Motor Vehicle Compensation Scheme 2025

The Scheme organises a set of compensatory subsidies for motor vehicle access and modification centred on four interlocking concepts: eligibility, need, Commission discretion, and conditions attached to the subsidised asset. Each is embedded in the Scheme’s text and shapes who receives help, what kind of help, and what constraints follow.

Eligible person

• The Scheme repeatedly conditions compensation on the applicant being an “eligible person”, a term the Scheme defines by reference to paragraphs 212(1)(a), (b) and (c) of the Act (s5 definition of eligible person). The instrument itself does not restate the Act’s content for those paragraphs, so eligibility under the Scheme is substantively governed by the Act’s criteria.

Need and functional tests

• Eligibility for modifying an existing vehicle (s7) or for an initial purchase (s10) is conditioned on functional incapacity: the person either cannot drive without driving or other modifications that enable safe driving, or cannot be driven without modification enabling safe and reasonably comfortable transport (ss7(1)(c), 10(1)(b)). For residents of a care institution there is an added gate: the person must be capable of leaving the care institution (ss7(1)(b), 10(1)(d)).

Recommendation and expert input

• A written recommendation from an approved program provider or an occupational therapist is a recurring prerequisite for eligibility (ss7(1)(f), 10(1)(e), 13(1)(b)). The Commission is permitted to request advice from those providers and from a qualified mechanic where relevant, and to take that advice into account when setting subsidy amounts (ss9, 12, 15).

Commission discretion and “reasonableness”

• The Scheme places broad evaluative power with the Commission. For example, the amount of any subsidy is repeatedly “such amount as the Commission considers is reasonable” (see ss8(1), 11(1), 14(1)). The Commission also decides whether, in all the circumstances, it is appropriate to grant compensation for modification instead of a vehicle purchase (s10(3)). The Commission “may” request and may “take into account” expert advice (ss9(1)-(2), 12(1)-(2), 15(1)-(2)).

Objective triggers and financial adjustments

• For replacement vehicles, the Scheme sets objective triggers: at least five years since last relevant compensation, at least 100,000 kilometres travelled since purchase or modification, or theft/destruction of the previous vehicle (s13(1)(a)). When determining subsidy amounts for initial purchases or replacements, the Commission is required to deduct trade-in value at arm’s length of the person’s existing or previous vehicle (ss11(1), 14(1)). Other enumerated factors to be considered include impairment nature, vehicle and accessory costs, ability to fit required devices, access to alternative providers, second hand vehicle life and kilometres, and insurer write-off payments where applicable (ss8(1), 11(1)(a)-(h), 14(1)(a)-(g)).

Conditions on use and disposal

• The Scheme takes a property-control approach to subsidised vehicles. The recipient is taken to be the legal owner (s20(1)(a)), but the vehicle cannot be sold, transferred, encumbered or otherwise dealt with without the Commonwealth’s written agreement (s20(1)(b)). It is also a condition that the person maintain the vehicle in good working order and, where insurer payments arise after damage, apply those payments to repair or replacement (s20(1)(c)-(d)). The Scheme cross-references the Act’s offence for dealing with goods without Commission consent (s20 note citing s408 of the Act).

Exclusions and interaction with other assistance

• The Scheme bars eligibility for a purchase subsidy if the person has received a payment, other assistance, or a motor vehicle under any other law, contract, agreement, or understanding within five years prior to making the claim (s18(1)). This creates a temporal exclusion designed to prevent duplicative or proximate assistance from other programs.

Transitional carry-over

• Modifications and vehicles provided under the former 2015 Scheme are treated as if received under the new Scheme, and processes commenced under the former scheme but not determined are continued under the new Scheme (Schedule 1, items 2-3). This preserves entitlements and continuity for existing recipients.

These concepts collectively structure the Scheme: need and clinical recommendation gate access; the Commission exercises evaluative and monetary discretion; objective triggers and financial offsets limit recurring claims and reduce duplication; and post-subsidy conditions and Act cross‑references constrain recipient dealing with the vehicle.

The Scheme targets a defined cohort and several secondary parties whose rights or obligations are altered by the Scheme’s mechanics.

Primary recipients

• Eligible persons, defined as those to whom paragraphs 212(1)(a), (b) and (c) of the Act apply, are the only people who can receive compensation under the Scheme (s5 definition of eligible person; s7(1)(a) and s10(1)(a)). The Scheme itself does not restate those Act provisions; practitioners must look to the Act for the statutory definition of eligible person.

People resident in care institutions

• The Scheme contains specific conditions for persons who are residents of a care institution (see definition of care institution at s5 and the Schedule 2 amendment tying paragraph (a) to the Aged Care Act 2024). If a person is a resident of such an institution they must be “capable of leaving the care institution” to be eligible for modification or initial vehicle purchase subsidies (ss7(1)(b), 10(1)(d)). This potentially excludes residents who cannot reasonably leave the institution, and ties eligibility to functional independence to a degree.

Family members and co-owners with interests in vehicles

• Where the applicant has an interest in a motor vehicle, any other person with an interest must agree to the proposed modifications (s7(1)(e)). The Scheme’s definition of interest expressly includes joint interests or other interests but excludes an interest as a mortgagee (s5 definition of interest). That exclusion has a practical consequence for financiers and secured parties: the Scheme does not treat a mortgagee’s interest as a relevant “other person” whose agreement is required under s7(1)(e).

Approved program providers and occupational therapists

• These professionals provide the written recommendations required for eligibility and may be asked by the Commission to provide advice on types of devices, modifications or vehicles (ss7(1)(f), 9(1)-(2), 12(1)-(2), 15(1)-(2)). Their assessments will materially affect Commission decisions about both eligibility and the reasonable quantum of subsidy.

Qualified mechanics

• For replacement vehicle eligibility, a “qualified mechanic” must consider the previous vehicle unsafe, taking into account maintenance and service history and condition (s13(1)(c)). This allocates a role to mechanics in certifying safety as a precondition for replacement subsidies.

Insurers and financiers

• The Scheme interacts with insurers through the calculation of trade-in values and write-off payments. When a person’s vehicle was stolen or destroyed through no fault of the person, the full amount of the insurer’s write-off payment is relevant to the subsidy calculation (ss11(1)(g), 14(1)(g)). For financed vehicles, the legal ownership and the Scheme’s restriction on dealing with the vehicle (s20(1)(b)) may affect mortgagees and financiers. The definition of interest excludes mortgagees (s5), but the instrument does not itself specify how existing security interests are to be dealt with beyond the Commonwealth’s written agreement requirement.

The Commission and Commonwealth

• Operationally, the Commission makes eligibility and quantum decisions and can require and take advice into account (ss7, 8, 9, 11-15). The Commonwealth retains the power to consent to disposition or encumbrance of the vehicle via the Commission’s role in issuing written agreement under s20(1)(b). The Commission therefore controls both access to subsidies and dispositional constraints.

Other schemes and providers

• Persons who have received vehicle assistance under any other law or contract within five years are excluded from purchase subsidies under this Scheme (s18(1)). That implicates other public programs, insurer payments, private settlements and contractual arrangements that deliver motor vehicles or vehicle purchase assistance.

Transitional affectees

• Recipients and ongoing processes under the 2015 Scheme are carried forward by Schedule 1, which treats modifications and vehicles received under the former scheme as received under the new Scheme and continues commenced processes (Schedule 1 items 2-3).

In sum, the Scheme primarily affects injured or disabled veterans who qualify as eligible persons under the Act, but it also materially involves occupational therapists and approved program providers who supply assessments, qualified mechanics for safety certification in the replacement context, insurers and financiers through value deductions and constraints on dealing, and the Commission and Commonwealth as decision makers and gatekeepers.

The Scheme sets out duties for applicants and rights and controls exercised by the Commission and the Commonwealth. Below are the principal duties, rights and their legal mechanisms with section references.

Applicant duties

• Obtain a written recommendation that the applicant would derive direct benefit from driving or being driven in a motor vehicle (ss7(1)(f), 10(1)(e), 13(1)(b)). The recommendation must come from an approved program provider or an occupational therapist.
• Where the applicant has an interest in a vehicle that is to be modified, secure agreement from any other person with an interest in the vehicle to the proposed modification (s7(1)(e)). The Scheme’s definition of interest excludes a mortgagee (s5).
• For purchase subsidies, establish that modification of an existing vehicle is not possible or not practicable, or that the person does not own a vehicle (s10(1)(c)).
• For replacement claims, satisfy one of the objective conditions: at least five years since last compensation for a motor vehicle, previous motor vehicle travelled at least 100,000 km since purchase or modification, or previous vehicle stolen/destroyed through no fault of the person (s13(1)(a)).
• If the applicant receives a subsidy to purchase a motor vehicle, register the vehicle and comprehensively insure it to full market value (s19(1)(a)-(b)). Maintain the vehicle in good working order and, where insurance payments arise for damage, apply the payments toward repair or replacement (s20(1)(c)-(d)). The recipient is otherwise wholly responsible for garaging, maintenance, insurance, registration and operation of the vehicle, subject to s16 (s21(1)).
• If the recipient receives compensation under section 16 for additional insurance pertaining only to modifications, or for repairs to modifications, the recipient is entitled to the cost of the additional insurance or the cost of repairs respectively (ss16-17).

Commission duties and decision rights

• Determine whether a person is eligible, i.e. be satisfied that the criteria in ss7(1) or 10(1) or 13(1) are met (ss7(1), 10(1), 13(1)). The Commission is the central gatekeeper.
• Determine the amount of any subsidy. The Scheme repeatedly gives the Commission authority to set “such amount as the Commission considers is reasonable” while listing factors the Commission should take into account (ss8(1), 11(1), 14(1)). Those factors include nature of impairment, proposed devices, vehicle and accessory costs, alternative providers, and trade-in or write-off values.
• The Commission may request and take into account advice from an approved program provider, occupational therapist, or qualified mechanic to ensure the vehicle, devices and modifications are appropriate and achieved at minimum cost (ss9, 12, 15).
• The Commission may decide whether modification is an appropriate form of compensation instead of a purchase subsidy even where the applicant otherwise meets eligibility for purchase (s10(3)).

Commonwealth rights and controls

• The Commonwealth, through the Commission, retains control over disposal or encumbrance of the vehicle by requiring written agreement for sale, transfer, encumbrance or other dealing with the vehicle (s20(1)(b)). The Scheme notes that s408 of the Act is an offence limiting a person’s ability to deal with goods provided under the Act without the Commission’s consent (s20 note).

Financial adjustment rules (applicant duty/right interaction)

• Where a person receives a purchase or replacement subsidy, the Commission must deduct the trade-in value at arm’s length of the person’s existing or previous vehicle when determining subsidy amount (ss11(1), 14(1)). The Commission must also consider insurer write-off payments where the vehicle was stolen or destroyed (ss11(1)(g), 14(1)(g)). If a person sold or disposed of a vehicle within 12 months before making the claim, the trade-in value for which it was sold will be deducted (s11(1)(h)). These deductions reduce the monetary subsidy; they are statutory mechanics that allocate the cost between the Scheme and the recipient.

Exclusions and limitations on entitlement

• The Scheme bars purchase subsidy eligibility where the person received a motor vehicle or a payment or other assistance for purchase under any other law, contract, agreement or understanding within 5 years before making the claim (s18(1)). This is an express exclusionary duty the applicant must self‑assess and disclose.

Transitional rights

• Recipients of modifications and vehicles under the former 2015 Scheme retain the status of having received those items under the new Scheme for purposes of future eligibility and calculations; processes commenced under the former scheme but not determined continue under the new Scheme (Schedule 1 items 2-3).

In practical terms, applicants have rights to assessable compensation subject to satisfying evidentiary and procedural duties, and the Commission has broad evaluative discretion to grant, quantify and condition subsidies. The Commonwealth retains post-grant property control through the requirement for written agreement before dealing with the vehicle and by referencing the Act’s offence provision.

The Scheme itself contains limited express penalty provisions. Enforcement mechanisms are principally indirect, relying on contractual-like conditions attached to the subsidies and on cross-references to offence provisions in the Act. Below are the concrete enforcement features and potential sanction pathways visible in the instrument.

Express penalty references

• The instrument explicitly notes that s408 of the Act is an offence provision that limits a person’s ability to deal with goods provided under the Act without the Commission’s consent (s20 note referring to s408 of the Act). The Scheme does not reproduce s408, but cross-references it as relevant to the Scheme’s restriction on sale, transfer, encumbrance or other dealing without Commonwealth written agreement (s20(1)(b)). This creates an enforcement link: unauthorised dealings may attract the Act’s offence provisions.

Conditions with enforceable consequences

• The Scheme attaches conditions to subsidies that function as enforceable requirements. Key examples include:
  • The recipient must register and comprehensively insure the motor vehicle to its full market value (s19(1)(a)-(b)). Failure to comply may affect entitlement and expose the recipient to remedial action under the Act or the Scheme’s administrative procedures, and could be relevant to off‑scheme conduct such as insurer claims and s408 enforcement.
  • The recipient must maintain the motor vehicle in good working order and apply insurer payments towards repair or replacement (s20(1)(c)-(d)). These conditions create ongoing obligations; non-compliance could be grounds for Commission action.
  • The motor vehicle cannot be sold or otherwise dealt with without written Commonwealth agreement (s20(1)(b)). That requirement is backed by the Act’s offence provision noted above.

Deductive financial mechanisms as indirect enforcement

• The Scheme reduces subsidy amounts by deducting trade-in value at arm’s length (ss11(1), 14(1)) and by offsetting insurer write-off payments (ss11(1)(g), 14(1)(g)). These mechanisms enforce financial accountability and reduce double recovery. They are self-contained statutory rules rather than criminal sanctions, but they function to enforce the Scheme’s fiscal integrity.

Discretionary controls that shape compliance

• Because the Commission holds broad discretion over eligibility and amount, it controls compliance by approving or refusing subsidies and by conditioning approvals on written recommendations, mechanic assessments, and agreement from other persons with interests in an affected vehicle (ss7, 9, 12, 15). The Commission’s decisions therefore operate as the routine enforcement instrument: denial of subsidy is the primary practical sanction for non‑compliance with eligibility prerequisites.

Transitional carry-over and enforcement continuity

• The transitional provisions treat benefits and processes under the former 2015 Scheme as having occurred under the new Scheme (Schedule 1 items 2-3). This prevents recipients who previously received modifications or vehicles from losing their status and avoids retrospective clawback under the new Scheme’s rules. The transitional approach reduces enforcement complexity for pre-existing arrangements.

Gaps and implementation enforcement risks

• The Scheme does not set out a detailed enforcement regimen such as explicit administrative penalties, repayment schedules, adjudication appeal rights within the Scheme text, or precise timeframes for Commission decisions. The lack of those procedural prescriptions concentrates enforcement power in the Commission and routes potential sanctioning to the Act’s broader enforcement architecture (not reproduced in the instrument). Practitioners should therefore expect enforcement to be exercised within the Act’s wider administrative and criminal framework, and must consult the Act for specific offence provisions, procedural remedies and appeal routes.

In summary, the Scheme enforces its rules primarily by conditioning subsidies, creating statutory deductions and offsets that reduce payments, and cross-referencing the Act’s offence provision for dealing with goods without consent. The Commission’s discretion over eligibility and amount is the routine regulatory lever. The instrument leaves detailed procedural enforcement mechanisms and specific criminal penalties to the Act itself.

The Scheme is deliberately interlaced with the Military Rehabilitation and Compensation Act 2004 (the Act) and touches other statutory and contractual regimes through cross-references and exclusion rules. The instrument’s own text contains a number of explicit interactions and implied cross-system effects.

Authority and definitional cross-reference to the Act

• The instrument is made under subsection 212(1) of the Act (s3). Several key terms are defined in the Act and incorporated by reference into the Scheme, including approved program provider (s5 note referencing section 41 of the Act) and Commission (s5 note referencing section 5 of the Act). The Scheme therefore operates as a subordinate instrument under the Act and relies on the Act for foundational legal constructs such as who qualifies as an eligible person (s5).

Offence provisions in the Act

• The Scheme refers to s408 of the Act as limiting dealing with goods provided under the Act, and notes that this offence provision is relevant to s20(1)(b) (s20 note). This binds the Scheme to the Act’s criminal enforcement architecture where dealing with subsidised goods occurs without the Commission’s consent.

Interaction with Aged Care Act 2024

• The definition of care institution in s5 includes “a residential care home (within the meaning of section 10 of the Aged Care Act 2024)” and Schedule 2 substitutes paragraph (a) to the same effect. Schedule 2 only commences at the same time as the Aged Care Act 2024 commences (s2(b)). Thus eligibility for residents of care institutions depends on Aged Care Act definitions and commencement timing, linking the Scheme’s coverage for those residents to another statute’s operational timeline and definitional framework.

Overlap with other assistance schemes and contracts

• The Scheme expressly excludes eligibility for a purchase subsidy where the person has received a motor vehicle or a payment or any other form of assistance for purchase under any other law, contract, agreement or understanding within 5 years before making the claim (s18(1)). This creates a statutory interaction with any other public benefits, insurer settlements, contractual arrangements or private agreements that provide motor vehicle assistance within that five-year window. Practically, cross-program checks and disclosure obligations will be necessary.

Insurance law and insurer interactions

• The calculation of subsidy amounts requires attention to insurer write-off payments when vehicles are stolen or destroyed through no fault of the person, as the full insurer write-off may be relevant to the Commission’s calculation (ss11(1)(g), 14(1)(g)). The Scheme also makes recipients responsible for comprehensive insurance of purchased vehicles to full market value (s19(1)(b)). These rules create an interface with private insurer policies, claims processes, and insurer valuations.

Property and secured finance regimes

• The instrument’s definition of interest excludes interest as a mortgagee (s5). The Scheme requires agreement of other persons with an interest in a vehicle before modification (s7(1)(e)), but mortgagee interests are excluded from the definition of interest. The Scheme also prevents sale, transfer or encumbrance of subsidised vehicles without Commonwealth written agreement (s20(1)(b)). Together, these provisions interact with secured finance structures and may affect lending practices or require lenders and borrowers to negotiate the Commission’s consent when vehicles are subject to security interests, although the exclusion of mortgagee interests suggests the Scheme does not treat mortgagees as the class of “other person” whose agreement is required when modifications are proposed (s5, s7(1)(e)).

Administrative law and procedural review

• The Commission is given discretionary powers in numerous places (see ss7, 8, 11, 14). While the instrument does not itself set out appeal or review processes, decisions by the Commission will exist within the Act’s wider administrative framework and thus will interact with administrative-law principles and any statutory review mechanisms the Act provides. The Scheme does not reproduce those mechanisms, so practitioners must consult the Act for specific review or appeal rights.

Transitional continuity with former scheme

• Schedule 1 preserves processes and benefits under the former Motor Vehicle Compensation Scheme 2015 by deeming proceedings commenced under the former scheme to continue under the new Scheme and by treating prior modifications and vehicles as received/previous for the new Scheme’s purposes (Schedule 1 items 2-3). This reduces legal friction between the old and new instruments.

In sum, the Scheme functions as a subordinate instrument anchored in the Act and interacts materially with the Aged Care Act 2024 for definitional purposes, with insurer valuations and private insurance arrangements for financial offsets and conditions, with other benefit schemes and private settlements through its five-year exclusion, and with secured finance via its treatment of “interest” and constraints on dealing. It leaves procedural enforcement, offences and administrative review to the Act itself.

The instrument itself is presented as a replacement for the earlier Motor Vehicle Compensation Scheme 2015 and contains an internal amendment schedule and transitional provisions. The Scheme’s amendment history as recorded in the instrument consists principally of the following entries.

Repeal of former scheme

• The instrument repeals the Motor Vehicle Compensation Scheme 2015 (Instrument 2015 No. MRCC 20) (s4). The repeal is explicit and unconditional in s4.

Transitional carry-forward

• To smooth the transition from the 2015 Scheme to the 2025 Scheme, Schedule 1 contains transitional provisions:
  • Processes commenced under the former scheme but not determined before the commencement day are taken to have been commenced under the new Scheme (Schedule 1 item 2(1)). This preserves in-flight applications.
  • Driving or other modifications and motor vehicles received under the former scheme are taken to have been received under the new Scheme for the purposes of the new Scheme (Schedule 1 items 3(1)-(2)), thereby treating prior benefits as “previous motor vehicle” or as modifications received under the new regime.

Commencement staging and linked amendments

• The instrument sets out staged commencement (s2). Parts 1 and 2 and Schedule 1 commence the day after registration; Schedule 2 commences at the same time as the Aged Care Act 2024 (s2). Schedule 2 contains an amendment to subsection 5(1) definition of care institution, substituting paragraph (a) to refer to residential care home as defined in section 10 of the Aged Care Act 2024 (Schedule 2 item 1). This amendment is conditional on the Aged Care Act’s commencement and aligns the Scheme’s care-institution definition to the longer-term statutory framework.

Internal duplicates and consolidation

• The text presented includes duplicated blocks (for instance, Part 1 repeated, sections repeated). Those duplications appear clerical in the provided instrument but do not on their face alter substantive content beyond repetition. Practitioners should rely on the operative sections as numbered and the schedules for changes to prior instruments.

No other express in-scheme amendments of the Scheme are listed beyond the repeal of the 2015 instrument, the transitional provisions, and the Schedule 2 substitution referencing the Aged Care Act 2024. The instrument therefore functions as a consolidated replacement with transition rules rather than as an amending instrument that iteratively modifies the 2015 Scheme.

For practitioners tracking change, the practical amendment history to date is this 2025 instrument that repeals the 2015 Scheme and carries forward prior recipients and pending processes, while aligning the care institution definition to the Aged Care Act 2024 when that Act commences.

The instrument itself does not record any litigation history. It is a statutory instrument replacing the Motor Vehicle Compensation Scheme 2015 and contains no case citations or references to decisions. Consequently, there are no proceedings, appellate determinations, or judgments mentioned in the text of the Scheme.

However, the Scheme creates several legal loci where disputes or litigation could arise, visible from its structure and the powers it confers:

• Discretion and reasonableness. The Commission determines subsidies as “such amount as the Commission considers is reasonable” in multiple provisions (ss8(1), 11(1), 14(1)). Those broad evaluative phrases typically give rise to disputes about the scope and exercise of discretion, especially where applicants and the Commission disagree on valuation inputs (for example, trade-in value, assessment of appropriate vehicle type or accessory necessity). The instrument does not itself set a procedural appeal path; contestation over Commission decisions will therefore engage the Act’s broader administrative and review framework.
• Eligibility determinations tied to clinical recommendations. Eligibility depends on written recommendations from approved program providers or occupational therapists (ss7(1)(f), 10(1)(e), 13(1)(b)). Disputes may arise concerning the sufficiency or content of those recommendations, whether they meet the Scheme’s “satisfied on reasonable grounds” formulation, or whether the Commission lawfully relied on contrary advice when determining eligibility or subsidy quantum.
• Treatment of trade-in values and insurer write-off payments. The statutory requirement to deduct arm’s length trade-in value and to take insurer write-off payments into account (ss11(1)(g), 14(1)(g), 11(1)(h)) creates potential conflict when applicants dispute the valuation or the Commission’s valuation methodology. Such valuation disputes can be both factual and legal.
• Interaction with other assistance and 5-year exclusion. Section 18(1) creates a temporal exclusion where the applicant received assistance under any other law, contract, agreement or understanding within 5 years. Disputes can emerge over what counts as “any other... assistance” or when the five-year period runs, especially where private settlements, contractual benefits or other public aids are involved.
• Property and dealing restrictions. The Scheme conditions vehicle deals on Commonwealth written agreement and references s408 of the Act as an offence for unauthorised dealing (s20 note). Disputes could concern the validity of dealings, the scope of the Commission’s consent power, or whether a particular dealing falls within the prohibited category.

Because the Scheme is subordinate to the Act, litigation about any of these points will be litigated within the Act’s statutory regime and general administrative law. The instrument itself does not provide a litigation history or indicate prior judicial interpretation; practitioners should therefore treat the Scheme as newly operative and subject to future judicial development on questions of discretion, valuation, and interaction with other benefits or contractual arrangements.

This Scheme contains several specific provisions and textual features that produce traps or unexpected consequences if not noticed. Below are concrete “gotchas” that advisers must flag to claimants, clinicians and funders, with section references.

1. “Eligible person” is defined by the Act, not the Scheme

• The Scheme requires the applicant to be an “eligible person” as defined in paragraphs 212(1)(a), (b) and (c) of the Act (s5). The Scheme does not provide the substantive eligibility test itself. Practitioners must check the Act before assuming entitlement.

2. Care institution residents must be capable of leaving

• If an applicant is resident in a care institution, the Scheme requires the person to be capable of leaving the institution (ss7(1)(b), 10(1)(d)). Being resident is not itself disqualifying; functional ability to leave is a specific gating condition that may exclude many long-term institutional residents.

3. Mortgagees are excluded from “other persons with an interest”

• The Scheme requires that if the applicant has an interest in a motor vehicle, any other person with an interest must agree to the proposed modification (s7(1)(e)). However the definition of “interest” excludes interest as a mortgagee (s5). That means a mortgagee’s interest is not treated as triggering the agreement requirement under s7(1)(e). Lenders and secured parties nevertheless remain affected by the Scheme’s broader restriction on dealing with subsidised vehicles (s20(1)(b)), so financing arrangements deserve careful attention.

4. Commission discretion is wide and “reasonableness” is the standard for subsidy quantum

• The amount of a subsidy is repeatedly set as “such amount as the Commission considers is reasonable” (see ss8(1), 11(1), 14(1)). The Commission can take advice into account but is not bound by it. Applicants should expect variability and be prepared to supply robust evidence on costs, alternatives and necessity of devices or vehicle types.

5. Trade-in and recent-sale deductions reduce subsidy

• When computing a purchase subsidy the Commission deducts the arm’s length trade-in value of the applicant’s existing vehicle. If a vehicle was sold or disposed of within 12 months before making a claim, the actual arm’s length trade-in value for which it was sold will be deducted (s11(1)(h)). Claimants who have recently sold a vehicle should anticipate the sale proceeds will reduce the subsidy, including where the sale was to a related party.

6. Full insurer write-off amounts can be offset against subsidy

• If the applicant’s existing vehicle was stolen or destroyed through no fault of the person, the full amount of the insurer’s write-off payment is a relevant offset in determining the subsidy (ss11(1)(g), 14(1)(g)). Applicants receiving insurer write-offs will need to declare them and expect the Commission to account for them.

7. Five-year exclusion for other motor vehicle assistance

• A person is not eligible for a purchase subsidy if they have received a payment, other assistance, or a motor vehicle under any other law, contract, agreement or understanding within five years before making the claim (s18(1)). This is broad and may catch private settlements or family-provided assistance. Applicants must disclose such assistance or risk exclusion.

8. Replacement triggers are objective but require mechanic certification

• To be eligible for a replacement vehicle, the applicant must meet one of the objective thresholds (s13(1)(a)) and also obtain a qualified mechanic’s view that the previous vehicle is unsafe, taking into account maintenance, service history and condition (s13(1)(c)). A vehicle may reach 100,000 km but still be considered safe; conversely the mechanic’s assessment is a discrete precondition, not merely advisory.

9. Recipient is “taken to be the legal owner” but cannot deal without Commonwealth consent

• The recipient is treated as the legal owner (s20(1)(a)), but s20(1)(b) prohibits sale, transfer, encumbrance or other dealing without the Commonwealth’s written agreement. This combination creates a constrained ownership situation for recipients, and the Scheme links it to s408 of the Act. Buyers, brokers and financiers seeking to take security in such vehicles should be aware of that control and seek Commission consent.

10. Ongoing operating costs are on the recipient

• Subject to s16 (which covers insurance relating to modifications and repair of modifications), the recipient is wholly responsible for garaging, maintenance, insurance, registration and operation of the vehicle (s21(1)). The Scheme does not provide ongoing operational subsidies.

11. Transitional carry-over may alter replacement timing

• Vehicles and modifications received under the former 2015 Scheme are taken to have been received under the new Scheme and are treated as “previous motor vehicle” or modifications for purposes of future eligibility (Schedule 1 items 3(1)-(2)). That affects timing for replacement claims (for example, whether the five‑year clock has started) and may have unintended consequences for recipients depending on their history under the former scheme.

12. No explicit monetary caps or decision timeframes

• The Scheme contains no fixed monetary caps or guaranteed decision timeframes. The Commission’s discretion therefore determines both the size and timing of payments in practice. Applicants should therefore engage early, provide thorough evidence on costs and alternatives, and plan for uncertainty.

These “gotchas” create practical traps across valuation, timing, disclosure of other assistance, institutional residence, ownership and financing. Advisers should treat the Scheme’s discretionary structures and statutory offsets as central to claim strategy.

This section sets out a practical compliance checklist and step-by-step actions, mapped to the Scheme’s substantive provisions, that applicants, clinicians, allied service providers and advisers should follow to maximise a lawful and well-supported claim.

1. Confirm statutory eligibility under the Act

• Before preparing an application, confirm that the person is an “eligible person” within paragraphs 212(1)(a)-(c) of the Military Rehabilitation and Compensation Act 2004. The Scheme (s5) refers to that Act for the base eligibility test. Do not assume Scheme text substitutes for Act criteria.

2. Establish functional need and care-institution status

• Check whether the person needs modifications to drive safely or to be transported safely and in reasonable comfort (ss7(1)(c), 10(1)(b)). If the person is resident in a care institution, confirm they are capable of leaving the institution (ss7(1)(b), 10(1)(d)). Prepare objective functional assessments or mobility statements to evidence capability.

3. Obtain written recommendation from an approved provider

• Secure a written recommendation from an approved program provider or an occupational therapist stating that, on reasonable grounds, the person would derive direct benefit from driving or being driven in a motor vehicle (ss7(1)(f), 10(1)(e), 13(1)(b)). Ensure the recommendation addresses physical and mental health benefits and current level of mobility as the Scheme explicitly asks for those considerations.

4. Where modification is proposed, get consent of other persons with an interest

• If the applicant has an interest in a vehicle that is to be modified, identify any other person with an interest and obtain their agreement to the proposed modifications (s7(1)(d)-(e)). Remember the Scheme’s definition excludes mortgagee interest (s5), but consider lenders’ practical expectations and seek to document communications with financiers to avoid later dispute.

5. Prepare valuation and trade-in documentation

• For purchase or replacement claims, gather evidence of the arm’s length trade-in value of any existing or previous vehicle. If the vehicle was sold or disposed of in the 12 months before making the claim, obtain the sale document to show the arm’s length trade-in value used in s11(1)(h). If the vehicle was stolen or destroyed and an insurer paid a write-off, obtain the insurer’s write-off documentation to show the quantum for s11(1)(g) or s14(1)(g).

6. For replacement claims obtain mechanics’ report

• If applying for a replacement vehicle under s13, obtain a qualified mechanic’s report stating the previous vehicle is unsafe, with references to maintenance and service history and the vehicle’s condition (s13(1)(c)). Ensure the mechanic’s credentials and report are documented.

7. Document alternative providers and cost-effectiveness

• Prepare comparative cost information on proposed driving devices, modifications, and alternative suitable vehicles, and document alternative providers’ accessibility and cost-effectiveness (ss8(1)(c)-(d), 11(1)(d), 14(1)(d), 8(1)(d)). The Commission is directed to consider availability and cost-effectiveness.

8. Disclose other assistance and transactions within five years

• Fully disclose any motor vehicle assistance, payments, motor vehicles, agreements or arrangements under any other law, contract, or understanding received within five years of the claim (s18(1)). If a sale or disposal occurred within 12 months, disclose sale value and circumstances to properly account for s11(1)(h).

9. Prepare evidence on accessory and modification necessity

• For purchases, provide evidence of accessories reasonably required and the vehicle’s ability to be fitted with necessary driving devices or modifications (ss11(1)(c), 11(1)(e), 14(1)(c)-(e)). If the applicant proposes a second-hand vehicle, provide kilometre history and estimated remaining life (ss11(1)(f), 14(1)(f)).

10. Ensure insurance and registration compliance after grant

• If the Commission grants a purchase subsidy, register the vehicle and obtain comprehensive insurance to full market value as required by s19(1). Maintain records of registration, insurance policies, premiums and claims because these are continuing conditions of the subsidy (s20(1)(c)-(d), s21(1)). If the insurance company pays out for damage, apply the payment to repair or replacement as required under s20(1)(d).

11. Keep maintenance and service records

• Because the recipient must maintain the vehicle in good working order (s20(1)(c)) and a mechanic’s assessment is required for replacements (s13(1)(c)), keep up-to-date maintenance and service histories. Those records are relevant to both ongoing compliance and future replacement eligibility.

12. Plan for funding shortfalls

• Be aware that the Commission deducts trade-in or write-off values from subsidy calculations (ss11(1), 14(1)) and that recipients are wholly responsible for operating costs except where s16 applies. Budget accordingly and provide evidence of need if full funding is sought.

13. Seek Commission advice where appropriate

• If there is doubt about the type of devices, modifications, or vehicle appropriate at minimum cost, anticipate that the Commission may request advice from an approved program provider or occupational therapist or a qualified mechanic (ss9, 12, 15). Supply robust supporting documentation proactively to reduce the likelihood of protracted back-and-forth.

14. Retain records and contemporaneous documentation

• Given the Commission’s discretion and the potential for valuation disagreements, keep all contemporaneous quotes, recommender reports, mechanic reports, insurer correspondence and sale documents. These documents support accurate computation of deductions and help in any review process under the Act.

15. Anticipate constraints on disposal and seek Commonwealth written agreement where needed

• Because the subsidised vehicle cannot be sold, transferred, encumbered or otherwise dealt with without the Commonwealth’s written agreement (s20(1)(b)), seek written permission well before any planned transfer or financing event that would affect the vehicle. Factor potential delays into any financing or estate planning.

16. If a case is borderline, consider early engagement with legal or administrative advice

• Where the Commission’s exercise of discretion on quantum, trade-in valuation or eligibility is likely contested, plan for administrative review or other remedies available under the Act. The Scheme itself does not set out internal appeal rights, so consult the Act and seek specialist advice early.

Following this checklist maps the Scheme’s statutory requirements into concrete steps, reduces the risk of avoidable deduction or rejection, and preserves evidence needed to respond to Commission queries or prospective review.
