What it does
This Regulation prescribes operational rules, evidentiary requirements, exemptions and administrative details that implement and supplement the Electoral Act 2017 (the Act) and related electoral funding and administrative law provisions. It does so by defining key terms (cl 3), specifying acceptable identity evidence for enrolment (cl 4), setting procedures and timeframes where the same person is relied on by more than one party for party eligibility (cl 5), and providing mechanics for nomination, registration and the handling of electoral material (cl 5B, cl 7, cl 7A, cl 8, cl 8AA, cl 8A). It also prescribes discrete administrative arrangements: the classes and named private providers whose staff may be appointed as election officials (cl 5A), the prescribed official mark for ballot papers (cl 8), and the office prescribed to provide access to child-protection declarations (cl 6). The Regulation places time-limited restrictions on technology-assisted voting at by-elections (cl 9) and imposes documentary and timing rules for use of an independent candidate logo at by-elections held in a specified period (cl 6A). It designates particular offences as penalty-notice offences and fixes penalty-notice amounts (Schedule 1), and it repeals or replaces earlier auxiliary schedules (sch 2 repealed).
Mechanically, the instrument operates primarily by: (a) prescribing evidentiary standards for enrolment applications (cl 4); (b) imposing procedural steps and deadlines on the Electoral Commissioner when resolving competing party member claims (cl 5); (c) describing how the Electoral Commissioner treats electronic lodgment and the online nomination system (cl 5B); (d) regulating the availability and display of registered how-to-vote or other electoral material at mobile or declared voting facilities (cl 7); (e) setting digital-era requirements for the “relevant name and address” displayed on social media electoral material and creating narrowly drawn exemptions for unpaid social-media posts and certain SMS and email interactions (cl 8AA, cl 8A); (f) limiting the use of technology-assisted voting at by-elections until the 2027 general election, save for a telephone-voting exemption for blind or low-vision electors (cl 9); and (g) quantifying penalty-notice amounts for specified offences under the Act (Schedule 1, for the purposes of s 263 of the Act).
