A delegate of the Chief Executive Officer revoked Tariff Concession Order (TCO) No. 9708969 and replaced it with a new TCO (No. 0614566).\n- The revocation takes effect from 1 January 2007. The instrument itself is dated 20 June 2007 and signed by the delegate (Robert Crawford).\n- The textual description of the goods is effectively the same in the old and new orders: specific parts for commercial motor vehicle suspension (spring hangers, torque rods, top pads, spring seats, transverse rod axle brackets, cross channels/lower shock brackets), with detailed physical and strength specifications for each part.\n- The mechanical change is that the tariff classification (Harmonized System code) for these parts moves from 8708.99.99 (old TCO) to 8708.80.99 (new TCO) and the Schedule 4 item number that applies to the goods is changed in the new order (Table B shows the item specified in Part III of Schedule 4 to the Customs Tariff Act 1995 identified in Column 2).\n\n**Who is affected**\n\n- Importers and customs brokers who bring into Australia the listed commercial motor-vehicle suspension parts. They must use the new TCO/tariff classification when lodging import declarations from the effective date.\n- Domestic firms that manufacture, supply or compete with those parts, because changes in tariff treatment can affect relative prices and competition.\n- The Australian Customs administration (and any other agency that enforces tariff concession rules), which must apply the new TCO and adjust processing and classification guidance.\n\n**Why it matters (practical consequences)**\n\n- Tariff classification and the Schedule 4 item determine whether a concessional or different rate of customs duty applies. Changing the HS code and Schedule 4 item can change the duty payable on these imported parts.\n- Importers will need to update commercial systems, customs entries and possibly re‑price contracts if duty rates or concession conditions change. There is an administrative compliance cost in updating paperwork and systems.\n- Revenue and competitive effects depend on the duty rates attached to the old and new classifications and the Schedule 4 concession item. If the new classification carries a different rate or different concession conditions, some parties will pay more duty, others less.\n\n**Official purpose claim and practical test**\n\n- The instrument is presented as a straight revocation and replacement; the stated mechanical effect is to map the described goods to a different tariff heading and Schedule 4 item (Table B). The official effect-claim is therefore administrative/re-classificatory.\n- Practical trade-offs and implementation issues to note:\n - Who pays: importers pay customs duties at whatever rate applies to the new classification and Schedule 4 item; government revenue may rise or fall accordingly (see Table B Column 2 for the applicable Schedule 4 item).\n - Who decides: the delegate of the CEO made the revocation under a statutory power (s269SD(2) of the Customs Act 1901); Customs then administers entries under the new TCO.\n - Behavioural change: importers and brokers will change the tariff code used on entry documentation; suppliers may reclassify products and may alter sourcing or pricing in response to duty effects.\n - Concentrated benefits / diffuse costs: benefits of a lower tariff or concessional classification would go to the importers of these specific parts (concentrated); any revenue cost to government would be dispersed. Conversely, raising duties would concentrate cost on those importers while distributing revenue gains.\n - Implementation risks: backdating (the revocation is effective from 01.01.07 though the instrument is dated 20.06.07) can create transitional compliance questions for shipments entered during the intervening period; misclassification risk if importers or Customs apply an incorrect HS code; and administrative burden in updating systems and advice.\n\n**Concrete references to the instrument**\n\n- Legal power used: section 269SD(2) of the Customs Act 1901 (as cited on the instrument).\n- Revoked order: TCO No. 9708969 (original operation date shown as 10.10.97 in Table A).\n- New order: TCO No. 0614566 (operation date shown as 01.01.07 in Table B).\n\nOverall, the instrument is an administrative reclassification of a narrowly defined set of vehicle suspension parts from one tariff heading and Schedule 4 item to another. That reclassification changes which tariff item and concession (if any) applies, producing direct effects on import entries, duty payable, and administrative compliance for importers and customs handlers."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
