1 By its statement of claim, the plaintiff (KSG) advanced two causes of action against the defendant (Open Markets): a claim for damages arising from breaches of the shareholders agreement to which KSG, Open Markets and other shareholders were party () and a claim seeking orders pursuant to ss 232 and 233 of the (Cth), on the basis that the breaches of the SHA were oppressive or unfairly prejudicial to it or discriminatory against it.
