What it does
The Coronavirus Economic Response Package (Payments and Benefits) Rules 2020 are a Commonwealth legislative instrument made by the Treasurer under the Coronavirus Economic Response Package (Payments and Benefits) Act 2020. The Rules are the operative document for the JobKeeper payment scheme (Part 2) and the JobMaker hiring credit scheme (Part 3). The parent Act provides the framework powers and integrity provisions; the Rules contain the eligibility tests, the entitlement rules, the wage condition for employees, the integrity rules for business participants and religious practitioners, and the timing and administrative machinery used by the Commissioner of Taxation to pay the schemes. Although both schemes have closed (JobKeeper to 28 March 2021 and JobMaker to 6 October 2022), the Rules remain in force as the source of obligations relevant to outstanding compliance, repayment, audit and review activity. The Rules are large because the JobKeeper scheme was amended several times in 2020, including the introduction of a two-tier rate, an actual decline in turnover test, and changes to the eligible employee 1 July 2020 reference date.
