What it does
The Business Services Wage Assessment Tool Payment Scheme Act 2015 created a one-off Commonwealth payment scheme for intellectually disabled workers employed in Australian Disability Enterprises (ADEs) whose minimum wages had been assessed using the Business Services Wage Assessment Tool (BSWAT). The BSWAT had been found to involve unlawful disability discrimination.
The Act was a legislative response to a Full Federal Court decision (Nojin v Commonwealth of Australia [2012] FCAFC 192, discussed in Duval-Comrie v Commonwealth of Australia [2016] FCA 1523) and subsequent representative proceedings. Rather than continuing complex litigation, the government established a payment scheme offering a structured compensation amount to eligible workers in exchange for the release of all related legal claims.
The scheme operated between 1 July 2015 and 31 December 2018. All deadlines have now passed. The Act remains in force but its primary operational significance is now historical, relating to any outstanding payment matters, debt recovery, information obligations, and the continuing effect of releases given by persons who accepted offers.
