What it does
The Wellington Park Regulations 2019 set out detailed operational rules for the care, control and management of Wellington Park under the Wellington Park Act 1993. Mechanically the instrument replaces the Wellington Park Regulations 2009 (Schedule 3) and comes into force on the day its making is notified in the Gazette (regulation 2; Schedule 3, Gazette notice 27 March 2019). It supplies definitions (regulation 3) used throughout the Act and regulations, prescribes a permit regime (Part 3, regs 33-42, Schedule 1), and creates a system of regulatory prohibitions, directions and enforcement powers for authorised officers (scattered through Part 2 and Part 4).
Key mechanical changes and rule‑sets created by the regulations include:
- Definitions and cross‑references (reg 3) tying in other statutes (for example, the Road Rules, the Traffic Act 1925, the National Parks and Reserves Management Act 2002 and the Nature Conservation Act 2002). These definitions determine the reach of prohibitions and powers (for example what counts as a vehicle, track, or possession).
- Detailed natural resource protections (regs 4-5), including offences against taking flora or fauna, using hunting equipment, or depositing pesticides; and separate controls on cutting equipment such as chainsaws (reg 4).
- Animal controls (regs 6-9) governing dogs, horses and other animals, with express exceptions for guide/hearing dogs and Commonwealth‑defined assistance animals (reg 6(7)).
- Traffic and access controls (regs 10-16): power to erect traffic/no‑access signs, close roads or vehicular tracks to some or all vehicles, and to enforce compliance with traffic signs (reg 10, 16). Bicycle use and bicycle tracks are separately regulated (reg 12).
- Camping, fires and fire safety (regs 18-23): camping restricted to places allowed by a management plan (reg 18), and a general ban on lighting fires except in designated fireplaces or with a permit (reg 21), with significant penalties for breaches.
