Judgment
- In these proceedings, the plaintiff, Anthony Pulitano, claims provision out of the estate of his late father, Rocco Pulitano who died on 4 February 2017 (the deceased), pursuant to s 59 of the Succession Act 2006 (NSW).
- The defendant, Nelia Bayon-On Pulitano, is the deceased's widow and second wife. She is the sole executrix and the beneficiary under the deceased's last will made on 21 July 2016.
- The plaintiff commenced these proceedings on 15 December 2017. It is not in dispute that he is an eligible person under the Succession Act and that the proceedings were commenced within time. The only issue in dispute is whether the plaintiff was left without adequate provision for his proper maintenance or advancement in life.
