What it does
This instrument, titled Tariff Concession Revocation Order HS2007/578A, formally revokes an earlier Tariff Concession Order and substitutes a new one for the same class of goods. The operative delegation is stated at the top of the instrument: "Under Section 269SD(2) of the Customs Act 1901, I Robert Crawford a delegate of the Chief Executive Officer (a) revoke Tariff Concession Order Number 9708969 made on 05.01.98, in respect of the goods described in TABLE A below. This Revocation has effect from 01.01.07; and (b) make in its place the Tariff Concession Orders described in TABLE B." The instrument is signed and dated "Robert Crawford ... Dated 20 June 2007 Delegate of the Chief Executive Officer."
Mechanically, the instrument does three things:
- It revokes Tariff Concession Order (TCO) Number 9708969, originally made on 5 January 1998, in relation to the goods described in Table A. The revocation "has effect from 01.01.07" (the instrument’s stated effective date for the revocation).
- It creates new Tariff Concession Orders described in Table B that apply to the goods described in Column 1 of Table B.
- It declares that the goods in Column 1 of Table B "are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies."
The practical legal effects in the text are therefore confined to revoking one TCO and making another for substantially the same described goods, fixing the effective date for that change and identifying the Schedule 4 item that applies to the replacement TCO. The instrument does not itself state rates of duty or penalties; it links the described goods to an item in Part III of Schedule 4 to the Customs Tariff Act 1995 by reference (see the instrument's explicit wording). The tables contain the detailed commodity description and the eight-digit tariff classifications used by customs (Table A shows 8708.99.99; Table B shows 8708.80.99) and administrative references to the original and replacement TCOs (TC 9708969; TC 0614566) and operation dates ("Op. 10.10.97 - TC 9708969" in Table A and "Op. 01.01.07 - TC 0614566" in Table B).
