REASONS FOR DECISION
- The principal issue in these appeals is whether the Tribunal denied a self-represented party procedural fairness by failing to inform her of her right to cross examine the other party's witnesses. The other significant issue is whether the Appeal Panel can conclude that this failure would have made no difference to the outcome of the proceedings in circumstances where those proceedings were brought out of time.
- We have found that the Tribunal's failure to inform the appellant of her right to apply to cross examine the respondent's witnesses was a breach of procedural fairness. We have also found that it is impossible to conclude that the breach could have made no difference to the outcome.
- Accordingly, we have decided to remit the proceedings to the Tribunal for redetermination.
