What it does
The Drug Court Regulation 2026 sets detailed criteria and procedures for parts of the Drug Court Act 1998. It does not set out the full Drug Court scheme. Instead, it prescribes matters that the Act leaves to regulations, including eligibility criteria, referring courts, facility-allocation guidelines, information channels, forms and fees.
The regulation is scheduled to commence on 1 September 2026 (s 2). On that date, it replaces the Drug Court Regulation 2020, which is repealed under s 10(2) of the Subordinate Legislation Act 1989, as described in the note to s 2. Section 15 preserves an act, matter or thing that had effect under the 2020 regulation immediately before its repeal, continuing its effect under the 2026 regulation. The text does not identify which particular acts, matters or things will be carried forward.
The regulation distinguishes between people considered for referral during criminal proceedings and convicted offenders considered for referral under the Act’s separate provision. Section 4 prescribes criteria for the first group, including residence in specified local government areas, age, capacity to participate and exclusion of proceedings within the Children’s Court’s jurisdiction. Section 5 prescribes a different set of criteria for convicted offenders, including a separate list of local government areas and a requirement that the person be male.
Other provisions govern referrals, treatment facilities, suspension of specified procedural obligations with consent, information supplied to the registrar, and fees. The regulation’s practical effect therefore depends on the Act’s underlying provisions, which are cross-referenced but not reproduced in the supplied text.
