GAMING CONTROL (LICENSING) REGULATIONS 1995

The regulations organise licensing around a set of discrete legal concepts and administrative mechanisms. The key legal concepts are "duties", licence classifications, "Director" powers, eligibility and fit-and-proper assessments, provisional versus full licences, review and remedial powers, and offences and penalties.

"Duties" is the central substantive concept restricting who must hold a licence. Regulation 2 defines duties broadly, to include croupier and supervisory roles, cash/chip handling for gaming, security and surveillance in gaming areas, and administration directly related to gaming, including accounting and internal auditing. The textual scope ties the licensing requirement to activities that relate directly to the conduct of gaming or operation of gaming machines (regulation 2). This focuses regulatory coverage on functions that materially affect gaming operations and financial flows tied to games.

Licences come in three classes: key, standard and trainee (regulation 2). The Director determines which class to grant based on the proposed duties , managerial functions trigger key licences, training programmes trigger trainee licences, otherwise a standard licence (regulation 7(2)). Licences are either provisional (time-limited to a period not exceeding 12 months) or full; provisional status is mandatory in specified circumstances (for example certain prior convictions, previously cancelled licence, short-term engagement, or trainee status) (regulation 8(1)).

Eligibility is framed around age, repute, English competency, financial background and criminal history, plus competence for the proposed duties (regulation 5(1)(a)-(f)). Criminal-history assessment is qualified by reference to the Criminal Records (Spent Convictions) Act 1992 (regulation 5(1)(e)). The Director has an obligation to investigate and assess these matters (regulation 5) and may pause or refuse processing until the applicant supplies required documentation (regulation 5(3)).

The Director’s investigatory powers are extensive. Regulation 6 allows the Director to inquire into additional matters, to notify applicants of those enquiries, to request further information, to require attendance at interviews, and to make inquiries outside the Territory. The regulation also requires the applicant to provide consents and authorities to facilitate those inquiries and empowers the Director to treat non-compliance as grounds for refusal (regulation 6(1)-(3)). There is limited statutory protection for third parties who supply information in good faith to the Director (regulation 6(4)).

The review and enforcement framework is a combined administrative oversight and sanctioning mechanism. Regulation 13 triggers a Director-initiated review when specified adverse matters come to light, including fraud in obtaining a licence, certain criminal convictions, contravention of licence conditions, insolvency matters, and other concerns about fitness and propriety (regulation 13(1)). The Director sets the procedure for the review, is not bound by rules of evidence, may retain documents, and may compel attendance and answers from associated persons (regulation 13(3)). Decisions following a review range from dismissal of the matter through to reprimand, retraining, conditions, suspension (up to six months) and cancellation (regulation 13(4)-(6)). Cancellation carries a further restriction on re-application for 12 months (regulation 13(6)).

Procedural entitlements: an applicant can request reasons for refusal within 14 days (regulation 7(6)), and the Director must provide reasons as soon as practicable. The licensed person is protected from compelled self-incrimination by an express privilege in regulation 13(7).

Fees and costs are specified in the Schedule and are payable before an application will be dealt with (regulation 15). Fees are denominated in "revenue units" as currently expressed in the Schedule; the Schedule also lists amounts for grant, renewal, variation and replacement of licences.

Offences are framed narrowly to the application and compliance context. Making a false statement or supplying false information for licensing or review purposes is a standalone offence (regulation 16). A breach of any provision of the regulations is an offence carrying a maximum fine of 17 penalty units (regulation 17).

The text contains transitional savings for licences previously issued under directions made under the earlier Casino Licensing and Control Act 1984, deeming those licences to be licences granted under these regulations and subject to the same terms and the remedial powers here (regulation 18).

Taken together, the conceptual architecture centralises individual worker licensing, assigns broad investigatory discretion to the Director, and couples licence status to both upfront vetting and ongoing supervisory review tied to fitness, propriety and conduct in role.

The regulations affect a set of distinct actors, each bearing particular legal obligations, costs and decision points under the text.

1. Applicants and licensed persons

   • Individuals who intend to perform the regulated "duties" in a casino must apply for and hold an appropriate licence. The regulations make it an offence to perform duties without a licence, or to perform duties outside the scope of a licence (regulation 3(2)). Licensed persons must comply with the terms and conditions of their licence and with the Act and lawful directions from Gaming Inspectors concerning the conduct of approved games (regulation 7(4)).
   • Applicant obligations include submitting an application in an approved form, supplying a suite of supporting documents verified by statutory declaration, supplying three passport photographs, and providing written consents to enable the Director to obtain criminal history and financial background information (regulation 4(2)(a)-(g)). A police verification of fingerprints and palm prints is required (regulation 4(2)(f)).
   • Licensed persons are subject to ongoing regulatory surveillance through the Director’s review powers; if a review is initiated the licensed person must cease performing duties until determination, as arranged by the Licensee, and must comply with the review process subject to the privilege against self-incrimination (regulation 13(2), (7)).

2. Licensees (capital L)

   • The regulations impose duties on "Licensee" to ensure no person performs regulated duties without a licence, and to supply a certificate that they will engage the applicant subject to licence grant as part of the application (regulation 3(1); regulation 4(2)(a)). During a Director’s review, the Licensee must arrange for the licensed person to cease duties until the review is determined (regulation 13(2)). The regulations therefore allocate operational compliance and immediate workforce management responsibilities to Licensees even though the Licensee is not defined within these regulations themselves.

3. The Director

   • The Director is the decision-maker for grant, refusal, renewal, variation, suspension, cancellation, and replacement of licences. The Director conducts investigations and inquiries into applications (regulation 5), may request additional information and consents (regulation 6), decides whether an application meets eligibility and fit-and-proper requirements (regulation 7(1)), and conducts reviews where adverse matters are reported (regulation 13). The Director also sets provisional licence periods and may waive certain procedural requirements in limited circumstances for re-applicants (regulation 8; regulation 12).

4. Third parties and information providers

   • The Director may require third parties associated with an applicant to provide information and attend interviews, and offers a statutory shield against civil or criminal proceedings for those who supply information in good faith to the Director (regulation 6(1) and (4)). However, the Director may retain documents produced for a review and compel attendance and answers from associated persons (regulation 13(3)(e) and (f)).

5. Police and criminal-record agencies

   • Applicants must have fingerprints and palm prints taken and verified by a police member for the application (regulation 4(2)(f)), and must give written consents to enable the Director to obtain criminal-history information (regulation 4(2)(g)). The Director may rely on interstate or international enquiries (regulation 6(1)(b)(ii)).

6. Training providers and employers of trainees

   • People engaged in a training programme must hold trainee licences and provisional licence rules apply to trainees; the duration of a trainee provisional licence normally ends at the termination of the training programme (regulation 8(1)(f); regulation 8(6)).

Who pays

• Applicants pay fees set out in the Schedule before the Director will deal with an application (regulation 15). The Schedule lists grant and renewal fees for key and standard licences, trainee licences, replacement and variation fees, all expressed in revenue units.

Who decides

• The Director makes the licensing decisions and sets conditions and durations within the regulatory framework (regulations 5-9, 11, 13). The Director also decides whether to grant full or provisional licences in specified circumstances (regulation 8).

What behaviour changes

• Individuals who undertake the defined casino duties must obtain and maintain the correct licence, submit to criminal and financial scrutiny, and comply with licence conditions and lawful gaming directions. Licensees must ensure only licensed persons perform regulated duties and must manage staff during Director reviews. Applicants and licence-holders must retain documentary evidence to meet procedural requests and to defend against review outcomes.

Concentrated burdens and risks

• The direct compliance costs fall on individuals for documentation, fingerprinting/palm printing, and fees, and on Licensees for pre-engagement certification and for taking staff off duties during reviews. The Director’s discretionary investigatory powers create unpredictability over timelines and possible outcomes. The mandatory provisional licence in specified circumstances limits immediate employment stability for those applicants. The statutory review powers allow the Director to retain documents and conduct inquiries beyond strict evidentiary procedures, which could affect privacy and operational continuity.

This section sets out the principal duties imposed by the regulations and the rights they create for applicants and licensed persons, with references to the regulatory provisions that establish each duty or right.

Core duties imposed by the regulations

• Licence requirement: A licensed person shall not permit a person to perform duties in the casino unless that person holds a licence authorising those duties, and individuals must not perform duties without a licence or outside the scope of their licence (regulation 3(1)-(2)). This creates an exclusionary rule controlling who may be engaged in regulated casino functions.
• Application obligations: Applicants must apply in writing in an approved form and provide specified supporting documents including a certificate from the Licensee confirming intended engagement, statutory declarations verifying supplied information, employment history, certified identification, three passport photographs, police verification of fingerprints and palm prints, and consents for criminal-history and financial-background enquiries (regulation 4(1)-(2)).
• Information-update duty: Applicants must inform the Director of any change to information previously supplied before the licence is granted, verified by statutory declaration, unless the Director notifies that particulars need not be supplied (regulation 4(3)-(4)). This imposes an ongoing pre-grant disclosure obligation.
• Co-operation with inquiries: Applicants and third parties may be required to supply further information and attend interviews to assist Director inquiries (regulation 6(1)(b)(i)). Non-compliance may be considered grounds for refusal (regulation 6(3)).
• Compliance with licence terms and gaming directions: It is a condition of every licence that the licensed person comply with the Act and with lawful directions or orders from a Gaming Inspector in relation to the carrying out of duties in playing an approved game (regulation 7(4)(a)-(b)). This ties day-to-day conduct in the casino to inspector instructions and statutory requirements.
• Licensee operational duties: The Licensee must certify intended engagement as part of an applicant’s dossier and, where the Director conducts a review, must arrange that the licensed person ceases performing duties until determination (regulation 4(2)(a); regulation 13(2)).

Rights and procedural protections

• Right to reasons on refusal: A person refused a licence may, within 14 days of receiving notification of refusal, request reasons and the Director must provide written reasons as soon as practicable (regulation 7(5)-(6)). This is an administrative right to the reasons for an adverse decision.
• Renewal and continuity: A full licence has a five-year duration and the holder may apply for renewal at least one month before expiry; the Director must renew if satisfied the applicant has complied with terms and is not otherwise ineligible, and the renewal continues the licence on the same terms unless varied (regulation 9(1)(b), (3)-(5)). Where a renewal application is made, a full licence continues in force until the later of its expiry or determination of the renewal application (regulation 9(6)). This creates a continuity protection during renewal processing.
• Re-application and waivers: Persons whose licences have expired may re-apply; in certain cases the Director may waive some procedural requirements and fees for a re-applicant who held a provisional licence and applied not more than 12 months earlier, or may grant a full licence where pleased with conduct during a provisional licence (regulation 12(3)-(4)). These are discretionary rights that can reduce re-application burden.
• Review process protections: Before conducting a review under regulation 13 the Director must give notice of reasons and timing and require the Licensee to have the person cease performing duties pending determination (regulation 13(2)). A licensed person is entitled to at least 14 days’ notice of the reason for the review and opportunity to make submissions personally or by representative, or in writing (regulation 13(3)(a)). The licensed person is protected against compelled self-incrimination during review (regulation 13(7)).
• Scope of Director’s discretion: The Director is not bound by the rules of evidence in reviews and may inform himself or herself on relevant matters in such manner as the Director thinks fit, including requiring production and retaining documents (regulation 13(3)(b)-(e)). This is a procedural feature that increases investigatory flexibility for the Director but reduces formality for the subject.

Enforcement and remedial powers

• Range of remedial actions: After a review the Director may dismiss the matter, reprimand, require counselling or retraining, impose or vary licence conditions, suspend for up to six months, or cancel a licence (regulation 13(4)(a)-(g)). Cancellation triggers a 12‑month prohibition on re-application (regulation 13(6)). This is the enforcement toolkit for regulating fitness and conduct.
• Return of licence upon sanction: A person whose licence is cancelled, suspended or varied must, upon notice, send the licence to the Director without delay (regulation 13(5)). This ensures administrative control of licence documents.

Obligations on making statements and documents

• False statement offence: It is an offence to knowingly make a false statement or supply false information in connection with grant, renewal, variation or replacement of a licence or conduct of a review (regulation 16). This attaches criminal risk to fraudulent or misleading applications or representations.
• Fees payable prior to processing: The Director will not deal with an application for grant, renewal, variation or replacement until the prescribed fee in the Schedule is paid (regulation 15).

Administrative discretions that materially affect rights

• The Director can decide that changes in information need not be notified for the purposes of an application (regulation 4(4)). The Director can conduct inquiries in other jurisdictions (regulation 6(1)(b)(ii)), and can determine the terms and length of provisional licences having regard to the nature and recency of offences or reasons for past cancellations (regulation 8(3)-(4)). These discretions affect how long an individual might remain in provisional status and what evidence the Director will consider.

In sum, the regulations set a structured set of duties for applicants and Licensees to document and demonstrate suitability, grant the Director broad investigative and remedial powers, and provide applicants and licence-holders with specified procedural rights such as reasons on refusal, renewal continuity, and review process notice.

The enforcement framework in these regulations combines preventive licensing controls, investigatory powers, administrative sanctions, and criminal penalties. The text furnishes both specific offences and a general offence for breach, and provides the Director with administrative tools to manage licence integrity.

Criminal offences and fines

• False statements: Regulation 16 makes it an offence to knowingly make a false statement or supply false information in relation to the grant, renewal, variation or replacement of a licence or the conduct of a review. The regulation does not specify a standalone penalty in that provision but its breach will fall within the general penalty regime where applicable.
• General penalty: Regulation 17 creates a general offence for a contravention or failure to comply with a provision of these regulations, with a maximum penalty of 17 penalty units. This provision applies broadly to breaches of the regulations’ requirements.

Administrative enforcement powers vested in the Director

• Review initiation: Regulation 13 obliges the Director to conduct a review where specified adverse matters are brought to the Director’s attention, including fraud in obtaining a licence, certain types of criminal convictions (those involving dishonesty, assault, drugs, offences under the Act, or offences punishable by at least three months imprisonment), contraventions of licence terms, failure to provide required information or knowingly providing false or misleading information, and insolvency or bankruptcy-related matters (regulation 13(1)). This is the statutory trigger for administrative fact-finding and potential sanctions.
• Interim suspension of duties during reviews: Prior to commencing a review, the Director must give written notice to the Licensee and require that the Licensee arrange the licensed person to cease performing duties until the review is determined; the Licensee must comply (regulation 13(2)). This creates an immediate operational restraint pending outcome.
• Investigation procedure: The Director has broad investigatory procedures in reviews: notice procedures (minimum 14 days for the subject to make submissions), no requirement to observe rules of evidence, flexibility to inform himself or herself by any relevant means, power to require production and inspection of documents and to retain them for reasonable periods, and power to require associated persons to attend and answer truthfully (regulation 13(3)). The Director may determine the review where the licensed person fails to make submissions and had received notice (regulation 13(3)(g)).
• Range of sanctions: After a review the Director may dismiss the complaint, reprimand the licensed person, require counselling or retraining, impose conditions, vary terms or duties or classification, suspend a licence for up to six months, or cancel the licence (regulation 13(4)(a)-(g)). These are administrative sanctions short of, and including, licence cancellation.
• Return of documents on sanction: A person whose licence is cancelled, suspended or varied must, on receipt of notice requiring the return of the licence, deliver the licence to the Director without delay (regulation 13(5)). This facilitates administrative control and prevents continued unauthorised performance of regulated duties.

Consequences of cancellation and re-application restrictions

• A person whose licence is cancelled is barred from re-applying for 12 months from the cancellation date (regulation 13(6)). This imposes a time-limited career interruption for the individual in the regulated sector.

Practical enforcement considerations

• The Director’s procedure in reviews is not bound by the rules of evidence (regulation 13(3)(b)), which speeds fact-finding but may reduce the formal legal standards for admissibility; the Director may retain documents (regulation 13(3)(e)), raising confidentiality and record-retention considerations for employers and applicants.
• Non-compliance with requests for information during application processing may result in refusal (regulation 6(3), regulation 5(3)). This gives the Director effective leverage to require cooperation.
• The Licensee’s duty to remove a person from duties during a review (regulation 13(2)) places the initial economic cost of administrative enforcement (idle labour, rostering changes) on the casino employer rather than the regulator.

Enforcement by criminal proceedings

• The regulations provide for criminal liability but reserve to other instruments the specifics of prosecution and penalty unit valuation. The maximum fine of 17 penalty units for contraventions (regulation 17) should be read with the Penalties Amendment and subsequent statutory frameworks for penalty unit value and prosecutorial discretion set out elsewhere in Northern Territory law. The regulations do not prescribe imprisonment as a direct penalty for contraventions here.

Interplay with other enforcement mechanisms

• The regulations operate within the broader framework of the Gaming Control Act 1993 and other laws. For example, contraventions of the Act itself or of directions given by Gaming Inspectors (compliance with which is a licence condition at regulation 7(4)) may attract separate enforcement paths under the Act. The regulations' review process is an administrative mechanism distinct from judicial or criminal proceedings, though its outcomes (such as cancellation and its ancillary re-application bar) have material employment consequences and may be relevant to separate prosecutions if offences arise.

In sum, enforcement combines criminal sanctions for false statements and general contraventions with a substantive administrative regime enabling the Director to investigate, impose remedial measures, remove licence-holders from duties during enquiries, and suspend or cancel licences.

These regulations are subordinate to and operate in tandem with the Gaming Control Act 1993, and they reference or implicate other Northern Territory statutes and prior legislative instruments. The regulations make several express cross-references and create points of contact with other legal regimes.

Parent Act and statutory context

• The regulations are made under the Gaming Control Act 1993, as stated at the head of the instrument. Throughout the text, several provisions explicitly refer to "the Act" or to obligations "under the Act" (for example, the condition that a licensed person must comply with the provisions of or under the Act, regulation 7(4)(a); and renewal disqualification where "prevented by a provision of or under the Act", regulation 9(4)). These cross-references indicate that the licensing adjunct here is part of a larger statutory scheme governed by the Act, and that enforcement and eligibility can be affected by provisions in the Act not printed in these regulations.

Criminal Records (Spent Convictions) Act 1992

• Regulation 5(1)(e) prescribes that the Director's assessment of prior convictions is subject to the Criminal Records (Spent Convictions) Act 1992. That statute governs the treatment of spent convictions and thus limits or qualifies how the Director may consider certain historical convictions in deciding fitness and propriety. The regulation directly imports legal constraints from that Act into eligibility assessment.

Pre-existing licences and earlier acts

• Regulation 18 preserves certain casino operatives licences issued under directions under the Casino Licensing and Control Act 1984, deeming them to be licences under these regulations until a specified date and subject to the same terms and subject to these regulations for cancellation and variation. This is a transitional provision to maintain continuity for pre-existing licence holders and to convert older licences into the new regulatory framework.

Police and criminal-record systems

• The application process requires a police member to sign a statement verifying that the applicant has had fingerprints and palm prints taken (regulation 4(2)(f)), and requires applicants to provide written consents and authorities to enable the Director to obtain a criminal history report and financial background information (regulation 4(2)(g)). These steps interface with criminal-record agencies and financial-reporting systems and may implicate privacy and data-sharing rules in separate legislation.

Revenue units and penalty units

• Fees in the Schedule are expressed in "revenue units". The endnotes show that the instrument has been amended by Treasury Legislation Amendment (Revenue Units) Regulations 2006 and other fee/penalty instruments (Endnotes 2 and 4). Interpretation of "revenue units" and the monetary equivalent of "penalty units" depends on separate instruments that set the monetary values of those unit measures. Thus, to translate fees and penalties into currency, a reader must consult the relevant Treasury regulations or Acts that establish unit values.

Bankruptcy and insolvency laws

• Regulation 13(1)(e) lists bankruptcy, applications under laws for insolvent debtors, composition with creditors, or assignments of remuneration as grounds for the Director to conduct a review. The interaction is procedural: insolvency events under bankruptcy or corporate law may trigger fitness and propriety scrutiny under the regulations even if the insolvency regime itself is governed elsewhere.

Administrative law and judicial review

• The regulations authorise internal administrative review processes (regulation 13) and require reasons on request for refusals (regulation 7(6)). While the regulations themselves do not provide a statutory external appeal route, administrative decisions under these regulations and the parent Act will typically be subject to common administrative law principles and judicial review remedies available under general administrative law and the Act. The instrument does not set out those external rights, so a reader should look to the Act and general administrative law for judicial and merits review processes.

Privacy, data-protection, and document retention

• The Director may require and retain documents produced during reviews for "such reasonable period" as necessary (regulation 13(3)(e)) and may conduct inquiries overseas (regulation 6(1)(b)(ii)). These powers interact with privacy and information-sharing regimes, though the regulations do not themselves delineate data-security or disclosure safeguards beyond an immunity for good-faith information providers (regulation 6(4)). Practitioners should therefore assess compliance with separate privacy statutes or policies when implementing consent and information-sharing steps.

Interoperation with casino inspectorate functions

• The condition in regulation 7(4)(b) that licensed persons must comply with lawful directions or orders from a Gaming Inspector ties the licensed person's obligations back to inspectorate powers under the Act and any instrument empowering Gaming Inspectors. That creates an operational link between day-to-day inspector directives and licensing discipline under these regulations.

Amendment instruments and repeal/rewrite risks

• The endnotes list a series of amendments and Acts that have altered the regulations over time, including Licensing (Repeals and Consequential Amendments) Act 2014 and Licensing (Director-General) Repeal Act 2020, and the Statute Law Amendment (Territory Economic Reconstruction) Act 2021. Those instruments can change administrative structures, titles, and procedures that sit adjacent to or embedded in these regulations; practitioners should check up-to-date versions of the parent Act and related instruments to understand current governance arrangements.

In sum, these regulations are an administrative implement of the Gaming Control Act 1993 and are intended to operate with, and be informed by, criminal records law, treasury instruments fixing unit values, privacy and insolvency laws, and inspectorate provisions under the Act. Effective compliance and legal advice requires cross-referencing the parent Act and the other named instruments.

The instrument contains a compact history of amendments and formal updates recorded in the endnotes and the reprint. This section summarises the chronological amendment path reflected in the provided text and identifies provisions the amendments affected.

Original instrument and commencement

• Gaming Control (Licensing) Regulations (SL No. 9, 1995) were notified 5 April 1995 and commenced 5 April 1995 (Endnote 2). The original 1995 regulations established the licensing regime reflected in the current text.

Subsequent amendments and their scope

• SL No. 10, 1998 (amendments notified 8 April 1998, commenced 8 April 1998) made amendments to regulation 2 (definition r 2 amended), regulation 9 (r 9 amended), regulation 12 (r 12 amended) and the Schedule (Schedule substituted) among other changes. The endnotes list "r 2 amd No. 10, 1998, r 2" and "sch sub No. 10, 1998, r 5".
• Treasury Legislation Amendment (Revenue Units) Regulations 2006 (SL No. 33, 2006) were notified 18 October 2006 and commenced 18 October 2006, and amended the Schedule to reflect revenue-unit denominated fees (Endnote 2 and 4).
• Fees and Charges Amendment Regulations 2009 (SL No. 34, 2009) were notified 14 December 2009 and some changes commenced 1 January 2010, specifically amending the Schedule (Endnote 2 and 4).
• Penalties Amendment (Justice and Treasury Legislation) Act 2010 (Act No. 38, 2010), assent 18 November 2010, commenced 1 February 2011, amended regulation 17 (r 17) to change the maximum penalty or the structure of penalties (Endnote 2 and 4 record r 17 amended by Act No. 38, 2010, s 3).
• Licensing (Repeals and Consequential Amendments) Act 2014 (Act No. 44, 2014) was assented to 5 December 2014 and commenced 1 January 2015. This Act amended regulations 4 through 8, 9, 10-11, 12, 13-15 and possibly other provisions, as noted in the endnotes (Endnote 4 lists rr 4 - 8 amd Act No. 44, 2014, s 145; and other entries).
• Licensing (Director-General) Repeal Act 2020 (Act No. 4, 2020), assent 9 March 2020, commenced 14 April 2020, produced further amendments to multiple regulations including rr 4-12 and rr 13-15. The endnotes show repeated entries "Act No. 4, 2020, s 87" linked to many regulations, indicating structural or terminology changes tied to that Act.
• Statute Law Amendment (Territory Economic Reconstruction) Act 2021 (Act No. 19, 2021), assent 31 August 2021, had staged commencement: part 6 commenced 2 October 2021; remainder commencement dates differ; the reprint notes commencement of parts and a remade clause effective 29 September 2021. Regulation 9 is listed as amended by Act No. 19, 2021, s 78 in the endnotes.

Formal and drafting amendments

• General amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) to rr 1, 5 and 18 as noted in Endnote 3. These are described as formal changes and not separately listed in the amendment table.

Effect on specific provisions

• The endnotes specifically map amendments to regulation numbers: rr 4-8 (Act No. 44, 2014; Act No. 4, 2020), r 9 (No. 10, 1998; Act No. 44, 2014; Act No. 4, 2020; Act No. 19, 2021), rr 10-11 (Act No. 44, 2014; Act No. 4, 2020), r 12 (No. 10, 1998; Act No. 44, 2014; Act No. 4, 2020), rr 13-15 (Act No. 44, 2014; Act No. 4, 2020), r 17 (Act No. 38, 2010), and the Schedule (substituted by No. 10, 1998 and amended by No. 33, 2006 and No. 34, 2009).

Practical implications of amendment history

• Fee expression and monetary valuation: The Schedule was converted to revenue units and amended multiple times, which affects the monetary value of licence fees but requires cross-reference to separate Treasury instruments to convert revenue units to currency (Endnotes and Schedule).
• Terminology and administrative office changes: Acts such as the Licensing (Director-General) Repeal Act 2020 indicate structural changes in public offices or administrative titles; this can affect references to decision-makers and the organisational home for the Director or their functions. Practitioners should therefore review the current version of the parent Act for up-to-date institutional arrangements.
• Substantive process changes: The larger legislative amendments (Act No. 44, 2014 and Act No. 4, 2020) touched multiple regulations including application, grant, renewal, variation and review procedures, suggesting substantive regulatory modernisation. The reprint captures those changes but a time-series comparison would be required to identify prior procedural forms.

Where to look for the authoritative current text

• For precise legal counselling, always consult the most recent consolidated reprint of the regulations as published by the Northern Territory’s legislation service, and cross-check with the amending Acts cited in the endnotes. The endnotes in this reprint list the key amending instruments and their commencement dates and should be used as a map to determine which version of any given provision was in force on a specified date.

The text of the Gaming Control (Licensing) Regulations 1995 supplied here does not include case law, judicial decisions or a list of litigated matters interpreting the regulations. The instrument itself records administrative procedures and remedies, but it does not catalogue any litigation.

What the regulations do provide by way of remedial process

• Internal administrative review: Regulation 13 establishes an administrative review mechanism conducted by the Director where specified adverse matters arise, and sets out procedural steps and possible outcomes, including suspension and cancellation. The regulations also provide a procedural right to request written reasons for refusal of a licence within 14 days (regulation 7(6)). These are internal administrative remedies that parties must typically exhaust before seeking external judicial review, depending on the parent Act’s provisions on merits review and appeals.
• Statutory protections during review: The licensed person may assert the right not to answer questions that might tend to incriminate them (regulation 13(7)), which affects how evidence is gathered during administrative enquiries.

Absence of recorded judicial decisions in the instrument

• There are no cases named in the regulations, no references to precedent or judicial interpretation, and no sections that summarise how courts have treated the instrument. Consequently, to locate litigation history one must search court and tribunal records, administrative appeals, and reported decisions for matters concerning the regulations or decisions made under them. The parent Act and its administrative decisions may have generated case law relevant to the interpretation and application of these regulations, but that material is not included in this text.

Practical implications for practitioners

• Because the regulations create administrative processes and discretions that can have significant employment and licencing consequences (suspension, cancellation, re-application bars), a regulated person or Licensee facing a review or an adverse licensing decision should consider administrative-law remedies outside the regulations such as merits review or judicial review under the parent Act and common law. Those tribunals and courts may have jurisdiction to review procedural fairness, lawfulness of decision-making and reasonableness, but such external remedies are not set out in these regulations. Practitioners should therefore cross-reference the parent Act and consult up-to-date case law for precedential guidance.

Recommendation on locating litigation

• To assemble litigation history relevant to the operation or interpretation of these regulations, search Northern Territory Tribunal and Supreme Court decisions, decisions under the parent Gaming Control Act 1993, and any administrative appeals that reference regulation 13’s review process, reasons under regulation 7(6), or offences under regulations 16-17. The reprint’s endnotes identify key amending Acts that may have been the subject of litigation about regulatory transition or interpretation.

In sum, the instrument contains no embedded litigation history; to evaluate how courts have interpreted or enforced these provisions one must conduct a dedicated legal research exercise in the relevant jurisdictions and repositories.

This section flags specific traps for practitioners and operators found in the text, focusing on procedural pitfalls, timing, discretionary practices that can materially affect applicants and employers, and hidden compliance frictions that flow from the regulations as written.

1. Provisional licences are not renewable

   • Regulation 9(2) states a provisional licence is not renewable. If an applicant expects continuity, they must apply for a new licence before expiry. Practitioners should not assume a provisional licence will roll over automatically into a full licence; while regulation 12(4)(b) allows the Director to grant a full licence where satisfied with conduct during provisional period, that is discretionary and not guaranteed.

2. Fee payment blocks consideration

   • Regulation 15 requires payment of the Schedule fee before the Director will deal with an application. Applications incomplete in documentary evidence but with fee paid may still be delayed, yet unpaid fees will halt processing entirely. Confirm fee currencies given fees are expressed in revenue units, which must be translated into currency using separate instruments.

3. Certification of engagement required from "Licensee"

   • Regulation 4(2)(a) requires a certificate signed by or on behalf of a Licensee that the Licensee will engage the applicant, subject to licence grant. The term "Licensee" is used extensively but not defined in these regulations. Practitioners should locate the parent Act or other instruments for the operative definition. Absent that certificate, the Director may consider the application incomplete (regulation 5(3)).

4. Police verification is mandatory

   • Regulation 4(2)(f) requires a police member’s written statement verifying fingerprints and palm prints have been taken. This is an operational step that can delay processing if not arranged promptly. Note that applicants must supply this as part of their initial application.

5. Wide disclosure and consent requirements

   • Regulation 4(2)(g) requires applicants to supply written consents and authorities to enable the Director to obtain criminal history and financial information. The Director may also conduct inquiries interstate or internationally (regulation 6(1)(b)(ii)), and may request associated persons to supply information. These consent requirements implicate privacy and commercial confidentiality; practitioners should obtain and store signed consents and consider privacy obligations under other law.

6. Director’s discretion to pause or refuse if information not supplied

   • Regulation 5(3) and regulation 6(3) allow the Director to delay consideration or to decide there are sufficient grounds to refuse where required information or consents are not provided. Applicants who withhold information or delay consents risk refusal, not merely sanction. Document retention and compliance are therefore critical.

7. Director not bound by rules of evidence

   • Regulation 13(3)(b) explicitly states the Director is not bound by the rules of evidence when conducting a review. Evidence admissible in a review may thus be different to what would be admissible in court. Practitioners should therefore prepare for flexible evidentiary settings and carefully manage documentary and testimonial responses.

8. Employer must remove person from duties during review

   • Regulation 13(2) requires the Licensee to arrange that the licensed person ceases performing duties until the review is determined. This places immediate staffing and wage-cost consequences on the employer and could disrupt operations. Ensure rostering and contingency plans are in place for potential enforced suspensions.

9. Risk of document retention and disclosure

   • During a review the Director "shall inspect" documents and "may retain them for such reasonable period" (regulation 13(3)(e)). Employers and applicants should be cautious in producing original documents and should request receipts or copies; plan for data security and confidentiality risks when providing documents to the Director.

10. False statement offence and general penalty

    • Regulation 16 criminalises knowingly false statements to the Director in connection with licence matters. Regulation 17 creates a maximum penalty of 17 penalty units for contraventions. Practitioners should check current financial conversion of a penalty unit to quantify exposure. Note also that false statements discovered during or after grant can trigger review, suspension or cancellation (regulation 13(1)(a), (d)).

11. Short timelines for requesting reasons on refusal

    • If an applicant is refused a licence, they must request written reasons within 14 days to trigger the Director’s obligation to supply reasons (regulation 7(6)). Missing this window may complicate challenge strategies or delay understanding of refusal grounds.

12. Re-application waivers are discretionary

    • Regulation 12(3)-(4) provides discretionary waivers of application requirements and fees for re-applicants, but the Director may grant waivers only where satisfied on conduct during provisional licence or fairness. Do not assume waivers will be granted; advise clients to maintain full application records.

13. Re-application ban after cancellation

    • A person whose licence is cancelled cannot re-apply until 12 months after cancellation (regulation 13(6)). Cancellation therefore creates a defined blackout period for the individual’s employment prospects within the regulated activities.

14. English competency and competence tests are subjective

    • Regulation 5(1)(c) and 5(1)(f) require adequate command of English and demonstration of competence for duties. These are factual enquiries and can be interpreted subjectively by the Director. Applicants should provide objective evidence of English competency and of training or qualifications to reduce subjective adverse findings.

15. Schedule expressed in revenue units requires cross-reference

    • The Schedule lists fees in revenue units rather than currency. The applicable monetary value will be determined by separate Treasury instruments. Failure to confirm the current monetary value could lead to underpayment and the Director refusing to deal with the application (regulation 15).

16. Requirement to notify prior changes before grant

    • Regulation 4(3) requires applicants to notify the Director of any change in supplied information before grant. This imposes a continuing pre-grant obligation that can impact applications during ongoing background checks or changing personal circumstances.

These "gotchas" focus on procedural traps and practical operational impacts created by documentary, timing and discretionary features of the regulations. Practitioners should build compliance checklists and document management protocols to avoid avoidable refusals, delays and sanctions.

This section provides a practical compliance checklist and recommended procedural steps for applicants, Licensees and advisers, grounded in the regulatory requirements. It addresses pre-application preparation, application lodgement, interactions during investigation, renewal and re-application, and handling a Director review.

Pre-application and employer preparation

• Identify duty classification: Analyse the specific duties the prospective employee will perform against regulation 2’s definition of "duties" to determine whether a licence is required at all and what licence class (key, standard, trainee) is appropriate (regulation 2; regulation 7(2)). For managerial roles plan for key licence fees and fit-and-proper thresholds.
• Obtain Licensee certification: Secure the certificate from the Licensee confirming the intended engagement subject to licence grant, as required by regulation 4(2)(a). Licensees should prepare a standard form of engagement certificate to streamline applications.
• Plan fingerprinting and palm-print verification: Arrange an appointment with police for fingerprints and palm prints and obtain the police member’s written statement verifying the prints, per regulation 4(2)(f). Do not lodge the application without this.

Document checklist for application As required by regulation 4(2), assemble:

• Completed application in the approved form;
• Certificate from the Licensee confirming engagement (regulation 4(2)(a));
• Documents supporting eligibility (as required by the Director) verified by statutory declaration (regulation 4(2)(b));
• Statement of employment history (regulation 4(2)(c));
• Certified copy of birth certificate, passport, refugee certificate or naturalisation certificate plus certified proof of any change of name such as marriage certificate (regulation 4(2)(d));
• Three recent passport photographs (regulation 4(2)(e));
• Police verification of fingerprints and palm prints (regulation 4(2)(f));
• Written consents/authorities enabling the Director to obtain criminal history and financial background information (regulation 4(2)(g)).

Fee payment

• Pay the fee specified in the Schedule before lodging. The Director will not deal with applications until the fee is paid (regulation 15). Confirm current monetary equivalents for "revenue units" with Treasury instruments in force at lodgement time.

Submission and statutory declarations

• Verify all statutory declarations are correctly signed and witnessed. Regulation 4(3) and regulation 10(2) require statutory-declaration verification for updates and replacement applications.

Responding to Director requests and additional inquiries

• Provide prompt consents and additional documents: Regulation 6 empowers the Director to require further information, to interview applicants or associated persons, and to make interstate or international inquiries. To avoid refusal under regulation 6(3), respond promptly and fully to requests, remembering the Director may treat non-compliance as grounds to refuse.
• Keep records of all materials supplied: Because the Director may inspect and retain documents produced during a review per regulation 13(3)(e), maintain copies and a chain-of-custody record for documents provided.

Managing provisional licences and training

• If an applicant falls within regulation 8(1) categories for provisional licences (certain prior convictions, prior cancellation, short-term engagement, or trainee), plan for the provisional licence period, which the Director will set not exceeding 12 months (regulation 8(2)). For trainees link licence expiry to training-programme termination dates as specified (regulation 8(6)).

Renewal and re-application

• For full licences, submit renewal applications at least one month before expiry (regulation 9(3)). Remember full licences are for 5 years; provisional licences are not renewable (regulation 9(1)-(2)).
• Re-application waivers: If re-applying within six months of licence expiry the Director may waive compliance with regulation 4 to the extent necessary (regulation 12(3)). If re-applying under the rules for a person holding a provisional licence, the Director may waive certain application document requirements and the fee or may grant a full licence if satisfied (regulation 12(4)). For persons considering re-application after cancellation, note the 12‑month prohibition (regulation 13(6)).

Variation, replacement and surrender

• Use regulation 11 process for any variation: If the licensed person seeks to vary terms, duties or classification, lodge an application under regulation 11(1) explaining the variation and reasons, and be prepared to provide supporting documents as required under regulation 4 where the Director deems them necessary (regulation 11(2)-(3)).
• For lost or damaged licences follow the replacement process in regulation 10, including statutory declaration verification.
• To surrender a licence return the licence with the approved form to the Director (regulation 14).

Preparing for and managing a Director review

• If a review is initiated under regulation 13, note immediate steps:
  • Expect written notice with reasons, time, date and place, and a requirement that the Licensee remove the person from duties pending determination (regulation 13(2));
  • Provide submissions in writing or appear personally or by representative with at least 14 days’ notice (regulation 13(3)(a));
  • Exercise the privilege against self-incrimination where appropriate (regulation 13(7));
  • Be ready to supply documents and witnesses if requested; be aware the Director may retain documents temporarily (regulation 13(3)(e)).
• Consider legal representation for substantive or complex matters; prepare evidence of character, remedial steps, training, counselling or restitution to address grounds for review (regulation 13(4)).

Mitigating privacy and data risks

• Because the Director may request financial and criminal-history information and may make interstate or international inquiries (regulation 4(2)(g); regulation 6(1)(b)(ii)), obtain appropriately worded consents, and ensure that collection and sharing of personal information complies with applicable privacy laws and organisational policies.

Practical office and HR controls for Licensees

• Set a standard practice of only scheduling individuals to perform regulated duties after licence grant is confirmed (regulation 3(1));
• Keep a compliance file for each licensed person with application papers, consents, licences and any review outcomes;
• Prepare rostering contingency plans to cover enforced removal of staff during a Director’s review (regulation 13(2));
• Train supervisors and HR staff on licence-class limitations, the need to ensure individuals do not perform duties outside their licence scope (regulation 3(2)), and on the obligation to deliver licences to the Director on notice of cancellation or suspension (regulation 13(5)).

Record-keeping and audit

• Maintain records of all interactions, documents produced, and Director communications. Given the Director’s power to inspect, retain and copy documents, be ready to produce organised and legible records on request.

When to escalate to legal advice

• Seek legal advice when:
  • The Director commences a review that may lead to suspension or cancellation (regulation 13);
  • There is an allegation of fraud or falsity relating to an application (regulation 13(1)(a); regulation 16);
  • Insolvency, prior criminal convictions, or contested fitness-and-propriety issues arise which may trigger discretionary imposition of conditions, suspension or cancellation;
  • There is a dispute over the Director’s exercise of discretion, procedural fairness, or the Director’s request for interstate/international inquiries.

This compliance roadmap is grounded in the regulations’ provisions and emphasises proactive documentation, timely cooperation with Director enquiries, and careful planning for provisional-licence contingencies, renewals and possible reviews.
