27Appointing external reviewer

#### 27 Appointing external reviewer (1) If the Secretary receives an application for external review of a determination, the Secretary must, by writing, appoint a person (the external reviewer) to review the determination. (2) A person may only be appointed under subsection (1) if: (a) the person has been (but is no longer) a Justice of the High Court or a judge of another federal court or of a court of a State or Territory; or (b) the person is a legal practitioner who has been enrolled for at least 10 years. (3) If a person appointed under subsection (1) is unable to complete the review of the determination, the Secretary must appoint another person under that subsection to review the determination. (4) A person appointed under subsection (1) is to be paid the remuneration and allowances determined in writing by the Secretary in accordance with the rules (if any).
