What it does
The Employment Protection Regulation 2022 (NSW) is a subordinate instrument made under the Employment Protection Act 1982. Its core function is to specify the circumstances in which an employer’s obligations under sections 7 and 8 of that Act do not apply, to prescribe the content and form of notices required under those sections, to set the scale of severance payments that an employer must pay to avoid those obligations, and to prescribe the form for a union or employer to request the Industrial Relations Commission to exercise its jurisdiction. The regulation replaces the Employment Protection Regulation 2017, which was repealed on 1 September 2022 under the Subordinate Legislation Act 1989. The regulation itself commenced on that same date and applies to all terminations of employment occurring on or after that date, subject to savings provisions for acts, matters or things that had effect under the 2017 regulation.
Mechanically, the regulation carves out five categories of terminations from the operation of sections 7 and 8 of the Act: employees on a trial period of six months or less (section 4); employees with less than 12 months continuous service (section 5); employees whose employment transmits to a new employer in a business transfer (section 6); employees who receive a severance payment equal to or exceeding the scale in Schedule 1, or whose employment is covered by an award or agreement that provides for a severance payment (section 7); and employees in other specified cases: no applicable award or agreement, employees subject to a Commission order under section 11 of the Act, or employees engaged for a specified period or task whose employment ends at the natural expiry or completion (section 8). Each of these exemptions operates by stating that the particular termination is excluded from the duties the Act would otherwise impose. The regulation also creates an offence for serving a notice that does not comply with the prescribed form (maximum penalty 0.5 penalty unit, currently $55 in NSW unless adjusted).
