What it does
The Construction Occupations (Licensing) Regulation 2004 (ACT) is the principal subordinate instrument under the Construction Occupations (Licensing) Act 2004. It transforms the broad licensing framework of the Act into operational detail that practising trades, corporations and regulators must follow. The Regulation prescribes the classes of licence for each construction occupation (Part 6, Schedule 1), the information required in a licence application (s 5), the particulars that must appear on a licence (s 6), and the maximum terms for issue and renewal. For builders, electricians, plumbers, drainers, gasfitters and gas appliance workers the maximum term is three years, but the applicant may elect a one-year term (s 7). For building assessors, building surveyors, plumbing plan certifiers and works assessors the maximum term is one year and is tied to the period of the applicant’s professional indemnity insurance (s 8). The Regulation also sets out the eligibility requirements for each licence category, including qualifications, skills, financial requirements (s 13), and, for certain occupations, mandatory professional indemnity insurance with minimum limits of $1,000,000 per claim (ss 16B, 17, 18, 18A). It establishes a demerit‑points system for occupational discipline, with specific grounds and point values tabulated in Schedules 2 and 3, and prescribes the conditions to which all licences are subject (Division 5.1, ss 20-28). The Regulation further defines which construction services may be provided without a licence when done by a trainee under supervision (s 35), creates reviewable decisions and prescribes the entities entitled to seek review (Part 6A, Schedule 4), and provides for the making of skill‑assessment notices (ss 14, 14A, 18B). Extensive transitional provisions ensure continuity from earlier regulatory regimes under the repealed Construction Practitioners Registration Act 1998 and the Plumbers, Drainers and Gasfitters Board Act 1982. Finally, the Regulation permits statutory instruments made under it to apply, adopt or incorporate external documents such as Australian Standards as in force from time to time (s 45A).
