What it does
The Registration of Deeds Regulations 2022 prescribe the mechanical and administrative procedures for lodging, registering and indexing documents under the Registration of Deeds Act 1935. They replace the 2012 regulations in substance but carry forward nearly identical formatting and lodgment instructions. The regulations do not create new rights to register documents; they specify how an applicant must present the application and any accompanying document to the Registrar for acceptance. Every requirement in regulation 4 is directed at the physical and formal attributes of the paper: single sided printing, A4 white paper of at least 80 gsm, margins between 10 and 20 millimetres, permanent black or blue ink, black ink only for plans, page numbering that indicates both the page number and total pages placed above any writing or plan, and stapling only as the permitted method of fastening. The application must be an original, dated, in English, and contain the full name and complete residential or workplace address of the applicant. Accompanying documents must also meet the same paper and ink specifications and additionally must list the full name and address of every witness and party, be signed or sealed by each, be identified as the annexure referenced in the application, and be dated.
Beyond formatting, regulation 5 ties each type of application to a prescribed form: Form 1 for an instrument, Form 2 for a judgment, Form 3 for a will or letters of administration, Form 4 for a certificate of satisfaction of a mortgage, Form 5 for a certificate of satisfaction of a judgment, Form 6 for a lis pendens, and Form 7 for vacation of a lis pendens. Every application must be accompanied by a lodgment form approved by the Registrar, though a single lodgment form can cover multiple documents that form one registrable transaction. The Registrar must accept a document that complies with the regulations but must refuse a document that is not stamped or endorsed as required by section 243(1) of the Duties Act 2001. A grandfathering provision in regulation 6(2) allows the Registrar to accept documents executed before the commencement of the 2012 regulations even if they do not comply with certain physical specifications: single sided printing, paper weight and colour, margins, black ink for plans, the address requirement for witnesses and parties, ink colour, page numbering, and stapling. No waiver is available for non compliance with the requirements that the document be in English, contain the full name of the applicant or of witnesses and parties, be an original, have signatures and seals, be dated, or be clearly legible and reproducible. Regulations 7, 8, 9 and 10 address registry records, the prescribed form for a memorial of letters patent under the Land Titles Act 1980, the indexing method, and the scope of copies provided to the public under section 43A(2) of the Act.
