Simpkin v Mansfield SC [2012] VCAT 1433
Ms Louise Hicks of counsel, instructed by Ellen Hogan & Associates. She called the following witnesses:
Mr Daniel Bowden, a town planner from Song Bowden Planning Pty Ltd.
Mr Phil Taylor of Mansfield Consulting Services. He called the following witness:
Retrospective approval for the use and development of the land for a sawmill.
Objection to the decision to grant a permit pursuant to Section 82 Planning and Environment Act 1987.
Zone and Overlays applying under the Mansfield Planning Scheme
Environmental Significance Overlay (Clause 42.01 and Schedule 2)
Planning permissions required under the Mansfield Planning Scheme
Use of the land for a rural industry in a Farming Zone (sawmill)(Clause 35.07-1).
Development and works on land in a Farming Zone (Clause 35.07-4) and subject to an Environmental Significance Overlay (Clause 42.01-2).
Ensure that development is not prejudiced and community amenity is not reduced by noise emissions, using a range of building design, urban design and land use separation techniques as appropriate to the land use functions and character of the area.
Why have we found the proposed acoustic response to be unacceptable?
Scenic value of the foothills, valleys and cleared grazing country is a characteristic of the district and of intrinsic importance to the landscape and requires careful management of development.
