act

Plain English Summary

6/10 complexity

This Act revokes the State-forest and flora-reserve legal status of specified parcels and reclassifies those parcels as national parks or nature reserves. It vests certain access roads in the Environment Minister and preserves existing forestry leases while excluding freehold and certain continued leaseholds from being converted.

The change shifts management and legal regime from forestry law into the National Parks and Wildlife framework, affecting forestry operators, lease/license holders, adjoining private landowners and the Environment Minister because it alters who decides land use, access and administration (see s4–6, s9, s11, Sch 4).

What it does

This Act converts substantial areas of New South Wales State forest into national parks and nature reserves, and removes or reconfigures certain flora-reserve notices and land interests so the converted areas sit under the National Parks and Wildlife Act 1974 (NPW Act) regime. The mechanical steps the Act takes are:

It revokes specified notices that previously set parts of State forests apart as flora reserves, but only insofar as those notices relate to flora-reserve land that lies within State forests whose dedication is revoked by this Act (section 3 and Schedule 1). The listed flora-reserve notices are set out in Schedule 1.
It revokes the dedication as State forest of the lands described in Schedule 2 (section 4). Schedule 2 contains 26 parts, each identifying the State-forest parcels by name, parish, county, approximate hectares and diagram catalogue references. Those parcels are then re‑allocated under sections 5 and 6.
It reserves the lands described in Schedule 2 as national parks or parts of national parks (section 5). Sections 5(2)-(10) create new named national parks (for example, “Bellinger River National Park”, “Chaelundi National Park”, through to “South East Forest National Park”), and sections 5(11)-(25) reserve particular parcels as parts of existing national parks (for example, parts of Barrington Tops, Ben Boyd, Biamanga and others). The precise parcels and extents are in Schedule 2.
It dedicates certain former State forest land as nature reserves (section 6): Part 25 of Schedule 2 becomes “Koorebang Nature Reserve” and Part 26 is dedicated as part of Nadgee Nature Reserve.
It alters some existing national-park reservations by revoking reservation of particular parcels and reserving those parcels as parts of other parks (section 7 and Schedule 3). Schedule 3 identifies the small parcel in Barrington Tops to be made part of Mount Royal National Park and a Werrikimbe piece to be made part of Oxley Wild Rivers National Park.

1 Name of Act

This Act is the Forestry Revocation and National Park Reservation Act 1996.

2 Commencement

This Act commences on 1 January 1997.

3 Revocation of status of certain lands as flora reserve

(1) The notices specified in Schedule 1, setting apart areas of State forest as flora reserves, are revoked but only to the extent to which they relate to flora reserves or parts of flora reserves situated within State forests whose dedication is revoked by this Act.

(2) Any other notice under section 25A of the Forestry Act 1916 that sets apart, as flora reserve, the whole or any portion of a State forest whose dedication is revoked by this Act is, to the extent to which the notice relates to flora reserve situated within such State forest, also revoked.

4 Revocation of dedication of certain lands as State forest

The dedication as State forest of the lands described in Schedule 2 is revoked.

5 Reservation of former State forest as national park

(1) This section has effect subject to section 9.

(2) The lands described in Part 1 of Schedule 2 are reserved as a national park to be known as “Bellinger River National Park”.

(3) The lands described in Part 2 of Schedule 2 are reserved as a national park to be known as “Chaelundi National Park”.

(4) The lands described in Part 3 of Schedule 2 are reserved as a national park to be known as “Dooragan National Park”.

(5) The lands described in Part 4 of Schedule 2 are reserved as a national park to be known as “Dunggir National Park”.

Compliance under this Act is largely an exercise in administrative engagement, title verification and interacting with the NPW Act framework. The Act sets duties for Ministers and creates transitional rules for existing interests. For parties affected, the steps below are practical, statutory-based compliance actions.

For the Environment Minister and the Minister administering the Forestry Act

Publish access-road orders within the statutory window (section 9(5)). The Environment Minister must publish one or more orders in the Gazette within six months of commencement, or within an extended period notified in the Gazette, declaring which access roads are excluded from reservation and which are not (s 9(5)). Those orders require the concurrence of the Minister administering the Forestry Act. Practically, the Environment Minister should:
- Identify all access roads listed in s 9(2) and match them to the diagram references in Schedule 2 and the Gazette diagrams.
- Consult promptly with the Minister administering the Forestry Act to secure concurrence. Because concurrence is a statutory prerequisite to publishing the order, delays or disputes will stall the statutory process.
- Publish the order(s) in the Gazette and ensure the wording precisely matches the parcels described in the Act and diagram references, so post-publication legal effects (s 9(6)) are clear.
Maintain access for private land holdings where road is sole access (s 9(8)). The Environment Minister must not close an access road that comprises the only means of access to a private land holding while the holding remains privately owned. To comply:
- Maintain records of private land holdings that rely on roads described in s 9(2).
- Ensure any management decisions or physical closures are not implemented in breach of s 9(8).
- If a closure is contemplated for roads not forming sole access, follow NPW Act processes where those apply.

For holders of existing forestry leases, licences, permits and occupancies

Engage with the Minister administering the NPW Act for administration matters (Schedule 4 cl 8). The administration of existing interests affecting Schedule 2 lands is vested in the NPW Minister (Sch 4 cl 8(2)). Existing forestry leases that were current immediately before commencement are treated similarly to licences or permits under NPW Act s 42(2) (Sch 4 cl 7). Practically:
- Identify all existing interests that affect any Schedule 2 parcel and confirm they were current immediately before commencement.
- Initiate contact with the NPW Minister’s office to establish the administrative point-of-contact for consents, renewals, compliance actions and any enforcement processes.
- Without assuming continuity of administrative practice, obtain written confirmation of what powers the NPW Minister will exercise (Sch 4 cl 8(3) gives the NPW Minister the powers of the Forestry Minister in respect of existing forestry interests, but operational arrangements will need practical clarification).
Continue to comply with existing lease conditions and NPW Act requirements. Existing leases remain in force but administration has moved. Continue to meet lease conditions, safety, environmental and reporting obligations and be prepared for the NPW Minister to exercise equivalent powers to impose conditions or manage compliance.

For fee-simple owners and continued leaseholders

Verify Schedule 2 and title boundaries (section 11). Section 11 excludes fee-simple estates and specified continued lease forms from being reserved by the Act. To ensure continued rights:
- Conduct a title search and cadastral comparison with Schedule 2 diagram references (Misc F numbers) to confirm whether your parcel is within a Schedule 2 part or excluded.
- If there is any overlap or ambiguity, obtain surveyor confirmation and seek a legal opinion. The Schedule references hatched diagram areas and exceptions; matching modern title parcels to those historic diagrams is essential to avoid mistaken assumptions.

For private landholders reliant on access via the affected lands

Confirm whether access roads are listed and monitor the Gazette (section 9). If your only access runs through land described in Schedule 2 or the access-road list in s 9(2), do the following:
- Identify whether the road is described in s 9(2)(n)-(o) or specifically in the enumerated subparagraphs (a)-(l).
- Monitor the Gazette for the Environment Minister’s orders under s 9(5). Those orders will state which roads are excluded from reservation and which are not; the status affects maintenance responsibility and the statutory tenure of the road.
- If your road is the only means of access, confirm the statutory protection in s 9(8) and, if necessary, document the fact that the road is sole access (title, survey evidence) so closure cannot lawfully be ordered while your holding remains privately owned.

For parties with easements, rights of way or other encumbrances

Assess the effect of s 9(3) vesting and “freed and discharged” language. Access roads vest in the Environment Minister freed and discharged from easements and other interests (s 9(3)). To comply with the Act and protect legal interests:
- Determine whether your easement or right of way is over a parcel described as an access road in s 9(2); if so, the easement may be extinguished by statute.
- Seek legal advice about remedies and the potential for compensation under other statutes or general law; the Act itself does not set out compensation procedures.
- If your easement is for sole access to a private land holding, document facts to show the road is the only means of access and rely on s 9(8) protection.

For local councils and road maintenance authorities

Identify whether you're responsible for roads affected by the Act and clarify maintenance responsibility post‑vesting. The vesting of access roads in the Environment Minister (s 9(3)) may alter maintenance obligations and cost allocation. To comply:
- Map all council-maintained roads against the s 9(2) list and Schedule 2 diagrams.
- Engage with the Environment Minister and the Minister administering the Forestry Act about who bears maintenance costs and liability for public safety on any roads that are excluded from reservation versus those that become park land.
- Where the road is reserved as part of a park (s 9(6)(b) post-order), plan for NPW Act management regimes to apply.

For prospective developers, timber operators, and recreational users

Confirm land tenure before undertaking or consenting to activity. After the Act, the relevant statutory tenure is national-park or nature-reserve tenure as deemed under Schedule 4. To comply:
- Before carrying out works or commercial activity, check whether the land is within Schedule 2/3 and whether access roads that facilitate work are excluded by s 9 orders.
- Consult the NPW Act for permitted activities and necessary approvals; the Act places the land within the NPW Act framework and NPW regulatory provisions will govern permitted uses, licences and offences.

Record-keeping and monitoring recommendations for all affected parties

Monitor the Gazette for s 9 orders and any subsequent NPW Act instruments and notices affecting the lands. The Act makes several processes dependent on Gazette publication (s 9(5)-(6); Schedule 4 references to proclamations are deemed to be the Act itself). Gazette notices will modify the legal status of access roads.
Obtain the diagram catalogue references and obtain certified maps. The Schedules rely on diagram numbers (Misc F numbers) and hatched areas. Secure copies of the referenced diagrams and, where necessary, commission survey confirmation to resolve boundary or overlap issues.
Obtain a current, official copy of the NPW Act and relevant Crown Land Management Act and Forestry Act provisions. The Act delegates substantive regulatory and administrative power to the NPW Act regime; compliance requires reading the NPW Act for management plans, approvals, permit regimes and offences.
Seek early legal advice where your property rights, easements, income or business operations depend on the affected lands or access routes. Given the vesting and power transfers in the Act, early legal advice can identify compensation risk, compliance obligations and practical steps to protect ongoing operations.

In sum, compliance is not a single step; it is a combination of confirming cadastral and title positions against the Schedules and diagrams, monitoring Gazette publications for s 9 orders, engaging with the NPW Minister for administration of existing interests, and adjusting operations to fit NPW Act regulatory constraints. The Act itself sets the structural legal changes; operational compliance requires aligning with those new authorities and procedures.
