Introduction
- This is an application for leave to appeal against a decision to refuse to grant, under s 60(2) of the Administrative Decisions Review Act 1997 (NSW) (the ADR Act), a stay or other order affecting the operation of the respondent's decision to revoke the appellant's corporate master licence under s 26 of the Security Industry Act 1997 (NSW) (the SI Act).
- For the reasons set out below, we are of the view that leave to appeal should be refused and the appeal dismissed. This decision does not, however, prevent any party from making a fresh application under s 60(2) of the ADR Act based on new or different evidence or from making an application to revoke or vary an existing order under s 60(2) in the light of new or different evidence.
