act

Plain English Summary

8/10 complexity

This Act creates a framework to plan, approve and fund large renewable generation, long‑duration storage and associated network projects in NSW. The Minister can declare renewable energy zones and access areas, appoint planners and direct network operators to deliver authorised projects (ss 19, 19A, 31A, 32).

Costs are recovered into an Electricity Infrastructure Fund from distribution network service providers and paid to operators under regulator determinations and LTES agreements (ss 56–58, 38–39, 46–50). The Act also gives officials powers to require information, protect commercial confidentiality and impose penalties for non‑compliance (ss 16, 18, 35).

What it does

Mechanically, the Act creates a statutory architecture to plan, procure, fund and, where necessary, compel the build and operation of large-scale renewable generation, long-duration storage and related network infrastructure in New South Wales. Key pieces are:

institutional offices and bodies: an NSW renewable energy sector board (s 7-9), an electricity infrastructure jobs advocate (s 10-11), an energy security target monitor (s 12-15; s 59), a consumer trustee (s 60), a financial trustee (s 61) and a scheme financial vehicle (s 62), an infrastructure planner (s 63), and a regulator (s 64). The scheme financial vehicle must establish and maintain an Electricity Infrastructure Fund (the Fund) (s 53-55).
planning, targets and monitoring: the energy security target monitor must calculate a 10-year energy security target using a statutory formula and report annually (s 12-15). The consumer trustee must prepare 20-year development pathways and 10-year tender plans for long-term energy service (LTES) agreements (s 44-45).
project pipeline, authorisation and commissioning: the infrastructure planner assesses REZ (renewable energy zone) network infrastructure projects and recommends authorisation to the consumer trustee (s 30, 30AA). The consumer trustee sets maximum prudent capital costs for authorised REZ network infrastructure projects and must notify the regulator and Minister (s 31). The infrastructure planner may appoint network operators to carry out REZ projects (s 31A) and recommend that the Minister direct a network operator to carry out an authorised REZ network infrastructure project (s 31B).
Ministerial direction power: the Minister may direct a network operator to carry out REZ or priority network infrastructure projects (s 32). The direction must specify the operator, project description and completion date and be exercised only if consistent with the Act’s objects and in the public interest (s 32(2)-(4)). A direction’s obligation to be complied with commences only when specified interim financial arrangements are in place or when the regulator makes a determination under s 38 (s 35A).
