What it does
The Evidence (Miscellaneous Provisions) Act 1958 (Vic) is Victoria's longstanding procedural evidence statute dealing with matters outside the main uniform evidence law framework of the Evidence Act 2008 (Vic). Now at Version 200, reflecting nearly seven decades of amendments, the Act covers the mechanics of obtaining evidence from witnesses at distance (both interstate and abroad), the audiovisual and audio link regime for Victorian courts, proof of documents, affidavit requirements, recording of evidence, and offences involving false documents and certificates.
The Act operates alongside rather than in place of the Evidence Act 2008 (Vic). Section 89F expressly provides that the document unavailability provisions in Part III are in addition to the Evidence Act 2008.
