused further harm and has resulted in an award of aggravated damages.
The First Defendant called Geoffrey McKee, Mr McKee’s father. He did so, I had anticipated, to prove some part of the First Defendant’s defence. The First Defendant had informed the Court that Mr McKee Snr had seen things first-hand that showed the Plaintiff to be the leader of OTO.
Somewhat surprisingly therefore, Mr McKee Snr gave evidence of the complete unreliability of the allegations that were made by his son against the Plaintiff. He described his son’s characteristics and attributes. His son had been diagnosed when he was young with behavioural issues. At the age of 12, he had been referred to a psychologist who was unable to make a formal diagnosis, although by the time he was 13, Aspergers Syndrome was suspected.
Mr McKee Snr said that his son “ran away from Australia in 2007 and never returned”.
Mr McKee Snr described his son’s obsession with OTO and the Plaintiff, and other conspiracy theories regarding the police. He said that those obsessions became extreme at times. For example in China in 2010, he conducted a one-man protest outside the Australian embassy in Beijing, making a speech and burning his passport.
Mr McKee Snr said that the obsession with the Plaintiff occurred, in part, in about 2014, when he learned that someone had been sued by him. He said that his son called the Plaintiff at his place of work and the Plaintiff wrote to his employer in Hanoi and got his son sacked. According to Mr McKee Snr, the Plaintiff complained that he had to put up with a homophobic tirade.
Whilst there is no evidence that this ever occurred, according to Mr McKee Snr, since that time, his son had been obsessed with fighting OTO and the Plaintiff, and putting out “knowledge”. His father said that he was in 2000 spaces “spruiking the same narrative” and that he is fixated.
The First Defendant attempted to prove that the imputations were substantially true by inviting Mr McKee Snr to give evidence of the research that he, Mr McKee Snr, had done and his “findings”, and to give his opinion as to what those findings show. Mr McKee Snr referred to his presence in ACAT hearings involving the Plaintiff and references to Wikipedia, and said that in respect of OTO, that “nobody knows” about it because it is secret. He said, “We don’t even know what Bottrill knows about. I don’t know what level he is at. We don’t know why he is a member.”
It was clear that Mr McKee Snr could give no reliable or admissible evidence going to the First Defendant’s contextual truth defence.
Notwithstanding, the First Defendant continued to elicit evidence from Mr McKee Snr as to a number of irrelevant, at times arguably defamatory, and largely unrelated topics; seeing the Plaintiff ’s “unusual” behaviour in ACAT, the fact that the Plaintiff was an “agent of the Attorney-General in the Australian Capital Territory (‘ACT’)”, that he did not know why the Plaintiff had gone to New South Wales (‘NSW’) when he could have done “it” (which I assumed was a reference to commencing proceedings) in the ACT; that (despite his stated lack of knowledge on the topic) he believed that the Plaintiff was going into the court system in NSW to create greater damages or stronger legal precedent; that the Plaintiff was shutting down free speech on X; and that after this case, nobody can express their opinion because of government people (a clear reference to the Plaintiff) and because of spies like Mr Swift listening and going off. The decision by the First Defendant to lead this evidence has also contributed to an award of aggravated damages.
The Second Defendant also did not give evidence. She did however tender some documents.
Those documents included:
a video screen recording of the recorded space of the Third Broadcast from 0:17:32 in three parts; and
a bundle of screenshots from the recorded space from the Third Broadcast with various times stamps before and after the matter of complaint.
They were tendered with a view to establishing that she was not in a co-host position throughout the broadcast.
It is necessary to set out the attempts I took to ensure that the First Defendant had an opportunity to make submissions about the case and to record his submissions. It is also necessary to set it out in detail, as the Plaintiff relies on the way the First Defendant conducted himself during the trial in his claim for aggravated damages.
The First Defendant commenced by asserting that he was not physically or mentally well or capable. He described what he said was Gibson DCJ’s biased opinion on the serious harm issue, referring to her Honour’s uncle’s purported connection with the Freemasons.
He described the proceedings as an “absolute farce”, and criticised Mr Swift for “perusing everything he can with notifications on to find anyone that mentions Mr Bottrill's name… so that he can hunt innocent fucking victims down and prosecute them.”
I attempted to assist the First Defendant by taking him to his filed defence. He complained he had no defence on as he lost his lawyers and had been dealing with his illness.
His remark about his defence was, “Defence to what? Defence to being innocent. Defence to doing nothing.”
I directed him to his Amended Defence at CB89, in which he pleads that the meanings in the broadcasts were substantially true. He did not allow me to inform him without interruption of the substance of his pleading before he remarked,
“No, I didn’t say that at all. I did not say that at all. I reject that. Not once did I mention Mr Bottrill's name. Not once, okay? I got sent a hundred and something messages from McKee and never shared one of them. What bloody malice or insights have I got in Mr Bottrill?”
I attempted to calm the First Defendant as he had become quite agitated. He declined saying, “No, I've had this shit.”
I explained to the First Defendant that I was trying to just make sure that he had every opportunity to tell me what he wanted to tell me about his defence. He responded,
“There's no, no jury [a reference to Gibson DCJ’s earlier ruling]. No jury, no representation, no nothing. What opportunity? This is a farce. For someone that’s two innocent people and to fricking make money from the court system. What a farce.”
“How many times have these allegations been put on the internet against Mr Bottrill? Okay? How many times, your Honour?”
“Yes, yes, the Courts are really trying to help two innocent people here, isn't it?”
”I never said that… Show me once. Show me once in any of these transcripts where I mentioned Mr Bottrill's name and to do with this shit here? Never.”
“He was the treasurer of a secret society… There's no wonder he's been sleeping with fucking dogs. You don’t lay, you don’t want fleas, you don’t lay with dogs, it's pretty simple.”
I asked the First Defendant if he wished to point to any evidence in the trial where it has been proven that Mr Bottrill is the leader of an organisation whose members have a sexual interest in children. He responded, “I never said it. No, there isn't”.
The First Defendant then invited me to “go and find Luke McKee”, who made the comments.
When I asked whether any of the things asserted about the Plaintiff were substantially true, the First Defendant admitted, “I wouldn’t have a clue. I've got no interest in Mr Bottrill.”
I took the First Defendant to CB93, which pleads in his Amended Defence that the issues that were in the broadcasts relating to Mr McKee were matters of public interest. The First Defendant submitted,
“How much more public interest do you want with the Epstein files out and all the crap with all the police officers, court people, they're going down for paedophilia and sexual crimes against kids. How much more public interest do you want?...
Because they're what, our kids, our kids aren’t part of public interest, come on your Honour…
How many cops, how many judges, how many people go down, right? With this sexual shit that is involved in our society, and you say it's not public interest?… Corrupt…
Look at the Epstein files alone...
Our children are our future. Our children are the thing that this is about, okay? And it is public interest.”
“Because it was all about Cookerwatch, your Honour. That Luke McKee coming in and mentioning Bottrill was meant to be, or as I presumed, part of the Cookerwatch story, all right? I have no interest in Mr Bottrill. All these broadcasts were about Cookerwatch, nothing more…
Okay, the Epstein files, the amount of police officers that have been taken down lately. The judiciary, which is involved, all right?”
“It was handled by a barrister and solicitor that your judiciary gave to me and then your judiciary let them fucking run all over me into saying, "Yeah, okay, don’t do it". You know, come on. Come on.”
“I think that everyone, all right, should be able to actually receive information that is out in the public circle and do their own research, okay? That’s what I believe, your Honour, okay?”
“How was I to know that Luke McKee had mental health issues? He came to us to tell us that he had information about Cookerwatch, okay? And then mixed Mr Bottrill and Mr Swift into the Cookerwatch scenario. So, I was there doing this public discussion about Cookerwatch, nothing to do with Mr Bottrill, okay? Mr McKee was not invited to the first broadcast, he just landed in there and turned up. I invited him to the second one to talk about Cookerwatch, and he wasn’t invited to the third one. He turned up and I ended up blocking him.”
“How have I got any idea what's going to be said on a live discussion, your Honour?”
“Would not have a clue, did not look at that, had no interest in Mr Bottrill, never looked at it again after the broadcast, okay? No interest whatsoever. No malice, no interest, onto the next thing.”
FIRST DEFENDANT: Your Honour, your Honour, may I ask a question?
HER HONOUR: You may ask, yes.
FIRST DEFENDANT: Yes, when someone goes out in the public domain and picks up a microphone and says the wrong thing and the police get called and they go down, do they arrest the person who supplied the microphone, or do they go and get the speaker? I'm just asking.
HER HONOUR: Well, I think you're talking about criminal allegations, and I'm not here to give advice on the trial, and I'm certainly not here to give advice about criminal allegations.
FIRST DEFENDANT: This Court is a farce, your Honour, sorry, my opinion only. This is just crap… Who gets taken? The person who said it or the person who supplied the microphone?”
I took that to be a submission that the First Defendant was not a publisher.
As to damages, the First Defendant acknowledged that he had read the Plaintiff’s submissions about damages. He responded when asked if there was anything he wanted to say about damages,
“What damages? This has been going on for about 14 years, your Honour. What possible more damages can be done?…
14 years, they have taken innocent people after McKee has been in there and spilt the beans, and then these guys rush in and go, ‘Oh, money, money, money’, what a farce.”
“Yes, submissions. Right, mate. Yes, my submissions are no jury, you know, no time to get myself together, you know what I mean? After a progressing fricking operation, all right? And then, and now, you know, my old mate there, Mr Kirby, is whacking in, you know, class actions, or actions against people with 300k? What and they started at 25. You know, what sort of a farce is this? 300k. I said nothing to no one, I didn’t condone anything, okay? I did not share one message that McKee sent me out of 140, okay? And you think I'm guilty, you think Cathryn's guilty, you are kidding yourself. Cathryn was there for two seconds. Luke McKee got five minutes in each broadcast, right? That’s 15 minutes out of nine hours. Mr Kirby himself said it's all conspiracy and ramblings. So, who's going to believe it? If Mr Kirby is saying that it's all ramblings and conspiracy theory, yet 15 minutes out of nine hours, come on? Who's listen to it? Did anyone contact me and go, ‘Wow, look at this Bottrill guy. Got any more info?’, no, they didn't. No one even remembered it. 15 minutes out of nine hours, come on…
An absolute farce. Yes, it's an absolute farce, your Honour…
That we're even, that Cathryn or myself are even here. Come and, come and get Luke McKee.”
As to publication:
the Plaintiff has failed in proving that a “legally sufficient act of publication” by the Second Defendant occurred;
the First Defendant alone created, hosted, controlled, and recorded all three broadcasts;
the Second Defendant’s involvement was brief, voluntary and peripheral;
The Second Defendant joined each broadcast after it had commenced and accepted a co-host position via an in-app invitation;
the Second Defendant had no role in planning or content, exercised no real control over the broadcasts, and made no statements conveying any pleaded imputation; and
the Plaintiff identifies no specific act of the Second Defendant that communicated any defamatory matter and that omission is fatal to the claim against her.
The Second Defendant further submitted:
the Plaintiff must establish that the Second Defendant engaged in conduct that communicated the defamatory matter, not merely been associated with the platform on which it was published;
incidental use of platform functions as a co-host does not amount to publication;
permitting a person to speak is not the same as communicating what they say;
participation requires involvement in the communication of the defamatory matter itself; and
the “co-host” label on the X platform is not determinative of publication.
The Second Defendant submitted that in Fairfax Media Publications Pty Ltd v Voller [2021] HCA 27 (‘Voller’), the High Court held that media companies were publishers of third-party comments posted on Facebook pages they had created and controlled. The companies were liable because they had set up the forum, invited public comments, and retained the power to moderate or delete them. The present case is materially different. The First Defendant alone created and administered the forum on X using his own account. The Second Defendant was invited only after each broadcast had already commenced and had no power to initiate, record, retain, or control the content of the broadcasts. The Second Defendant’s limited technical functions fell well short of the level of control that attracted liability in Voller.
The Second Defendant further submitted that her role was limited and peripheral. The evidence shows the First Defendant was the sole originator and controller who initiated, scheduled, recorded and retained the X broadcasts. The Second Defendant was invited as a voluntary co-host after each broadcast had commenced. Across approximately ten hours of broadcasts, her total speaking time was only eleven minutes, or approximately 1.9% of the broadcasts’ times. This limited speaking time is consistent with the absence of any real control or moderation over the broadcasts. The Second Defendant made no statements about the Plaintiff and did not endorse or adopt any defamatory allegations.
The Second Defendant submitted that whilst she performed routine platform interactions, such as thanking speakers and managing the hands queue (which allowed speakers onto the broadcasts), they were not “facilitative acts” sufficient for publication. They were, rather “ordinary, incidental functions available to any co-host”.
The Second Defendant further submitted that in the First Broadcast, Mr McKee was not introduced by the host or co-host. He began speaking by unmuting his own microphone without any introduction or invitation. The Second Defendant had no control over his participation.
The Second Defendant submitted that her role was limited to acknowledging or responding to participants as they indicated they wished to speak. That did not involve any selection or endorsement of content.
The Second Defendant submitted that her screenshots for the Second Broadcast (CB66, Exhibits E and F), together with the screen recording and screenshots for the Third Broadcast (Exhibits 2D1 and 2D2), show her status at the relevant times and contradict the Plaintiff’s assertion that she remained a co-host throughout the broadcasts.
The Second Defendant submitted that the audio recordings show that she was not participating at the times the alleged defamatory matter was communicated.
The Second Defendant drew my attention to the Plaintiff’s written submissions (at paragraphs [47]–[48]) which identifies the First Defendant as the host, account holder, the person who invited Mr McKee, and the person who controlled and endorsed the content. By contrast, the case against the Second Defendant rests only on her appearance as co-host and the performance of incidental procedural functions, insufficient to prove publication.
As to the Second Defendant not exercising any control, she submitted:
she had no administrative access, no account credentials, and no capacity to remove or edit recordings;
The Plaintiff’s solicitor’s screenshots (CB409–411), taken at early timestamps in each broadcast (1:00 in the First Broadcast, 0:09 in the Second Broadcast, and 0:18 in the Third Broadcast), show that the First Defendant was the sole host at the commencement of the broadcasts and that she was not present in any hosting capacity when each live broadcast had already commenced;
as the creator and administrator of the relevant X space, only the First Defendant had the power to start each broadcast and to invite co-hosts; and
she was invited only after each broadcast had already commenced and played no part in initiating or controlling them.
The Second Defendant submitted that her involvement was limited to basic moderating functions, such as welcoming speakers who were already queued to speak and monitoring for trolls. There was no expectation that she would remain for the full duration of the broadcasts.
As to the Second Defendant’s lack of knowledge and awareness of the defamatory matter, she submitted that she had never heard of the Plaintiff or of Mr McKee and had no reason to anticipate that any speaker would make defamatory statements about the Plaintiff during the broadcasts.
For the First Broadcast, the Second Defendant submitted:
she was disengaged for over 14 minutes from 0:15:40 to 0:30:26;
the audio recording shows a distinct six second gap before she responded to Mr McKee in a hesitant, distracted tone, consistent with her not having heard the preceding conversation; and
she had not been actively participating and did not hear the alleged defamatory statements made approximately four minutes earlier.
For the Second Broadcast, the Second Defendant submitted:
the host had told her that Mr McKee would speak about “Cookerwatch”;
at approximately 0:06:00, she said she was “looking forward to this conversation with Luke”;
she had not heard Mr McKee in the First Broadcast and did not recognise his name (I pause to interpolate that there is no evidence of this matter, where the Second Defendant did not give evidence);
she left the broadcast at approximately 0:10:20, well before the alleged defamatory remarks were made at approximately 0:54:00;
before exiting, she made a brief personal comment about returning a phone call and confirmed “yes, we have you” to Mr McKee, then left the space;
she did not hear any of the subsequent discussion (again, a matter about which there is no direct evidence); and
the screenshots at 0:26:42 and 0:55:10 (CB66, Exhibits E and F) confirm that X did not label the Second Defendant as a co-host before or after the relevant period.
For the Third Broadcast, the Second Defendant submitted:
the transcript records that she had already been disconnected from the broadcast well before 0:57:50, with the host noting at that time, “Catherine’s gone, they took her out”;
the audio recordings, transcripts, screen recording and the PDF of screenshots derived from that recording consistently demonstrate that she was not participating prior to, at the time of, or after the alleged defamatory matter; and
the screen recording, and screenshots (Exhibits 2D1 and 2D2) demonstrate that she was not a co-host at the relevant time and was not re-invited to that role for the remainder of the broadcast.
The Second Defendant further submitted that neither the Plaintiff nor Mr Swift gave evidence as to any act by the Second Defendant that communicated any defamatory matter.
The Second Defendant submitted that in the event publication is proven, she has a defence of innocent dissemination under s 32 of the Act.
The Second Defendant submitted that she is a subordinate distributor and not the originator or person who controlled or authorised the publication. She submitted that she neither knew, nor ought reasonably to have known, that the matter was defamatory and said that her lack of knowledge was not due to any negligence on her part.
The Second Defendant relied on the following matters including those matters going to her denial of publication:
she was an invited co-host with no editorial control in a broadcast originated and controlled by the First Defendant;
she did not hear the statements and was not present at the relevant times; and
no reasonable step was available to her to prevent or limit the publication.
The Second Defendant further submitted that she had no knowledge of the alleged defamatory content and no capacity to prevent or limit its publication. In those circumstances, there was no reason she ought reasonably to have anticipated that any speaker would make specific defamatory allegations about the Plaintiff during the live, chaotic broadcasts, relying on Thompson v Australian Capital Television Pty Ltd (1996) 186 CLR 574 (‘Thompson’).
In addition to the written submissions which I have taken into account, the Plaintiff made oral submissions as to the Defendants’ liability.
The Plaintiff relied on CB59 in which the Second Defendant made admissions as to her facilitative role in the broadcasts in her Amended Defence under the heading "Facts" at paragraph 2.1 as follows:
that she acted as a volunteer co-host in three broadcasts; and
that her role included tasks such as welcoming speakers, monitoring for disruptive participants and trolls.
As to the First Broadcast, the Plaintiff relied on the following matters:
at the commencement of the broadcast, at 00:05:36, the Second Defendant was invited by the First Defendant to “throw some mics around”, being a reference to inviting speakers to be able to comment, and to “co-host, darling" (CB100) to which the Second Defendant responded, "hello everyone, the co-host came up and I accepted it, and here it comes again", commencing her participation in that broadcast;
at CB102, the Second Defendant contributed at 0:12:25, prior to the relevant matter complained of in the First Broadcast at 0:26:40 (CB106);
the Second Defendant had last spoken at CB103;
the Second Defendant’s submission (unsupported by any evidence) that she had not heard Mr McKee in the First Broadcast, that she did not recognise his name, and that she left the broadcast at approximately 0:10:20, does not sit comfortably with her statement at 0:30:26 when she says, "thanks Luke";
there is no evidence that the Second Defendant was distracted and the transcript shows that she was not disengaged from 0:15:39 where she showed engagement and interest with the question, "what happened with your court case?"; and
the fact that the Second Defendant did not speak for those preceding 15 minutes is not evidence of disengagement.
Accordingly, it is submitted, there is no evidence that the Second Defendant did not hear Mr McKee make allegations against the Plaintiff and the inference from the content of the broadcast is that she did.
It is submitted on behalf of the Plaintiff that, in any event, whether the Second Defendant was engaged or not is not relevant to her role as a publisher. Her facilitative role makes her a publisher of the first matter complained of, and it does not matter if she left the room, notionally or virtually, at the time that the defamatory material was spoken. There is no need to establish any intention to defame. Liability is grounded in the facilitative act of publication.
As to further evidence of the Defendants’ collaborative involvement in the First Broadcast, the Plaintiff relied on the following matters in the broadcast:
At 0:30.26 (CB107), after the defamatory matters were uttered by Mr McKee, the Second Defendant thanked him and then “throws the mic” to the next speaker, still acting in her facilitative role.
At 0:32:16 (CB108) and at 0:36:21 (CB109), where it is stated, “[l]et's go into Shary and then Glen Patriot, Sydney, and then back to Luke", the Second Defendant responded, "hey Shary", showing that at this time, the Second Defendant was managing the speaker queue.
At 0:47.40 (CB113), the Second Defendant thanked another speaker and then handed over to the First Defendant, and Mr McKee spoke again.
At about the time Mr McKee was speaking (CB114), the First Defendant exercised his control of the broadcast and thereafter the Second Defendant continued her co-hosting role, giving the mic to another person, and the Plaintiff relies on this as an “evocative demonstration” of the control that could have been exercised by the Defendants over Mr McKee.
At 1:02:00 (CB118), the First Defendant handed over to the Second Defendant to take over primary control of the broadcast.
At CB126, the Second Defendant welcomed Mr McKee back into the broadcast saying, "Thanks, Coco. Let's go over to Luke… Come on in, Luke."
At CB143, the Second Defendant still controlled the speaker queue, and invited speakers to come in, letting them know when it was their turn, functionally performing her role as a co-host.
At 2:31:27 (CB144) and at 2:37:31 (CB146), the Second Defendant said in response to a speaker, "That was a real eye-opener, absolutely. Okay, let's go back. Was it Rick and then Glenn?" and the Plaintiff submitted that she was unarguably acting as a co-host.
As to the Defendants’ combined facilitation of the Second Broadcast, the Plaintiff relied on the following:
At 0:06:00 (CB155), the Second Defendant said, "Nice to see everyone here, really looking forward to this conversation tonight, with Luke I think he's (not transcribable)... Guru so hi Mel, nice to see you… Okay, let's go for it, Luke."
At about 0:10:00 (CB156), the Second Defendant said "Anyway, let's get Luke up, when he can get back in", and Mr McKee returned at 0:10:32 with the words "Working this time?" to which the Second Defendant said, "Yes, we have you.”
At CB160, the First Defendant invited Mr McKee to tell his story saying, “so, yeah, let's get a bit on you, Luke, where did you grow up?”
At 0:46:37, OTO is first mentioned by Mr McKee.
At 0:47:54, the First Defendant said, “I don't mind you coming back in, but I'm controlling it, mate, and I want to get some info out", demonstrating both the First Defendant’s control and that the information he wanted out was about OTO, the gnostic Catholic Mass, the infiltration and the mandate of child orgies referred to immediately beforehand.
In another example of the First Defendant’s control of Mr McKee at 0:50:58 (CB165), he said, "I mean, what we're trying to do here is gather all the information, I just want to know how these things work".
At 0:53:20 (CB166), Mr McKee referred to the Plaintiff.
At 0:56:27 (CB167), the First Defendant interrupted Mr McKee, and said "All right, Luke, hang on, let's just give you - you're going well, man, just give you a breath, Luke."
Further references to the Plaintiff are made at 1:00:00 (CB168).
At CB169-170, the First Defendant asked for Mr McKee’s permission to allow a person from @cookerwatch onto the broadcast.
At CB170-171, the Second Defendant had been following along, and she agreed to unblock the @cookerwatch speaker. A person advised at about 1:10:55 (CB171) how to unblock the caller. At 1:10:55, the Second Defendant said "Yeah, and check with both your account and Guru's as well. I'll just click unblock, I've unblocked her."
At CB171, the First Defendant endorsed Mr McKee saying, "This is what it's all about, guys, all right, gathering the information."
At CB172, the First Defendant said, "You've got the mic. I've usually got you barred. Yeah, I'll give you the first question at Luke, and then we'll get a response", and then, "Yeah, I'll control it, so come in Cookerwatch."
Mr McKee’s serious allegations against the Plaintiff follow thereafter. At CB178, he referred to "the devil" and "the great beast" and "Cookerwatch reported me yesterday, a couple of days ago, for talking shit about this cult and their doctrine of child abuse"; a reference to OTO. He went on, "I mean, the writing's on the wall. Who, who's the paedo is here", statements directed at members of OTO more generally, and criticising Cookerwatch for defending them.
The Second Defendant spoke again at 2:24:49 (CB193).
At CB194, Mr McKee returned to the topic of OTO. At 2:27:23, he said, “the world's first gay rights organisation, the Masonic satanic Ordo Templi Orientis, which", and goes on.
At 2:30:00, the First Defendant thanked Mr McKee for his contribution and said, “Look, Luke, you've got brilliant information, mate. You've, you've obviously got a Rain Man sort of brain for this stuff".
At 2:50:00 (CB202), the Second Defendant brought “Coco” into the broadcast. It is clear from the exchange that the Second Defendant had been absent from the debate for a time. She last spoke at 2:24:49. It is not clear how long she had been away from her microphone as she did not give evidence. She resumed co-hosting.
At 2:51:42 (CB203), the First Defendant again endorsed Mr McKee’s content. He said, "So Luke we’re gonna have to get - you’ve obviously got a shitload more information. I'm gunna [sic] have to start sharing all your stuff on Twitter and banging it out for you. Haven't had a chance to do that.”
At CB206, at the end of the broadcast, both Defendants are present. The First Defendant said at 3:03:07, “It’s been a great space. Luke, we’ll be in touch mate. We’ll talk again”, and later, “Luke, brilliant stuff, mate. That was great. A lot of info. People are gunna [sic] have to go back through this and pick the guts out of it if they want and go looking. Everything's up in the jumbotron up there, guys, so get into it. Happy digging and, yeah."
Someone said, "Thank you, Cathryn", and the Second Defendant wished everyone a good night.
As to the Defendants’ facilitation of the Third Broadcast, the Plaintiff relies on the following:
The Defendants both contributed to the commencement of the broadcast (CB207).
At 0:04:54 (CB207), the First Defendant invited Mr McKee into the broadcast, with conditions that he not make it all about himself, and that it is “topic-related”, not “Luke-related”. He said to Mr McKee, “I love you in here. I love your info.”
From 0:27:17 (CB208-214), the Second Defendant rejoined the conversation, importantly prior to the third matter complained of. She made a contribution to the topic of Masons in Launceston, showing engagement with the topic generally. At about 0:13:02 (CB210), she said that in Davenport she found a "full on bloody Mason".
At that point, and with the Second Defendant clearly present and contributing, the First Defendant brought Mr McKee back into the conversation. He said, “Luke, let's bring you in for a minute because what I want to do, Luke, is ask you, with all the research that you've done on these different topics, you've given us the stuff to - I want to quickly ask what you've - have you found? Which you have in a couple of things but is there a big Mason, you know, resemblance with all the research that you've done, Luke".
At CB211, Mr McKee clearly telegraphed that he was returning to the topic of OTO, bringing children to the gnostic Catholic mass ritual, and that “all of them were high level Masons". At 0:16:28, he said that OTO claims to be a Masonic organisation. The Second Defendant is present at that time (CB212).
The Second Defendant contributed to the conversation at CB212 when Mr McKee returned to the topic of OTO.
The Second Defendant’s last statement before Mr McKee’s first statements on defamatory topics is at 0:21:37 when the First Defendant, to deal with technical issues, proposed dropping the Second Defendant out so that Mr McKee could join. The First Defendant said, “Luke, give me a minute. Cathryn, I'm gunna drop you out. Pull the (not transcribable)… I'm gunna [sic] drop you off as to - as listening. I'm gunna bring Mel in as co-host and then bring you back in as a co-host. Remember that worked the other night?" The Second Defendant responded, "Absolutely, yep, go for it". The First Defendant said to Mr McKee, "Luke, you've got the floor."
From 0:25:34 (CB214), Mr McKee returned to the topic of OTO, “child abuse, gnostic Catholic mass with two real kids”. He said the woman they put in charge of the Anti-Discrimination Board of Tasmania “has a history of fighting for satanic child abuse cults” and cases are dropped. The First Defendant responded at about 0:27:17, “This is what happens buys, Yep True. Yeah. Thanks, Luke. That’s exactly right mate” and suggested the need to “get a strategy out there against Freemasons”. The Second Defendant agreed that the prevalence of Masons is an issue to be responded to.
By 0:32:10 (CB216), the Second Defendant returned to her co-hosting role. At CB215, she was asked by the First Defendant to unmute a participant. At CB216, she directed those wanting to speak to “put up your hands”. At 0:35:25 (CB217), she said, "Excellent. Come in Aussie chick, good evening."
At 0:56:35 (CB223), the Second Defendant again stepped away from her co-hosting role. The First Defendant said, “Luke, at the moment mate, take the floor if you want it okay.” Mr McKee continued speaking.
At about 0:59:20 (CB224), there is a reference to “Cathryn’s back”. It is not clear whether or not this is the Second Defendant as neither Defendant gave evidence, including about this issue.
At 0:59:20 (CB224) and at 1:09:56 (CB227), Mr McKee said the words relied on for the Third Broadcast, most notably that:
(a) OTO has a doctrine that is against the law, such as adults doing sexual acts in front of, at least, and/or with children, and/or consuming blood, acting like vampires; (b) David Bottrill is a member of the organisation; (c) they are “satanic pricks”; (d) David Bottrill is the head of OTO in Australia; and (e) the Australian OTO is a “child abuse cult”.
The Second Defendant is clearly present at 01:17:00 (CB229). She said in her co-host role, “Go ahead Coc**o”. As neither Defendant gave evidence, it is not clear when she returned.
Generally, as to whether the Second Defendant is a publisher of the Third Broadcast, the Plaintiff submitted that, in any event, her presence and lack of presence at times is irrelevant. It is submitted that she has been shown to have been instrumental as a co-host by her conduct overall. It was submitted that she clearly played a facilitative role in this tort of strict liability. In addition, it was submitted, the Second Defendant was present when Mr McKee started talking, and contributed to the discussion, at least in respect of the related topic of the Masons.
The Plaintiff relied on the following further matters:
At CB231, the Second Defendant’s co-hosting role is confirmed. At 1:24:43, the First Defendant said, "Cathryn's had her hand up, she's a co-host, she goes first, Crikey". The Second Defendant said, "Actually, no, I didn't have my hand up, it just went on by itself, so keep going." At 1:46:20 (CB236), the First Defendant said, "Who is watching hands? Cathryn? I hope so. Coco was next, Mel was just telling me". At 1:50:30 (CB237), the Second Defendant said, "And all else will come. Go Coco."
At about 2:13:57 (CB244), Mel Graham asks in relation to Coco coming back in, "I can't accept her request. Cathryn, can you?" It is apparent, and absent any evidence to the contrary, that the Second Defendant is still co-hosting.
Mel Graham said, "Luke's done well". The First Defendant said, "Thank you, Luke".
Mr McKee returned to talking about the Plaintiff and the sexual practices of OTO members. He said, “Remember what I said about the OTO and their doctrine of magical masturbation?” The First Defendant endorsed him saying, “Thanks Buddy”.
It was submitted by the Plaintiff that CB146 provided further evidence that the Second Defendant continued to perform her co-hosting duties. Just before 2:19:57, she said “Franco, yep keep going. Um, Guru hopefully will come back in”, and later “perhaps Coco, Coco could answer”.
At 2:23:28 (CB247), the First Defendant invited Mr McKee back to the microphone saying, “Right, back to Luke. You’ve been very well-behaved Luke”, endorsing the matter complained of. Mr McKee embarked on a further long speech, including about OTO. He finished talking more than 10 minutes later, at which time the First Defendant said “All right. Thanks Luke”.
At 2:48:02 (CB254), the Second Defendant continued in her co-host role saying, "Yeah, who's next?" and later at CB257, “Aussie chick, let's go to you Janice. Good evening. Good morning".
The Second Defendant’s co-hosting role continued throughout the balance of the broadcast. At CB267 and CB268, just before 3:32:00, the First Defendant said, "All right, Cathryn, you want to come in? We're going to wrap this up, because I got to get some sleep, man, I really do".
The Second Defendant, at 3:34:29 (CB268), wraps up the broadcast and said thanks to all the “other wonderful speakers tonight” (which must include Mr Mckee) and “We look forward to our space in the morning Guru. I’ll put a link out into the community as well.”
Reliant on the above matters, the Plaintiff rejected the Second Defendant's characterisation of her role as being "brief” and “peripheral”. It was submitted that she showed a cognisance of and recognition of the subject matter that the broadcasts were concerned with and facilitated a discussion which included the peddling of conspiracy theories by Mr McKee and which included the defamatory matters regarding the Plaintiff.
Consistent with that role, but which on its own would not provide clear evidence, is the evidence of the Second Defendant’s status as a co-host, set out in Exhibit C. The Plaintiff also relied on the Affidavit of Michael O’Connor at CB381, CB384, CB349 and CB396, in relation to her co-host responsibilities.
The documents set out in Exhibit 2D1 do not undermine that evidence and the admission in the Second Defendant’s defence that she was a co-host for all three broadcasts. It is accepted that the “co-host" label on X is not determinative. It is however consistent with the facilitative role that she played.
Finally, the Plaintiff relied on CB444 and the Affidavit of Rodney Swift at paragraph [26], the answers to interrogatories, and the Second Defendant’s qualified admissions found at CB557 and CB558, containing her exercise of moderation powers, and advertising upcoming X Spaces.
In addition to the matters set out in the written submissions, the Plaintiff pressed for an award of aggravated damages against the First Defendant by reason of the following matters:
The way that he ran his case, including an attempt, through Mr McKee's father, to prove his contextual truth defence, which was always hopeless both because the evidence given was incapable of proving that matter and because it could never have been swamped by a true defamatory imputation in the terms pleaded. It is submitted that it should never have been pleaded. It is a matter of serious aggravation.
A failure by him to provide any amelioration.
The posture that he adopted during the trial. When he was cross-examining, the glib and snide remarks, the tone of mock incredulity and sarcasm, including about the Plaintiff calling the police because he was scared for his safety.
His failure to take any responsibility where he had given Mr McKee a platform to reach many listeners and to “poison the atmosphere” with lies. Indeed, in his cross-examination of Mr Swift, he conveyed his view by the questions that X was the publisher and not him.
His failure to exhibit any remorse for the fact that the Plaintiff has had his name “dragged through the mud because of Mr McKee's platforming”, on three separate occasions.
By doing so, the First Defendant aggravated the hurt, humiliation and further injury done to the Plaintiff.
“Get this crap over with, your Honour… Get back in here and just do this, man. This is just ridiculous.”
“Look, as I said, your Honour, this has all been about Cookerwatch. Always was about Cookerwatch. As I said, Mr Bottrill is of no interest to me. My interest was supplying a discussion, all right, where people could have their say. I suppose what I’d like to say, your Honour, because - yeah, just open discussion, but, look, Australia is a signatory to the UN Human Rights Charter, your Honour. I would like to bring you towards Article 19 of that Charter, that we're signed up to, and it says:
Everyone has the right to freedom of opinion and expression. This right includes freedom to hold opinions without interference to seek, receive and impart information and ideas through any media and regardless of frontiers."
Your Honour, the Plaintiff 's case identified general involvement in the platform, but not any act by me that communicated or participated in the communication of the defamatory matter. My defence response to the case as pleaded, even looking at the broader transcripts that are now relied upon, the Plaintiff has not identified any act by me that communicated or participated in the communication of the pleaded defamatory matter.
The plaintiff's case relies on inference, rather than evidence, particularly concerning my co-host role. In the transcripts it is evident that I did not respond at times, or interact, and I can assure you if I was there, I would have responded. My visual screenshots, as tendered this morning, are the only true evidence of my position. Being labelled a co-host, or performing routine procedural functions, is not, of itself, publication. There is no evidence that I exercised control over the content, or communicated any defamatory material. The question is whether I communicated or participated in the communication of the defamatory matter.
The transcript itself is unclear about when I left and when I returned, and, with the X platform, that is a continual problem in those spaces. Happens all the time. There's no clear evidence from one third party application that just lists that would list anyone as a co-host. It doesn't say when they come or when they go, and it can list many.
…
[T]he Plaintiff still has to identify an act by me that communicated or participated in the communication of the defamatory matter. In those circumstances, the Plaintiff has not discharged the onus against me.
…
[The Plaintiff] has not identified any act by me that has participated in that communication, and instead relied on a very broad role, as in (not transcribable)… but not for anyone that hasn't created the actual content, or communicated it.
The Plaintiff has established that the Defendants published defamatory matter concerning the Plaintiff to at least one person other than the plaintiff: Dow Jones & Co Inc v Gutnick (2002) 210 CLR 575 at [25]–[26], namely to Mr Swift.
The liability for publication extends not only to the person who said the words, but all of those who are “in any degree” an accessory to the publication: Webb v Bloch (1928) 41 CLR 331, per Isaacs J at 363–364. Indeed, without the use of the First Defendant’s platform, and as assisted by the Second Defendant, Mr McKee’s words would likely have fallen on deaf ears.
Both Defendants have been either instrumental in (in the case of the First Defendant), or contributed to (in the case of both Defendants), the publication of defamatory matter and accordingly each is a “publisher” in the relevant sense given the way both facilitated the communication of Mr McKee’s rhetoric to listeners to the live broadcasts: Voller per Kiefel CJ, Keane and Gleeson JJ.
The majority in Voller (from [25]-[31]) held, citing Starkie*,* that all persons who:
"are in any degree accessory to the publication of a libel, and by any means whatever conduce to the publication, are to be considered as principals in the act of publication".
There is no doubt that the First Defendant aided and abetted Mr McKee in publishing his words. The Second Defendant also encouraged and facilitated such publication in all three broadcasts, albeit to a much lesser degree.
Although neither Defendant gave evidence that this was the case, it does not matter if no injury to reputation was intended or that they acted with reasonable care. However, I find that they did not. Both were aware of the nature of the long speeches given by Mr McKee. Indeed, the broadcasters encouraged them. I find that the Defendants had an ability to block or mute Mr McKee but chose not to. This was the very kind of material the broadcasts were intended to encourage, and both Defendants did so in the case of Mr McKee.
As submitted by the Plaintiff, a publisher's liability does not depend upon their knowledge of the defamatory matter which is being communicated or their intention to communicate it. The liability of a person as a publisher "depends upon mere communication of the defamatory matter to a third person": Lee v Wilson & Mackinnon [1934] HCA 60 (‘Lee’).
The Plaintiff relies on Dixon J’s statement in Lee that "[t]he communication may be quite unintentional, and the publisher may be unaware of the defamatory matter", but the person communicating the defamatory matter will nevertheless be liable.
Trkulja v Google LLC [2018] HCA 25 confirms that any act of participation in the communication of defamatory matter to a third party is sufficient to make a defendant a publisher.
The Plaintiff relies on Crookes v Newton [2011] 3 SCR 269, a decision of the Supreme Court of Canada, in which Abella J held that "the breadth of activity captured by the traditional publication rule is vast". Her Honour gave, as an example, a case in which a printer's employee, whose only role in a publication was to "clap down" the printing press, was held liable for the libels contained in the publication even though he was unaware of its contents.
The First Defendant admits that he broadcast the three live broadcasts (First Defendant’s Amended Defence, paragraphs [6], [13] and [19]).
The First Defendant hosted all three broadcasts.
The First Defendant’s X.com profile page “StoptheRot7” was the platform through which all three broadcasts were published. After each live broadcast, the recordings remained available on the First Defendant’s profile page.
The First Defendant controlled the platform. He had the ability to mute Mr McKee and to remove him from the broadcast. He exercised his power to mute Mr McKee during the First Broadcast (at 0:25:46 (CB106)) prior to Mr McKee’s defamatory statements concerning the Plaintiff were made. He muted other speakers from time to time.
The First Defendant also endorsed Mr McKee’s defamatory material.
The Second Defendant, at times, facilitated and contributed to the communication of defamatory matter to those listening to the broadcasts. In assessing speakers to join, muting and blocking, and unmuting and unblocking speakers, she acted as an instrument in the broadcast’s production.
In particular, the Second Defendant:
welcomed speakers;
managed the "hands" queue;
took over the broadcast from the First Defendant on one occasion (CB170);
thanked Mr McKee for his contributions, which included defamatory material concerning the Plaintiff;
introduced the next speaker after Mr McKee’s defamatory statements in the First Broadcast (0:30:26);
continued to co-host the Second and Third Broadcasts;
had the role of ‘handing out microphones’ to those who wished to speak; and
had the ability to mute speakers.
I find that both Defendants were publishers of the defamatory content in all three broadcasts. Indeed, it is apparent from the broadcasts that the Defendants endorsed the statements made by Mr McKee, including the defamatory statements of and concerning the Plaintiff.
Although I did not read them when coming to my findings, it follows that that I agree with Gibson DCJ in her findings at [33] in respect of the serious harm application in Bottrill v Graham & Anor (No 2) [2025] NSWCC 221 that both Defendants controlled the content of the broadcasts in the following ways:
[33] … (b) Persons wishing to participate in the discussion would have to wait until their bona fides had been checked by members of the First Defendant’s “crew”, which on the dates in question here was the Second Defendant. The Second Defendant checked each person’s X profile on social media before permitting each such checked-out applicant to “come in” to hear the debate. There was a further checking process before any persons hearing the debate were given a “mic”, namely a microphone. The purpose of this careful procedure was, as the Second Defendant explained in her oral submissions, to ensure that only persons whose views accorded with the Guru and his crew were permitted to enter into the debate. Those who held contrary views, whom the Second Defendant described as being “cooker watchers” or “trolls”, had to be excluded as they could undermine the Defendants’ messages and warnings to listeners by introducing contrary views. With one exception (a person designated as “@Cookerwatch”, whose contribution was swiftly terminated), their views are homogenous.
The Plaintiff was named a number of times, and in all three broadcasts (CB106, CB166-168, CB224, CB227, and CB244). I am satisfied that the Plaintiff has established that the matters complained of in all three broadcasts were published “of and concerning” him as required by Mirror Newspapers Ltd v World Hosts Pty Ltd (1979) 141 CLR 632 at 638–639.
Mr Swift heard the Plaintiff named on each occasion.
The imputation alleged at [11](c) of the Statement of Claim in respect of the First Broadcast, that “the Plaintiff has committed perjury in legal proceedings”, is not pressed.
The remaining imputations are conveyed by each of the broadcasts.
They are:
that the Plaintiff engages in criminal activity, including paedophilia and the abuse, including sexual abuse, of children (for the First, Second and Third Broadcasts);
that the Plaintiff is the leader of an organisation that engages in criminal activities including paedophilia and abuse, including sexual abuse, of children (for the First and Second Broadcast); and
that the Plaintiff is the leader of a cult that concerns itself with child abuse (for the Third Broadcast).
The imputations, and any one of them, convincingly have a tendency to lower the Plaintiff in the estimation of right-thinking members of the community generally: Radio 2UE Sydney Pty Ltd v Chesterton (2009) 238 CLR 460 at [1]-[5].
I agree with the Plaintiff’s characterisation that those imputations are among the most serious that can be conveyed of any person.
The Plaintiff relies on Gibson DCJ’s observations in Martin v Najem [2022] NSWDC 479 (‘Martin v Najem’) at [71]. There are few more hated criminals in Australia than paedophiles, and to call a person a paedophile is at or near the top of the list of serious allegations.
McCallum J’s (as her Honour the Chief Justice of the Supreme Court of the Australian Capital Territory then was) observations in French v Fraser [2015] NSWSC 1807 (‘French’) are apposite:
“This case provides a distressing illustration of the devastating harm that can be caused by the mischievous use of the internet as a medium for defamatory publications.”
The First Defendant raises defences of contextual truth (s 26), public interest (s 29A), qualified privilege (s 30), honest opinion (s 31(3)), and innocent dissemination (s 32).
The Second Defendant raises innocent dissemination (s 32), and triviality (s 33).
It is a defence to the publication of defamatory matter if the Defendant proves that—
(a) the matter carried, in addition to the defamatory imputations of which the Plaintiff complains, one or more other imputations (contextual imputations) that are substantially true; and
(b) the defamatory imputations of which the Plaintiff complains do not further harm the reputation of the Plaintiff because of the substantial truth of the contextual imputations.
The First Defendant relies in his pleading on a contextual imputation that “the Plaintiff is the leader of an organisation whose members have a sexual interest in children (an interest not necessarily acted upon)” (Amended Defence, paragraph [41]).
The First Defendant must establish that this contextual imputation is substantially true and that the Plaintiff’s imputations cause no further harm beyond that caused by the contextual imputation.
The question is not just whether the contextual imputations are true, but whether, assuming they are true, the Plaintiff’s imputations cause any additional damage to the plaintiff’s reputation: see Basten JA in Besser v Kermode [2011] NSWCA 174 at [79].
The defence operates as a complete defence, but only if the contextual imputation is so damaging that the Plaintiff’s imputations add nothing to the harm already done.
This defence cannot succeed for three reasons, any one of which would doom it to failure:
The contextual imputation was not conveyed by the broadcasts.
The Defendants offered no evidence that could establish that the imputation was substantially true.
The imputations conveyed are significantly more serious than an imputation about the alleged interests of other members of an organisation led by the Plaintiff, and not acted on.
The contextual truth defence fails.
It is a defence to the publication of defamatory matter if the Defendant proves that
(a) the matter concerns an issue of public interest;
(b) the Defendant believed that the publication of the matter was in the public interest; and
(c) the Defendant’s belief was reasonable
Section 29A(1)(a) focuses attention on the relevance of the publication to “an issue of public interest”, which is objectively determined: see Russell v Australian Broadcasting Corporation (No 3) [2023] FCA 1223 (‘Russell’) at [318]-[319].
Section 29A(1)(b) is concerned with the First Defendant’s actual state of mind at the time of publication: Russell at [321]. This is not satisfied by showing that a notional reasonable person in their position could have believed that publication was in the public interest: Russell at [322]. The First Defendant must prove that he turned his mind to the issue at the time and believed that the matter was in the public interest: Russell at [322]. Ex post rationalisations are not enough: Russell at [322].
Section 29A(1)(c) is concerned with whether or not the belief that the publication of the matter was in the public interest was reasonable.
The Court must take into account all of the circumstances of the case: s 29A(2), Murdoch v Private Media Pty Ltd [2022] FCA 1275 (‘Murdoch’) at [68]; Russell at [265], [324]; Deeming v Pesutto (No 3) [2024] FCA 1430 at [635].
As to the third element, the Plaintiff relies on Wigney J’s statements in Murdoch at [67]:
“The question, essentially, is whether a reasonable person standing in the Defendant’s “shoes” – that is, in particular, possessing the information that the Defendant possessed at the time – would have held that belief.”
This includes consideration of whether the First Defendant had an honest and reasonable belief in the truth of what is published: Russell at [339].
The knowing publication of misinformation has never found protection in Australia (except on occasions of absolute privilege): Russell at [340].
Section 29A(3) of the Act sets out a non-exhaustive list of factors that the Court may take into account to the extent that the Court considers them applicable in the circumstances.
Taking into account those matters that are relevant and known:
The broadcasts were not reporting on matters of government, public health, or civic concern. The were unverified allegations about a private citizen.
Proper investigation of powerful child abusers in our society may be in the public interest. As set out in Bellino v Australian Broadcasting Corporation (1996) 185 CLR 183 per Dawson, McHugh and Gummow JJ at 221–222, it may involve the discussion of the conduct of some person or institution that invites public criticism or discussion. However, peddling incoherent, unfounded accusations is not, objectively, in the public interest. I accept the Plaintiff’s characterisation that the broadcasts provided “simply a platform for regurgitating unvetted conspiracy theories, without any regard for proof, particulars or circumspection”.
Any subjective belief that the First Defendant may have held (about which there was no evidence as the First Defendant did not give evidence), that the subject matter was on an issue of public interest, was not reasonably held.
Having regard to the factors set out in section 29A(3), I find as follows:
The imputations are extremely serious (s 29A(3)(a));
There is no attempt to distinguish between suspicions, allegations, theories and proven facts (s 29A(3)(b));
The broadcasts do not relate to the performance of the public functions or activities of the Plaintiff (s 29A(3)(c));
There is no evidence that there was a public interest in the circumstances for the matter to be published expeditiously (s 29A(3)(d));
The source of the information in the broadcast, Mr McKee, has been established on the First Defendant’s own evidence from Mr McKee’s father, to be of no integrity whatsoever (s 29A(3)(e));
There was no attempt to gain the Plaintiff’s side of the story and, indeed any counter voices were blocked from the debate. There was no attempt made by the First Defendant to obtain and publish a response from the Plaintiff (s 29A(3)(g)); and
No steps were taken to verify the information in the broadcasts, particularly after the First Broadcast, when it was known to the First Defendant the likely topic on which Mr McKee might speak: (s 29A(3)(h)).
The First Defendant could not have reasonably believed that publication of Mr McKee’s rambling and unverified allegations of paedophilia against the Plaintiff was in the public interest.
The public interest defence fails.
Section 30(1) of the Act provides that the First Defendant must prove that:
the consumers of the broadcast have an interest or apparent interest in having information on the subject;
the broadcast was published to the recipients in the course of giving to them the recipient information on that subject; and
the conduct of the First Defendant in broadcasting the information from Mr McKee was reasonable in the circumstances.
I have taken into account the following matters set out in section 30(3) in determining whether the First Defendant’s conduct was reasonable:
The matter was not of public interest.
It did not relate to the performance of any public functions or activities of the Plaintiff.
The defamatory imputations are extremely serious.
The Plaintiff’s side of the story was not sought, and the First Defendant took no step to at least state (by reason of the earlier litigation) that the Plaintiff denies the allegations.
The First Defendant took no steps to verify Mr McKee’s statements before publication and concluded with no factual basis that they had been “researched” by Mr McKee.
As was made clear in Lange v Australian Broadcasting Corporation (1997) 189 CLR 520 (‘Lange’), the High Court at 574 stated that the rationale for the defence is the furtherance of a legitimate interest or duty. It exists to protect publishers acting reasonably and in good faith and without malice, who publish material that serves a legitimate interest.
The question of reasonableness involves consideration of all the circumstances that are relevant and known: Roberts v Bass (2002) 212 CLR 1 at [15], [39], and [75]–[76].
Where the allegations are so serious, the standard of conduct required of the First Defendant is high.
Abraham J in Griniezakis v Morelas [2026] FCA 156 (‘Griniezakis v Morelas’) at [136]–[143] held that the respondent’s failure to contact the applicant before publication, failure to verify the allegations from reliable sources, and failure to have any proper factual basis for the defamatory imputations were fatal to a claim of reasonableness under s 30(3). So too in this case.
The First Defendant had no reasonable grounds for believing the imputations to be true, he took no proper steps reasonably open to him to verify the accuracy of the statements made by Mr McKee and there is no evidence that he did not believe the imputation to be untrue: Lange at 574.
The First Defendant did not seek a response from the Plaintiff. There was no evidence to suggest that this might not have been practicable, or that it was unnecessary to give the applicant an opportunity to respond: Lange at 574. Indeed, the entire purpose of the broadcasts was to engage only with like-minded participants in a room of mirrors, in a rambling, long-winded and, at times, frenzied fashion, without desire for genuine debate.
I accept the Plaintiff’s submission that no reasonable publisher, having heard Mr McKee’s allegations of paedophilia against the Plaintiff given in the First Broadcast, would invite him to return, to give him mostly a free rein and without taking any steps to verify the allegations or seek the Plaintiff’s response.
The qualified privilege defence fails.
The First Defendant pleads this defence in respect of Mr McKee’s statements (Amended Defence, paragraph [45]).
Section 31(3) of the Act provides a defence where the defamatory matter was published as the opinion of a commentator other than the Defendant. The First Defendant must prove that:
the matter was an expression of opinion of Mr McKee rather than a statement of fact; and
the opinion related to a matter of public interest; and
the opinion is based on proper material.
I find that the statements were not expressions of opinion. They were clearly assertions of fact that the Plaintiff is a paedophile and that he leads a paedophile cult. At the time, Mr McKee stated that it was true. There is, in my view, no unclear line between the two.
The statements did not relate to matters of public interest.
The statements were not apparently based on any nominated material, other than Mr McKee’s research, which is unknown, much less “proper material” as defined in s 31(5)-(6) of the Act.
The material on which Mr McKee’s statements were said to be based was not set out in specific or general terms in the broadcasts, nor was it notorious, and was not accessible from a reference, link or other access point included in the broadcast (for example, a hyperlink on a web page). It was not otherwise apparent from the context in which the broadcasts were made. The facts on which the comments were based were not stated or indicated with any clarity in the broadcasts. There was no information that what was being said was a comment or based on what facts.
Finally and relevant to the First Defendant’s pleading, the matter was not substantially true.
There was no attempt by the First Defendant to show that any material upon which any opinion might be based, was based on proper material. To the contrary, the First Defendant called Mr McKee’s father whose evidence was to the effect that the material was utterly unreliable.
The defence of honest opinion fails.
Section 32 of the Act provides a defence for a “subordinate distributor” who proves that:
the person neither knew, nor ought reasonably to have known, that the matter was defamatory; and
the person’s lack of knowledge that the matter was defamatory was not due to any negligence on the person’s part.
The Plaintiff relies on Thompson at 589-590, where the High Court drew a clear distinction between primary publishers and subordinate distributors.
A primary publisher, being the person who originates, controls, or authorises the publication, cannot avail themselves of the defence. It is available only to those whose role is genuinely subordinate, such as newsagents, booksellers, or internet service providers who have no editorial control over the content.
Both Defendants are primary publishers. The First Defendant, with the assistance of the Second Defendant, hosted the broadcasts on the First Defendant’s X profile page. They controlled which speakers could access the broadcast and had the power to mute and remove speakers. At times, they exercised that power. Both to some extent endorsed or applauded the content.
Furthermore, both Defendants knew, or ought to reasonably have known, that the matter was defamatory. No steps were taken by either Defendant to mute Mr McKee once he made defamatory statements. He was allowed to repeat them, not only in the First Broadcast, but in subsequent broadcasts. Indeed, the First Defendant invited Mr McKee to return for the Second Broadcast and spoke with him by telephone between broadcasts (Amended Defence, paragraph [47](vi)).
A reasonable person in the position of both Defendants would have anticipated that Mr McKee would repeat similar allegations and, given their seriousness, would have demanded proof and investigated them before allowing them to be repeated.
The defence of innocent dissemination fails.
Section 33 of the Act provides that it is a defence to the publication of defamatory matter if the Defendant proves that the circumstances of publication were such that the Plaintiff was unlikely to sustain any harm.
The Second Defendant bears the onus of proof.
The assessment of the likelihood of harm to the Plaintiff requires consideration of all the circumstances, including the nature and gravity of the defamatory imputation and the extent of publication: Bleyer v Google Inc [2014] NSWSC 897 at [92]–[95] per McCallum J.
The defamatory imputations of child abuse and where the Plaintiff was named, are extremely grave. They were also widely published. They remained on the internet for a not an insubstantial period of time.
The likelihood of harm is significant.
The defence of triviality fails.
The Plaintiff seeks compensatory damages, aggravated damages and costs.
The Plaintiff relied on the following:
The broadcasts remained on X for most of 2024, where they were readily accessible.
The extent of worldwide publication could be vast.
Many of those who speak or listen have their own podcasts and social media sites with thousands of followers.
The First Defendant urged the listeners to share and like the podcasts.
There is direct evidence of extensive publication, republication and grapevine material over a long period of time to a large audience.
An award of damages for non-economic loss in defamation proceedings serves three purposes: Carson v John Fairfax & The Sons Ltd [1993] HCA 31; (1993) 178 CLR 44 (‘Carson’) at 60-6. That is, to provide:
consolation for the personal distress and hurt caused to the person defamed;
reparation for the harm done to those persons both personally and (if relevant) to their business reputation; and
to provide vindication of their reputation.
The purposes overlap and the first two are often considered together. Vindication looks to the attitude of others to the applicant. The sum awarded must be at least the minimum necessary to signal to the public the vindication of the Plaintiff’s reputation.
The Court is to ensure there is an appropriate and rational relationship between the harm sustained by the applicant and amount awarded: s 34 of the Act.
The maximum amount that may be awarded for non-economic loss is presently $500,000 per s 35(1) of the Act, and the declaration of the Attorney General in NSW Gazette No 224 published on 6 June 2025.
The maximum damages amount is only to be awarded in a most serious case: s 35(2) of the Act.
If a Court finds for a Plaintiff in relation to more than one cause of action, damages may be assessed “in a single sum”: s 39 of the Act.
The Court is to disregard the malice or other state of mind of the Defendants at the time of publication except to the extent that it affects the harm sustained by the Plaintiff: s 36 of the Act.
The assessment of damages “involves an understanding of the nature and seriousness of the imputations and the [defendant’s] conduct”: Coyne v Citizen Finance Ltd [1991] HCA 10; (1991) 172 CLR 211, 241. To that end, relevant considerations to the assessment of damages include “the gravity of the libel, the social standing of the parties and the availability of alternative remedies” (Carson at 60), as well as the extent of the publication. As to that last matter, and the conduct of the defendant, a court may also take into account the fact that the defamatory statement “was never retracted, that no apology was ever offered to the [plaintiff], and that the statement had been persisted in to the end”: Herald & Weekly Times Ltd v McGregor [1928] HCA 36; (1928) 41 CLR 254, 263; Ali v Nationwide News Pty Ltd [2008] NSWCA 183 (‘Ali’) at [76].
Damage to the reputation of the defamed person need not be proved; rather, it is presumed: “the law presumes that some damage will flow in the ordinary course of things from the mere invasion of the plaintiff’s right and calls it general damage”: Andrews v John Fairfax & Sons Ltd (1980) 2 NSWLR 225, 258; Bristow v Adams [2012] NSWCA 166 at [20]-[31]. Notwithstanding the presumption that some damage will flow, evidence may be given of actual damage to the Plaintiff, undoubtedly that is because although some harm is presumed, “the extent of that harm is not”: Eppinga v Kalil [2023] NSWCA 287 at [100]. Of course, since changes to the Act in 2021, there is a need to consider the “serious harm” threshold: s 10A of the Act.
The award of damages must reflect the effect that the particular defamation had on the plaintiff: Rogers v Nationwide News Pty Limited [2003] HCA 52 at [69]. Further, it has been recognised that a person publishing defamatory material must take the plaintiff as they find them, with the consequence that it is appropriate to have regard to any particular sensitivities of the plaintiff: Ali at [77].
The Plaintiff relied on the following matters:
The documents, copied from X.com, exhibited to the Affidavit of Rodney Swift, establish that the broadcasts were heard by substantial audiences. The combined total audience across the three broadcasts exceeded 7000 persons, with combined live listeners exceeding 3000 (Affidavit of Rodney Swift paragraphs [50]-[56], Exhibit C).
The recordings remained available on the First Defendant’s X profile page after each live broadcast until about October 2024, where they could be viewed and shared.
I have had regard to the gravity of the imputations. There is no doubt that to allege that a person is a paedophile, and runs an organisation in which it is a practice, is an extremely serious criminal allegation. It was presented in a way that was unrelenting and vicious.
In French, McCallum J (as her Honour was then) took into account the likelihood that the tone and content of the publications was such that some might have dismissed them as irrational rants. The profanity, aggressive language and at times incoherent presentation used by Mr McKee is such that some people would have dismissed it as ranting. However, the imputations of paedophilia and child abuse are clear and repeated. They were not dismissed by the Defendants as unreliable rants. Indeed, the First Defendant commended Mr McKee’s research. As a broadcast, they could not be scrolled away from and they remained on the X space for more than seven months.
As McCallum J observed in French, the sheer brazenness of the allegations and the invocation of social obligations, of trying to weed out malevolent forces in the community, may have sounded compelling to some listeners, particularly with the endorsement of the First Defendant.
It is clear that allegations of paedophilia are the most serious allegation that can be made: Rodgers & Anor v Gooding [2023] QDC 115 (‘Rodgers v Gooding’); Grattan v Porter [2016] QDC 202 (‘Grattan v Porter’). In the present case, they were persistent and prolonged. It is a serious defamation alleging serious criminal conduct.
To be labelled a child abuser or paedophile is one of the worst possible things that could be said about someone. It is one of those statements which, despite denial, may have a tendency to persist and leave a lingering and permanent mark on a person’s reputation. It is extremely difficult, if not impossible to dispel this: Atholwood v Barrett [2004] QDC 505 (‘Atholwood v Barrett’).
In a similar vein, Gibson DCJ said in Northcoast Childrens Home Incorporated Trading as Child and Adolescent Specialist Programs and Accommodation (CASPA) v Martin [2014] NSWDC 125,
“[w]hile imputations of dishonesty, incompetence and neglect are serious issues, imputations of involvement in child abuse of any kind must be viewed as the most serious imputations capable of being made.”
In this case, the imputation in its context was one of violent and systematic child abuse, in breach of power and authority, and protected by powerful people, the most heinous kind of child abuse of all.
Because paedophilia most often occurs in secret, proof of its denial is almost impossible. There is almost nothing the Plaintiff can do to prove it not to be true to anyone that might hear it, other than to point to this judgment.
The “grapevine effect” is a metaphor to help explain the basis upon which general damages may be covered in defamation actions: Palmer Bruyn & Parker Pty Ltd v Parsons (2001) 208 CLR 388.
This is done because it is impossible to ascertain and establish the real damage caused by defamatory publications. It is impossible to track the scandal to know what quarters the poison may reach. It is impossible to weigh at all closely the compensation which will recompense any plaintiff for the insult offered or the pain of a false accusation.
The grapevine effect recognises that “the dissemination of defamatory material is rarely confined to those to whom the matter is immediately published” and that the “‘poison’ of a libel may spread beyond the immediate recipients of the initial publication”: Hoser v Pelley [No 3] [2023] VSCA 257 at [221]; Crampton v Nugawela [1996] NSWSC 651; (1996) 41 NSWLR 176, 194-195.
Accordingly, the assessment of compensatory damages must include consideration of the extent of the publication and the possibility of spreading along “the grapevine” and to appear at other places that might be unknown to the Plaintiff.
Where defamatory statements are published on the internet, the spread of information occurs easily and secretly. The distress that results when defamatory publications are made on social media, is because it is common knowledge that they spread easily, by the simple manipulation of mobile phones and computers. Their evil lies in the grapevine effect that stems from this kind of communication: Mickle v Farley [2013] NSWDC 295.
In O’Reilly v Edgar [2019] QSC 24, Justice Bradley noted, “The so called “grapevine” effect recognises that the dissemination of defamatory material is rarely confined to those to whom it is immediately published. The harm caused to reputation does not come to an end with the publication. Past observations that it is “impossible to track the scandal, to know what quarters the poison may reach” are apt to describe the effect of publication of defamatory matter on social media, where the defamation tends to spread very rapidly and might emerge “from its lurking place at some future date”, when again it has a “tendency to spread”.
A simple search term may revive a long dead publication.
What is emphasised particularly in that regard is that the award of damages must be sufficient not only to vindicate the Plaintiff at the time of publication and at the time of judgment but also into the future.
The Plaintiff makes a claim for aggravated damages, in accordance with the principles set out in Cerutti v Crestside Pty Ltd [2014] QCA 33 at [37]-[42] and Griniezakis v Morelas at [215]-[217].
The Plaintiff relies on:
the First Defendant’s failure and refusal to take down the broadcasts despite demand;
closely aligned to that, the First Defendant’s ongoing reticence to take responsibility for the broadcasts;
the First Defendants’ failure and refusal to apologise to the Plaintiff;
the First Defendant’s defence of contextual truth, which repeats the sting of the defamatory allegations;
the tone of the First Defendant’s cross-examination of the Plaintiff, including affected incredulity and mocking with respect to the Plaintiff’s evidence that he made calls to police because of fears about his safety; and
the First Defendant’s, albeit ineffective, efforts to prove the imputations to be substantially true.
As to the First Defendant’s failure to take responsibility, the First Defendant continues to blame those who run X for producing the broadcasts. He says this from the bar table. He did not give evidence. In any event, I do not accept his explanation. It is, as the Plaintiff submitted, inconsistent with his removal of the broadcasts from public view on X soon after being served with the Statement of Claim. I find that the First Defendant had control over the material remaining on X for the period that it did.
Aggravated damages are a form of general damages, given by way of compensation for injury to the plaintiff, which may be intangible, resulting from the circumstances and manner of the wrongdoing: State of New South Wales v Ibbett (2006) 229 CLR 638; [2006] HCA 57 at [31]. They are awarded for injury to the Plaintiff’s feelings caused by insult, humiliation and the like: Lamb v Cotogno [1987] HCA 47. Aggravated damages are compensatory to the Plaintiff where the First Defendant’s conduct was improper, unjustifiable or lacking in bona fides and aggravates the Plaintiff’s hurt feelings: Triggell v Pheeney [1951] HCA 23; (1951) 82 CLR 497 at 514.
They are awarded when the harm done by the wrongful act was aggravated by the manner in which the act was done: Uren v John Fairfax [1966] HCA 40.
Relevant conduct includes that of the First Defendant after publication (for example his conduct during litigation, his failure to apologise, and his failure to take down the broadcasts on request): KSMC Holdings Pty Ltd v Bowden [2020] NSWCA 28.
The “conventional approach” has been to not award a separate sum because “it is not a discrete head of damage”: Herald & Weekly Times Ltd v Popovic (2003) 9 VR 1; [2003] VSCA 161 at [385]; Nationwide News Pty Ltd v Rush [2020] FCAFC 115; (2020) 380 ALR 432 (‘Rush’) at [380] and, further, a separate award “would usually be difficult to assess”: Rush at [380] and the authorities there cited. However, in light of the statutory amendment, it is now the case that any award of aggravated damages is to be made separate to an award of damages for non-economic loss: s 36(2B) of the Act.
The maximum damages amount pursuant to s 35(1) of the Act may be exceeded where aggravated damages are warranted: s 36(2A) of the Act.
The Court must take care not to ‘double-count’ in compensating the Plaintiff. An award of aggravated damages must only be for the difference justified by the added conduct: State of New South Wales v Radford (2010) 79 NSWLR 327; [2010] NSWCA 276 at [95]-[96].
In this case, in consideration of s 36(2B) of the Act, and where aggravated damages are sought only against the First Defendant, but where non-economic loss damages are otherwise jointly and severally attributed to both Defendants, it is appropriate to make a separate award of aggravated damages against the First Defendant only.
It has been notable in this case that, unlike some of the cases to which I will come, for example French, there has been no admission of liability or concessions made about any appropriate award of damages. Indeed, the First Defendant unreasonably and without foundation contended that $25,000 in damages was beyond the pale, and no one spared the Plaintiff the “unhappy prospect” of facing the Defendants in Court.
The Plaintiff has had to obtain his vindication recorded in this judgment, but only with further aggravation. The First Defendant challenged all aspects of the Plaintiff’s case; the serious harm done by the broadcasts, the plaintiff’s evidence of harm, and he sought to propound useless defences. He was discourteous in his presentation and further sought to belittle the Plaintiff. This kind of “internet road rage” is an unfortunately common theme in cases of this kind.
The Plaintiff submitted that the following awards of damages are appropriate:
compensatory damages of $300,000 (for which both Defendants, as publisher, are jointly and severally liable); and
aggravated damages against the First Defendant of $80,000.
In support of his claim for damages, he relies on the following authorities which I will set out in some detail, mindful that both Defendants are self-represented and so that they understand the foundation for the award of damages:
In Martin v Najem, the matters complained of were so “sensational, abusive and profane” that they were not reproduced in the judgment. Similarly, the publishers were internet commentators. The defendant published a video about the plaintiff on Instagram, calling him a paedophile and a racist. The video contained abusive and profane language and an almost visceral hatred in the defendant’s tone of voice. The following day the defendant had published a second video repeating the imputations that the plaintiff was a paedophile by calling him a “pedo dog” and by calling him a racist. The defendant said that the plaintiff was the most hated person in the industry. At the end of this second video, the defendant posted a photoshopped picture of the plaintiff at Bondi Beach with the word “RACIST” superimposed over him.
Compelling evidence was given of the great harm done to the plaintiff. As a result, the defendant was deluged by posts from other Instagram users. The defendant began to publish a series of abusive messages about the plaintiff and his wife. Those further publications are relied upon for aggravated damages only. The defendant published a fourth video the following day. It was derogatory and highly offensive towards the plaintiff’s wife. Seeing her distress increased his hurt. The defendant also sent a direct message to the plaintiff saying he was “going to end [him]” and that he was a “racist dog” and that he was “going to destroy” him, such that he started to feel concerned about his safety. A further video was published which included a screenshot of that message. The plaintiff reported the publications to the police and sought to apply for an apprehended violence order against the defendant. He was deeply distressed and sought medical assistance. Since the plaintiff commenced the proceedings, he continued to receive negative and derogatory comments on his own Instagram account, repeating the allegations and attacking the plaintiff for having sued the defendant.
One Instagram account had around 20,000 followers. The second Instagram account had almost 1400 followers. The publications were available to a substantial audience.
The plaintiff relied upon the grapevine effect for both publications, a matter that may be inferred as the typical result of serious allegations made on social media, where the reach of a defamatory imputation is not limited to the immediate readership. The graver the imputation, the more likely it is to spread and to cause serious harm.
The matters remained on the site for perhaps only about 24 hours, although they “[P]ercolated and spread to a wide group of publishees that included friends of the plaintiff. There was direct evidence, in the form of posts, that persons not known to the plaintiff trolled and abused him as a result.”
As her Honour observed in the context of considering serious harm,
“The extreme nature of the allegations is an important factor. There are few more hated criminals in Australia than paedophiles. They are not even safe in gaol. To call a person a paedophile is at or near the top of the list of serious allegations.”
The manner of publication was a key feature. The defendant made a call to arms to his supporters.
The plaintiff received threats over a period of six months, which had a serious impact on the plaintiff’s health and wellbeing. The fact that it came “out of the blue”, where the plaintiff had never met the defendant, made it all the more frightening.
The Plaintiff was awarded $300,000, including aggravated damages.
In Rodgers v Gooding, the defendant published Facebook posts which called two plaintiffs “paedophiles”. It was visible for 90 minutes. The Court awarded $100,000 to each plaintiff in compensatory damages, and $40,000 and $25,000 respectively by way of aggravated damages.
Admissions were made by the defendant, default judgment on liability was entered and damages were assessed. The defendant did not engage with the damages assessment.
The parties were neighbours and were once friends. The neighbouring area set up a community safety Facebook page with a membership of between 4800 and 4900 people. Its primary purpose was to alert the residents to possible crimes in the neighbourhood.
The defendant posted the plaintiffs’ address and said they were paedophiles, that their child had been “touched” and that the plaintiffs had tried to get her six year old to go with them multiple times. The obvious outraged responses ensued.
About 90 minutes later, the defendant said her Facebook page had been hacked. Other members of the Facebook group, perhaps showing some incredulity at such a suggestion responded, including one post which said, “You put a post up about a paedophile and their apparent address. Gonna [sic] need a bit more explaining than “we got hacked”.” The statement that she had been hacked was demonstrably false. The post had already been saved as a screenshot reproduced, republished and disseminated to other members of the public, in a clear example of the grapevine effect in motion.
The consequences for the first and second plaintiffs were significant, being defamed so seriously in their local neighbourhood. The imputations were similarly serious.
The claim in that case for $100,000 reflected the seriousness of the defamatory imputations and the harm caused, and to vindicate each of the plaintiffs reputations, to compensate them for the hurt, distress and embarrassment that was caused as a result of the posts being made, to reflect the natural and probable extent of publication in the local area and finally, to convince any person to whom the defamatory imputations were published or republished of the baselessness of them.
Some other similar cases were referred to in Rodgers v Gooding. I have set them out for ease of reference.
In Newman v Whittington, the defendant defamed the plaintiff on 12 separate occasions in articles, on Facebook and on Twitter over a period of nearly two years, in retribution for something the plaintiff had published in a book. The defendant did not appear at the proceedings. The plaintiff was an accredited family dispute resolution practitioner. The defendant’s Facebook page was called “Child Abduction Recovery International”.
The imputations conveyed included that the plaintiff supports and sympathises with paedophiles, describing her as being among “the most disgusting paedophile sympathisers in Australia”. There were other serious allegations that she had committed fraud and was dishonest, that she has attacked women intent on protecting their sexually abused children, that she is a misogynist, has been convicted of domestic violence, and has falsely claimed to be a psychologist.
Damages for non-economic loss were assessed at $150,000 with aggravated damages awarded in the sum of $10,000.
In Griniezakis v Morelas, the applicant was the Archbishop of Australia and Primate of the Greek Orthodox Church in Australia and Oceania. The respondent was the publisher of a Greek-language website which purported to report on “Greek news from Greece and Australia. The respondent published four articles about the applicant on the website.
In relation to each of the articles, the respondent pleaded defences of honest opinion and statutory qualified privilege. In relation to the fourth article, he also pleaded a defence of justification to one imputation.
The website which contained the articles had more than 70,000 views. The readership of the articles was unclear.
The imputations generally conveyed were that the applicant was a fraud, had misappropriated money, had bribed for the appointment of his friends as bishops, and had accepted to cover up that a member of church was accused of raping and sexually harassing underage girls.
The Archbishop was offended by the characterisation of his charitable initiatives as being motivated by personal gain. He was disturbed by the language referring to him and the other clergy as “representatives of Satan” and “Diabolical men hiding their filth under their cassocks”.
Publications continued after an undertaking by the defendant to remove them.
The Court awarded $250,000 in non-economic damages and $50,000 in aggravated damages.
Whether or not a defendant will not have the means to satisfy any judgment debt is irrelevant to the assessment of quantum. This is a case in which the Court can, and should, give a judgment that achieves the object of vindicating the Plaintiff’s reputation.
All of the factors in this case call for a substantial award for each of the publications. There is little to distinguish the broadcasts in terms of the allegations made. One sum will be awarded for all three publications.
The Plaintiff is entitled to interest on the amount awarded for non-economic loss: MBP (SA) Pty Ltd v Gogic (1991) 171 CLR 657, 663-664; [1991] HCA 3; Metropolitan Meat Industry Board v Williams (1991) 24 NSWLR 54, 58-59. These principles were applied, in defamation proceedings, in Ryan v Premachandran [2009] NSWSC 1186 at [142].
The principles for interest awards are summarised in Amalgamated Television Services Pty Ltd v Marsden [2002] NSWCA 419 at [1540]. Interest rates on defamation awards tend to vary to take into account how the hurt decreases over time.
As I have not heard submissions, I will not quantify any interest. I invite submissions from the Parties in accordance with these Reasons.
I am satisfied that the Plaintiff has made out his case in respect of all three publications and that all of the Defendants’ defences must fail. There will be an award of damages and interest as stipulated.
I make the following orders:
Judgment and verdict for the Plaintiff against both Defendants by way of general compensatory damages in the sum of $235,000.
An award of $80,000 in aggravated damages against the First Defendant only.
Subject to order (5), the Defendants are to pay pre-judgment interest in accordance with the judgment.
Subject to order (5), the Defendants are to pay the Plaintiff’s costs of the proceedings as agreed or assessed.
The parties have liberty to apply within seven (7) days in respect of Orders (3) and (4), as to interest or for any special costs order or the revocation of any prior costs orders.
