What it does
The Meander Dam Project Act 2003 is a single‑project validation statute passed by the Tasmanian Parliament to override a decision of the Resource Management and Planning Appeal Tribunal (RMPAT) that had set aside the dam permit and environment protection notice for the Meander Dam. Section 5(1) expressly reinstates both instruments “which were set aside by the RMPAT decision”. The Act then confers a deemed water licence on the responsible entity (initially Tasmanian Irrigation Pty Ltd) under s 7(1), authorising the taking of water from the Meander River and four named tributaries plus their unnamed tributaries, with a water allocation transferred from the Hydro‑Electric Corporation’s special licence for the South Esk River hydro‑electric district.
Section 6 empowers the responsible entity to do all things necessary or expedient to implement the project, but only in accordance with the reinstated dam permit, the environment protection notice, the quarry permit (granted by the Meander Valley Council on 10 December 2002), the deemed water licence, and any prescribed instrument. Section 8 allows Crown land at or near the prescribed location to be disturbed, cleared, excavated, built on, submerged or otherwise modified for the project or any related hydro‑electric power‑generating facility, even if that land is reserved land (State forest or forest reserve). The reserved status ceases automatically upon modification, and the provision has effect only until the later of the receipt of the “work as executed” report under the dam permit conditions or the first filling of the dam to its maximum authorised storage capacity.
Section 9 declares that the project is taken to meet and further the objectives of the Water Management Act 1999 and all relevant State policies - a legislative fiat that removes any need for the project to demonstrate compliance with those objectives on its merits. Section 10 gives the Act primacy over any other law of the State and over the RMPAT decision, and s 5(2) and s 7(3) oust judicial review under the Judicial Review Act 2000 or any other State law for decisions relating to the reinstatement, validity or conditions of the dam permit, environment protection notice, or the deemed licence.
